PUBLIC .COMMENT : (15 minutes maximum) . The Planning Commission will hear public comments only, on matters, over which they have jurisdiction. There will be no Commission discussion. Petaluma General ,Plan wins State award. s 1 287 COMMISSIONER'S REPORT: Acting Chairman Libarle welcomed Commissioners Doyle and obel and new Planner Brad Ellison. PUBLIC HEARING I. DOMINO'S PIZZA, 1060 PETALUMA BLVD. NORTH, PART OF AP NO. 150 - 010 -15, (File No. 1.539) . 1. Consideration of E.I.Q. Go 2. Consideration of Use Permit for a pizza facility at the former West America Bank building at 1060 Petaluma Blvd. North (in the Town and Country Shopping Center) . O ® The public hearing was opened. SPEAKERS: Dave McClain - 2014 Caulfield Lane - applicant; discussed drivers speed requirements for employment; asked questions regarding condition recommending tree planting and trash program. The public hearing was closed. A motion was made by Commissioner Parkerson and seconded by Commissioner Read to direct staff to prepare a Mitigated Negative Declaration based on the findings listed in the staff report. Because this site has long been developed, the project does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife species to drop below self sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal, or eliminate important examples of periods of California history or prehistory. B. The project as conditionally approved, does not have the potential to achieve short term to the disadvantage of long term environmental goals. C. Because no additional development is anticipated as part of this project, the project does not have impacts which are individually limited but cumulatively. considerable. 2 .o ,16 D. The project as conditionally approved, does not have environmental effects which will cause substantial adverse effects on human beings either directly or indirectly. A motion was made by Commissioner Bennett and seconded by Commissioner Parkerson to grant a use permit based on the findings and subject to the conditions listed in the staff report as follows. The site has long been developed and used by neighborhood residents - without adverse effects and the use is required by public convenience and necessity. 2. The proposed use is in accord with the objectives of the Zoning Ordinance in that fastfood is a conditional use in this zoning district. 3. The use will not be a nuisance to residences or other surrounding uses. 4. The use as conditioned will not cause traffic hazards or undue traffic congestion but rather may reduce traffic congestion on East Washington Street because it will obviate the need for cross -town delivery trips for Domino's Pizza. 5. The proposed use, subject to the conditions, will conform to the requirements and intent of the Petaluma General Plan and this use will not under the circumstances constitute a nuisance or be detrimental to the public welfare of the community. Conditions: 1. Four street trees in holes sawcut behind the curb shall be provided approximately 25' on center along the frontage of the property. Placement, spacing, species selection and planting detail subject to City staff approval. 2. This project shall be responsible for installation of two trees in the north end of the concrete median island in Petaluma Blvd. North in front of the project site if space can be found avoiding underground utilities. The project shall guarantee maintenance of same for a minimum three -year break -in period. Placement, species selection, and planting details subject to City staff approval. 3 3. Arrangement for disposition of trash from this operation shall be to staff approval. If a trash enclosure is required, it shall be built to City SPARC Standards. 12. This Use Permit may be recalled to the Planning Commission for review at any time due to complaints regarding traffic congestion, noise generation or any other operating characteristics. At such time the Commission may repeal the Use Permit or add or modify conditions of approval. 13. There shall be no open storage of equipment, materials, trash, litter, palletts, packaging or containers on the site. 14. Any future use which requires a Conditional Use Permit shall obtain such a permit prior to commencement of business activity. PLANNING MATTERS II. PETALUMA REDEVELOPMENT AREA #2 - CONSIDERATION OF REDEVELOPMENT PROJECT BOUNDARIES. A motion was made by Commissioner Sobel and seconded by Commissioner Bennett to recommend that the redevelopment area be called the Petaluma Community Development Project. 4 4. All requirements of the Fire Marshal for this project shall be met. 5. Exterior modifications to the building or landscaping if any, are subject to Site Plan and Architectural Review per Zoning Ordinance requirements. 00 6. Any outdoor advertising sign shall be submitted for review and Iq I approval to the Community Development and Planning Department. A ® sign permit will be required. ® 7. The existing signs for Westamerica Bank with the exception of the one on the building facing toward Petaluma Blvd. North shall be removed. 8. As requested by the applicant, hours of operation shall be from 11: AM to 12:00 Midnight Sunday through Thursday and 11: AM to 1:_AM .Friday and Saturday. 9. Ongoing activities shall comply with applicable Ordinance and Municipal Code performance standards; i.e. noise, odor, etc. . 10. Employees of this facility shall not be required to park off -site. 11.. All existing, and upon installation, any future outdoor mechanical equipment shall be fully visually screened subject to the approval of the Community Development and Planning Department. Applicable Standard Conditions: 12. COUNTRY CLUB ESTATES - CONSIDERATION OF COUNTRY CLUB ESTATES PARK DESIGN REQUEST FOR REIMBURSEMENT OF EXTRAORDINARY IMPROVEMENT COSTS - MCNEAR AVENUE. A motion was made by Commissioner Read and seconded by Commissioner Parkerson to recommend approval of Extraordinary Improvement Costs in the amount of $9,480 for the development of Country Club Estates Neighborhood Park based on the following findings: COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER Findings BENNETT - YES SOBEL - YES DOYLE - YES LIBARLE YES PARKERSON - YES READ - YES TARR - ABSENT 1. That it is in the public interest to allow development of the proposed extra improvements to enhance public use and enjoyment and to. improve serviceability to the facilities. 2. That the placement of rip. rap is an appropriate erosion prevention measure and not within the realm of extraordinary improvements. IV. PLANNING COMMISSION REORGANIZATION - ELECTION OF OFFICERS.
