PUBLIC COMMENT (15 minutes maximum) . The Planning Commission will hear ;public comments only on matters over which they have jurisdiction. There will be no Commission discussion. The Chairman will allot no more than ifive minutes to any individual. If more than three persons wish to speak "; their time will be allotted so that the total amount of time allocated to this agenda item will be 15 minutes. There was no public comment. CITY OF PETALUMA /MOPA, PETALUMA MARINA /OFFICE COMPLEX, AP NO.'s 005 - 060 -24, 27, 28 (File 3.351) . 1. Continued from January 31, 1987. Per applicant's request and staff recommendation, this matter was continued to the Planning Commission meeting of March 24, 1987. II. LARRY A. JONAS, AARON ACRES ANNEXATION, 1003 and 1030 WESTERN AVENUE, AP NO.'s 019 - 110 -34 and 36 (File No. 3.366) . 1. Consideration of EIQ . 2. Consideration of prezone to R -1, 6,500, R -1 10,000 & R -1 20,000. This item was continued to the Planning Commission meeting of March 10, 1987 to permit Council to reconsider tentative General Plan designation. III. TIM RAY, DWELLING GROUP, 517' WEBSTER STREET, AP No. 8- 011 -30, (File 1.52.3). 1. Consideration of Conditional Use Permit to allow creation of a 2 -unit dwelling group. The public hearing was opened. SPEAKERS : Tim Ray - applicant, answered questions regarding project. The public hearing was closed. The proposed use, as subject to the following conditions, will conform to the intent of the Zoning Ordinance and the policies of the General Plan / EDP. 2. The proposed use, subject to the following conditions, will not constitute a nuisance or be detrimental to the public welfare of the community. Conditions 1. Easton - Representing Chief Auto Parts - Wanted alternative if agreement regarding shared drive with shopping center cannot be reached; answered general questions. The public hearing was closed. Because this site has long been developed, the project does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife species to drop below self sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal, or eliminate important examples of periods of California history or prehistory. B. The project as conditionally approved, does not have the potential to achieve short term to the disadvantage of long term environmental goals. C. Because no additional development is anticipated as part of this project, the project does not have impacts which are individually limited but cumulatively considerable. D. The project as conditionally approved, does not have environmental effects which will cause .substantial adverse effects on human beings either directly or indirectly. A motion was made by Commissioner Libarle and seconded by Commissioner Bennett to issue a use permit based on the findings and subject to the conditions as follows: COMMISSIONER c6mmIS'SIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER Findings: BENNETT - AYE DAVIS - AYE HEAD - ABSENT LIBARLE - AYE PARKERSON - AYE READ - AYE TARR - AYE 1. This site has long been developed and used by neighborhood residents with adverse effects and the use is required by public convenience and necessity. 2. The proposed use is in accord with the objectives of the Zoning Ordinance and the purposes of protecting and servicing the commercial center in the Central Commercial District in which the site is located. 3. The use will not be a nuisance to residences and other surrounding uses. 4 169 4.. The use as conditioned will not cause traffic hazards or undue traffic congestion but rather will mitigate existing traffic conflicts. 5. The proposed structure and use, subject to the conditions, will conform to the requirements and the intent of the Petaluma General Plan and Environmental Design Plans and this use will not, under the circumstances, constitute a nuisance or be detrimental to the public welfare of the community. 2. There shall be no storage or sale of vehicles on this site, no repair or parts installation, no outdoor display of parts, tires or other products related to the business and no parking lot vendors; i.e. no sales of laser art, velvet paintings, tools, pottery, etc. 3. This use permit may be recalled to the Planning Commission for review At any time due to complaints regarding traffic congestion, noise generation or other potentially objectionable operating characteristics. At such time the Commission may appeal the use permit or add or modify conditions of approval. 4. This project shall be subject to review by SPARC. SPARC shall particularly require an upgrade to the architecture of the proposed building at this prominently site, the shielding of public views of the loading area by ample landscaping, the addition of windows on the McDowell Blvd. elevation, the protection of parking spaces and the building by landscaping, and general upgrading of the perimeter landscaping of this site. 5. Free- standing signs shall be five foot high maximum, monument style only, in conformance with City policy on such signs for properties on E:. Washington Street. 6. The driveway on East Washington Street on -site shall be closed and the curbcut removed and sidewalk replaced to the satisfaction of City staff. The area thus freed shall be reconfigured with landscaping and parking to SPARC approval. 5 Conditions : CO 1. The following conditions of the Fire Marshal must be met: ® a. Provide second exit from ". sales and display area - "cannot exit through storage area ® b. Provide signs over exit doors stating - "This door to remain unlocked during business hours". Letters shall not be less than 1" high. C. Post address at or near main entry door - minimum two inch letters. d. Provide fire extinguisher 2A rated ABC dry chemical type as required by the Fire Marshal, location on plan acceptable. e;. No extension cords. All equipment and appliances to be direct plug in. f. Provide metal or flame retardant plastic waste cans. 2. Consideration of possible revisions to sections of Zoning Ordinance related to FEMA Flood Plain Regulation update. This item was removed from the agenda based on advice from FEMA. VI. PLANNING MATTER. 1. Rules of order discussion. Rules of Order items to be discussed at next Planning Commission meeting: Abstention - clarify contradictory terms regarding conflict of interest. Number of absences allowed. Term of office Meeting length and starting time Pertinent Municipal Code items to be included in Rules of Order. VII. COUNCIL/ COMMISSION JOINT MEETING. Agenda discussion. 1. General Plan follow-up: implementation priorities with respect to Commission responsibilities. 2. Appeals: Understanding Council decisions modifying Planning Commission recommendations / actions. 3., Enforcement: Follow -up enforcement of Commission/ Council actions and basic zoning provisions, staffing and priority. 4.
