Petaluma Planning Commission March 25, 1986 Regular Meeting 7:30 p.m. City Council Chambers Petaluma, California PRESENT: Commissioners Hilligoss, Libarle, Read, Sobel, Woolsey ABSENT: Head, Serpilio STAFF: Warren Salmons, Planning Director Pamela Tuft, Principal Planner APPROVAL OF MINUTES Minutes of February 25, 1986 were revised and clarified with respect to conditions 1,7 and 8 for the Kaiser Use Permit. Minutes from March 11, 1986 meeting were approved as printed. CORRESPONDENCE: None. DIRECTORS REPORT .86 -87 budget preliminary proposals are now being prepared. The Main Street program will be prepared shortly. Commissioners were asked to submit any suggested budget items to staff. COMMISSIONERS' REPORT Chairwoman Read reported that the General Plan Sub - Committees will meet March 31 thru April 1. Commissioners Head, Sobel and Read attended the Planning Commissioner's Conference in San Diego. NOTE: Strike-Out Type ( - - - -) = Deletion Underline Type ( ) = Addition OLD BUSINESS I. SONOMA HIGHLANDS, DAON CORPORATION, "D" STREET AND HAYES LANE, AP NO. 008 - 032 -42, 008 - 049 -09 and 10, 019 - 012 -15 and 16 (File 11.452B, 3.304A and 6.548A) . 1. Consideration of Draft Subsequent Environmental Impact Report. 2. Consideration of rezoning to PUD. 1 M 3 . Consideration of tentative map. The public hearing was opened. SPEAKERS: None. The public hearing was not closed and was continued to the Planning Commission meeting of April 22, 1986. II. KUYKENDALL - CHATHAM, MCDOWELL MEADOWS PHASE II, NORTH MCDOWELL BLVD., AP NO. 137 -06 -39 (File 6.59A) . 00 1. Continued consideration of request for Tentative Map Extension Phase I q II 63 single - family homes. C) c Mr. Chatham - 3475 Lovel Valley Road, Sonoma - applicant answered Commissioner's questions. A motion was made by Commissioner Libarle and seconded by Commissioner Hilligoss to approve a one -year tentative map extension to May 7, 1987. AYES: ' 5 NOES: 0 ABSENT: 2 PUBLIC HEARINGS III. EAST PETALUMA COMMUTE CLUB, PROPOSED NEW STOPS AT ELY AT GILRIX AND ELY AT CAPISTRANO (File 9.7073) . 1. Consideration of EIQ. 2. Consideration of proposed bus stop additions. The public hearing was opened. SPEAKERS: Chris Rohrs - President East Petaluma Commute Club - answered questions. The public hearing was closed. A motion was made by Commissioner Woolsey and seconded by Commissioner Libarle to direct staff to prepare and post a negative declaration for the proposed bus stops based on the findings in the staff report. AYES: 5 NOES: 0 ABSENT: 2 Findings 1. The proposed bus stops do not have the potential to degrade the quality of the environment. 2. The proposed stops do not have the potential to achieve short -term environmental goals to the disadvantage of long -term goals. 2 flM 3. The proposed stops do not have possible environmental effects which are individually limited but cumulatively considerable. 4. The environmental effects of these two additional stops will not cause substantial adverse effects on human beings, either directly or indirectly. A motion was made by Commissioner Sobel and seconded by Commissioner Hilligoss to recommend to the City Council amending the bus certificate to provide additional stops as proposed per the findings in the staff report. AYES: 5 NOES: 0 ABSENT: 2 Findings 1. The proposed two additional bus stops will conform to the intent of the applicable goals and policies of the General Plan /EDP. 2. The proposed two additional bus stops will not constitute a nuisance or be detrimental to the public welfare of the community. IV. PRISCILLA HIGH, 26 EL ROSE, AP No. 8 -352 -7 (File 1.496) . 1. Consideration of a use permit for an accessory dwelling. The public hearing was opened. SPEAKERS: Kris Brodie - 7220 Bodega Avenue, Sebastopol - answered questions as applicant's contractor. The public hearing was closed. A mot -ion was made by Commissioner Libarle and seconded by Commissioner Hilligoss to grant a use permit to allow an accessory dwelling at 26 El Rose Drive per the findings and conditions listed in the staff report as amended. AYES: 5 NOES: 0 ABSENT: 2 Findings 1. The proposed use, as subject to the following conditions, will conform to the intent of the Zoning Ordinance and the policies of the General Plan/EDP. 2. The proposed use, subject to the following conditions, will not constitute a nuisance or be detrimental to the public welfare of the community. Recommended Conditions 1. The proposed accessory dwelling shall meet all requirements of the Uniform Building and Fire Codes, paricularly with regard to light, ventilation and emergency exits. 3 ij ij hALIRJ 2 . The design of the addition shall be subject to SPARC review. If deemed minor, the review may be Administrative SPARC. 3. Separate meters shall be installed for water; gas and electricity for the accessory unit. 4. NORTH, AP NO. 137 - 010 -84 (File 1.495) . 00 1. Consideration of EIQ. 2. Consideration of a use permit for a fitness center. U �. The public hearing was opened. SPEAKERS: Gary Ramatici - 5 Highland Road, Petaluma - applicant answered questions. The public hearing was closed. A motion was made by Commissioner Hilligoss and seconded by Commissioner Sobel t& approve a mitigated negative declaration based on the findings in the staff report. AYES: 5 NOES: 0 ABSENT: 2 Findings I. The; proposed use is consistent with the applicable portions of the General Plan and the Zoning Ordinance. 2. Any potential significant environmental effects will be mitigated by the conditions of approval of this use permit and in the building permit review of the proposed tenant improvements. 3. The parking already provided on the site appears to be adequate to meet the expected requirements of this project together with the other uses of the site. A motion was made by Commissioner Sobel and seconded by Commissioner Woolsey to grant a use permit per the findings and conditions listed in the staff report. AYES: 5 NOES: 0 ABSENT: 2 Findings 1. Thei proposed use is subject to the following conditions, will conform to the intent of the Zoning Ordinance and the policies of the General Plan/EDP. 4 2. The hours of operation shall be 5 :00 AM to 10:00 PM, Monday through Friday and 8:00 AM to 6:00 PM Saturday and Sunday. Maximum occupancy, including staff shall be 30 persons. 2. - The unusable three parking . spaces in the way of the recently completed driveway onto Redwood Way shall be blacked -out. 3. The new windows shall be dual - glazed, any openings shall be weatherstri ea and the space shall be air- conditioned (with an necessary appropriate noise, baffles on the air ducting system ). Doors are not to be lett in open position bef6re 9AM and after .8PM. In the event that noise from the fitness center becomes a problem for adjoining uses, a noise study paid for by applicant shall be conducted and all recommended mitigating measures shall be installed by the applicants. 4. The use permit for this fitness center shall be subject to periodic review and may be recalled_ in the case of problems such as noise, parking,, etc. 5. Any revisions to the exterior of the building will be subject to SPARC review. Minor changes may be handled with an administrative SPARC review. 6. Any tenant improvements shall conform to UBC and Fire Codes. 7. Building leasing agent shall acknowled e in writin that future neighboring tenants must be compatible with possibly noisy aspects of the aerobics /fitness center. PLANNING MATTER VI. SONOMA COUNTY JUNIOR COLLEGE DISTRICT, ELY BLVD. NORTH, EAST OF CYGNUS WAY, AP NO. 136- 120 41 (File 11.851) . 1. Preliminary response to Sonoma County Junior College District's proposal to locate a Junior College in Petaluma. A motion was made by Commissioner Libarle and seconded by Commissioner Hilligoss to approve the Resolution as drafted by staff. AYES: 5 NOES: 0 ABSENT: 2 RESOLUTION IN RESPONSE TO SONOMA COUNTY JUNIOR COLLEGE DISTRICT'S NOTICE OF PROPOSED ACQUISITION 5 NFL WHEREAS, California Education Code Commission to respond to a notice of board of a college district; and Section 81305 requires the Planning proposed acquisition by the governing WHEREAS, the Sonoma County Junior College District has given written notice of its intent to purchase approximately 40 acres on Ely Boulevard North, .commonly known as the Bogart property, Sonoma County Assessor's Parcel No. 136- 120 -01; and WHEREAS, application has been made by the Sonoma County College District for the annexation of said property into the corporate limits of the city of Petaluma, and to amend the City's General Plan, Environmental Design Plan, and zoning map accordingly; and �.I WHEREAS, an environmental assessment of the site's constraints has been written ;in response to the District's application and reviewed by the Commiss'i'on; and WHEREAS, the environmental assessment identified no adverse conditions of the site or its environs which would prohibit a college campus with the proper planning and implementation of mitigation measures; and �a WHEREA +S, an Environmental Impact Report will be completed and reviewed by the Commission upon submission of a more detailed plan for the college at the site; and WHEREAS, this response in no way constrains the Commission from reviewing and recommending conditions of approval of the District's proposal based on recommendations of the EIR; and WHEREAS, the Petaluma City Council is on record as supporting the establishment of a permanent college site in the Petaluma area by stating, in part: "WH,EREAS, the Petaluma City Council recognizes that the quality of life' in our community is fundamentally dependent on the quality of the educational opportunities available to our citizens; NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council endorses and supports the acquisition by the College of a permanent site in the Petaluma area; and, BE IyT FURTHER RESOLVED that the City of Petaluma shall provide whatever assistance the City can offer to expedite the College's efforts to locate a suitable site." (Resolution 9668 N.C.S.) ; and "B& IT RESOLVED, that the council of the City of Petaluma urges the Junior College Board to proceed apace to establish the long needed permanent home for a major Junior College facility in Petaluma; and, NOW THEREFORE BE IT FURTHER RESOLVED, that the Council of the City of Petaluma is in full support of Site Selection Committee's recommendations and will to its fullest extent support the Junior 0 450 College Board's final choice for the location of the new Petaluma Center." ( Resolution 9798 N . C . S . ) NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Petaluma supports the concept of a permanent college facility in Petaluma and finds that, based upon the environmental assessment, the project site may accommodate a college facility with proper site design and implementation of mitigation measures as deemed necessary in the environmental impact reports.
