PUBLIC COMMENT (15 minutes maximum). The Planning Commission will hear ;public comments only on matters over which they have jurisdiction. There will be no Commission discussion. The Chairman will allot no more than five minutes to any individual. If more than three persons wish to speak, their time will be allotted so that the total amount of time allocated to this agenda item will be 15 minutes. There were no speakers. CORRESPONDENCE Letter regarding the Jonas project was distributed. DIRECTOR'S REPORT The appellant for Yardbirds has withdrawn the appeal. COMMISSIONER'S REPORT 1 216 OLD BUSINESS I. YARDBIRDS CENTER, 2000 LAKEVILLE HIGHWAY, AP NO. 005- 050 -22 (File No. 5.100) . 1. Consideration of appeal of administrative decision on height of free - standing sign. The appeal was wirhdrawn. a NEW BUSINESS Public Hearings II. FOWLER, 760 BODEGA AVENUE (4 LOT SUBDIVISION) AP NO. 006- 480 -21 (File No. 6.798) . 1. Consideration of EIQ. 2. Consideration of Tentative Map. The public hearing was opened. SPEAKERS: Don Davis - 820 Ruth Court - Traffic concerns regarding Bodega, road cannot extend through his property. Mr. Mafailadin - 810 Ruth Court - Ruth Court was a private street; concerns with a temporary road being built as relates to proper drainage. Dr. Patter - 507 Larch - Wanted to develop 10 -12 years ago but City told him he must put in road, drainage, sewer improvements; does not feel lot split should be allowed until road has been extended. Ellie Fowler - Described drainage problem with neighbors; described her property as being lower than others on Ruth Court. Bill Meyers - 800 Bodega Avenue - Is flooded from Fowler property now - temporary road will cause more problems for his property. Tom Hargis - City Engineer - answered questions regarding sewer capacity; drainage concerns (near Bodega) ; temporary road standards; all- weather roads; increased traffic on Bodega. The public hearing was closed. A consensus was reached to continue this item to the Planning Commission meeting of May 26, 1987 to allow staff time to present more information regarding the illegal use on the property, flooding, and access road improvements. 2 21'7 III. OIL WELL, 601 EAST WASHINGTON STREET, AP NO. 007 - 057 -42 (File .No. 1.528). 1. Consideration of EIQ. 2. Consideration of Conditional Use Permit for 3 -bay fluid exchange and lube business. • The public hearing was opened. SPEAKERS: Calvin Martin - applicant architect/ representative - answers questions regarding operations; recycle of used fluids; details of angled exiting on Washington; employee parking on -site not on Edith St. Victor- DeCarli - (neighbor) - Feels hours should be shortened; concerns regarding fire danger, parking on Edith St., odor problems, noise problems. The public hearing was closed. A motion was made by Commissioner Read and seconded by Commissioner Bennett to direct staff to prepare a mitigated negative declaration based on the following findings: COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER Findings BENNETT - AYE DAVIS - AYE HEAD - ABSENT LIBARLE - ABSENT PARKERSON - ABSENT READ - AYE TARR -AYE A. Because this site has long been developed, the project does not have the potential to degrade the quality of the environment, or eliminate important examples of periods of California history. B. The project as conditionally approved, does not have the potential to achieve short term to the disadvantage of long term environmental goals. C. Because no additional development is anticipated as part of this project, the project does not have impacts which are individually limited but cumulatively considerable. D. 'The project as conditionally approved, does not have environmental :effects which will cause substantial adverse effects on human beings either directly or indirectly. 3 218 E. That the anticipated adverse impacts to traffic and circulation patterns will be satisfactorily mitigated by the restructuring of the exit driveway on East Washington Street to prohibit entry and to restrict exiting traffic to right turns only. This site has long been developed and used by neighborhood residents without adverse effects and the use is required by public convenience and necessity. 2. The proposed use is in accord with the objectives of the Zoning Ordinance and the purposes of protecting and servicing the commercial center in the Central Commercial District in which the site is located. 3. The use will not be a nuisance to residences and other surrounding uses. 4. The proposed use, subject to the conditions, will conform to the requirements and the intent of the Petaluma General Plan and this use will not, under the circumstances, constitute a nuisance or be detrimental to the public welfare of the community. Conditions 1. The following conditions of the Fire Marshal must be met, prior to occupancy: 1. Provide detail for waste oil tank storage unit. 2. Provide fire extinguisher 2A rated ABC dry chemical type as required by the Fire Marshal. 3. Provide absorbent material, containment drain and proper tools for handling spills. 4. No extension cords. All equipment and appliances to be direct plug in. 5. Provide metal or flame retardant plastic waste cans. 6. Post address at or near main entry door - minimum two inch letters. 1 4 219 2. The use permit shall permit engine oil, automatic transmission and other automotive fluid exchange and lube operations. No general walk -in retail sales is permitted. 3. There shall be no storage or sale of vehicles on this site, no repair or parts installation excepting oil, air and fuel filters, and parts ' associated with auto fluid exchange no outdoor display of parts, tires Zr other products related to the business and no parking lot vendors; i.e. no sales of laser art, velvet paintings, tools, pottery, etc. G 9q 4. This use permit may be recalled to the Planning Commission for review ❑ at any time due to complaints regarding traffic congestion, noise _ generation or other potentially objectionable operating characteristics. ❑ At such time the Commission may repeal the use permit or add or ❑ modify conditions of approval. 5. This project shall be subject to review by SPARC. Front and street side landscaping depth shall be increased, subject to SPARC review and approval. SPARC shall place particular emphasis on architectural design, utilizing landscaping to enhance the corner, and on -site traffic movement including identification of stacking lanes. 6. A free - standing sign shall be five foot high maximum, monument style only, in conformance with City ordinance for such signs for properties on E. Washington Street. 7. The driveway on East Washington Street shall be restructured, to the satisfaction of the City staff, so as to enter Washington at an angle to force right turn exit only movement. An exit only sign shall be installed facing East Washington Street and a right turn only sign shall 'be placed for exiting traffic, subject to staff review and approval. 8. A automobile cross -over easements between project site and neighboring property shall be pursued with reasonable business diligence by the applicant and shall be recordle&-between- this --property an-d--the-a-dja- cent- lrroperty A.P. Discussion: Commissioners objected to deletion of travel and education for Planning Commissioners. It was agreed that a letter regarding this would be drafted and sent to City Council and City Manager. V. RULES OF ORDER 1. Consideration of proposed amendments to Rules and Regulations. for the Transaction of Business. Continued from April 14, 1987. A motion was made by Commissioner Read and seconded by Commissioner Bennett to adopt the proposed amendments to Rules and Regulations for the Transaction of Business in regard to the meeting starting times and , adjournment. Time changes to begin with meeting of May 26, 1987. Balance of amendments to be discussed at meeting of May 12, 1987. Regular meetings of the Commission shall be held on the second and fourth Tuesday of every month at 7 :00 PM -7-39 --FIM unless otherwise decided by the Commission.
