The Planning Commission encourages applicants or their representative to be available at the meeting to answer questions so that no agenda item need be deferred to a later date due to a lack of pertinent information. STAFF: Warren Salmons, Planning Director Pamela Tuft, Principal Planner Jenny Cavanagh, Planning Technician APPROVAL OF MINUTES Minutes of July 28, 1987 were approved with corrections on pages 6 & 11. PUBLIC COMMENT (15 minutes maximum) . The Planning Commission will hear public comments only on matters over which they have jurisdiction. There will be no Commission discussion. The Chairman will allot no more than five minutes to any individual. If more than three persons wish to speak, their time will be allotted so that the total amount of time allocated to this agenda item will be 15 minutes. Linda Kade - AIA - Representative of Phoenix Theater owner* Ken Frankel - working for an architectural solution to dance hall problems. As seen from Mainstreet point of view, feels dance hall is a good use of Phoenix Theater space. Ken Frankel - Phoenix Theater owner - feels City is acting unfairly in trying to close dance hall. Feels all problems can be taken care of. Tom Gaffey - Phoenix Theater Manager; feels all problems can be eliminated. Invited all Commissioners to visit dance hall. 1 305 COMMISSIONER COMMENT (15 minutes maximum). Commissioner Read - Reported on the August 4 study session - absent members opinions were missed. Commissioner Sobel - Reported that he had visited the Phoenix Dance Hall and rioted the problems outside. BAYWOOD TEXACO, 910 BAYWOOD, AP NO. 005 - 202 -01, (File No. 1.540), Continued from July 28. i. Continued consideration of EIQ. 2. Continued consideration of Conditional Use Permit for Mini - Market in Conjunction with Service Station. The public hearing was closed at the July 28, 1987 meeting. This item was continued per the applicant's request to the meeting of Wednesday, September 9, 1987 per Commission consensus. II. PHOENIX THEATRE, 201 EAST WASHINGTON STREET, AP NO.'s 006 - 362 -12, 21 (File No. 1.541), Continued from July 28. 1. Continued consideration of EIQ. 2. Continued consideration of Conditional Use Permit for Dance Hall. This use permit application was withdrawn by the applicant. The Commission reaffirmed its position that a use permit be required before this use can commence. A motion was made by Commissioner Bennett and seconded by Commissioner Tarr to reaffirm its direction to the applicant to cease the dance hall use until a valid use permit is secured. Consideration of Conditional Use Permit for an Accessory Dwelling. The public hearing was opened. SPEAKERS: None. The public hearing was closed. A motion was made by Commissioner Tarr and seconded by Commissioner Sobel to grant a use permit subject to the findings and conditions listed in the staff report as amended. The proposed use, subject to the following conditions will conform to the intent of the Zoning Ordinance and the policies of the General Plan /EDP. 2. The proposed use, subject to the following conditions will not constitute a nuisance or be detrimental to the public welfare of the community. Conditions! 1. The accessory dwelling shall be subject to review by the Site Plan and . Architectural Review Committee ( SPARC) before issuance of a building permit (per Zoning Ordinance Section 26 -401) . 2. A private fenced outdoor yard area shall be provided for the accessory dwelling unit subject to SPARC approval. 3. The sealed garage door opening in the northern wall of the proposed accessory dwelling shall be removed and replaced with appropriate wall material subject to approval of SPARC and the City Building Inspection Department. 4. Driveway and cracked or uneven sidewalk slabs along the front of the property shall be replaced or repaired subject to approval by City Engineer. F, 3 M 5. Fencing with missing or broken boards shall be replaced with new material matching the type and color of the existing fence prior to issuance of the certificate of occupancy. 6. Broken and undersized windows shall be replaced with new windows providing window area as required by the U.B.C. , subject to approval of Chief Building Inspector. 7. Gas and electric meters separate from the principal dwelling shall be provided for the accessory dwelling. 00 8. Consideration of Conditional Use Permit for a Machine Shop and Related Activities. The public hearing was opened. SPEAKERS: Mary,`Ellen O'Neil - Dividend Development - Representative of building owner - Building is concrete tilt -up; offices are sound - proofed; landscaping will be redone; parking will not be a problem. Peter, Johnson - Applicant Realtor - No problems with present facility; landscaping will be maintained; no hazardous waste problems. The public hearing was closed. A motion was made by Commissioner Parkerson and seconded by Commissioner Tarr to direct staff to prepare a mitigated negative declaration based; on the findings in the staff report. Due to the developed nature of the existing site the project does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause fish or wildlife population to -drop below self- sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of major periods of California history or prehistory. b. The project as conditionally approved does not have the potential to achieve short term to the disadvantage of long term environmental goals. C. Because the project does not include additional phased development the project as conditionally approved does not have impacts which are individually limited but cumulatively considerable. d. The project as conditionally approved does not have environmental effects. .which -will -cause substantial adverse - effects on :human beings either directly or indirectly. e. The project site mitigates possible adverse noise effects by its great distance from any noise sensitive receptors such as housing. Tenant improvements will include noise control as required. A motion was made by Commissioner Read and seconded by Commissioner Parkerson to approve the use permit subject to the findings` and conditions listed in the staff report. The proposed use, subject to the conditions of approval, conforms to the intent and requirements of the zoning ordinance and the General Plan. 2. This project will not constitute a nuisance or be detrimental to the public welfare of the community due to the mitigation measures incorporated in the conditions of approval. Conditions 1. The building shall be designed to meet the noise standards specified 4n the Uniform Building Code, Section 22 -301 of the Petaluma Zoning Ordinance, and the 1987 General Plan. Design criteria shall be specified in a noise study prepared by a City- approved licensed 5 �; ,I e; acoustical engineer. Noise study shall be subject to the approval of the Community Development Director and the Chief Building Inspector and design criteria shall be implemented prior to occupancy. At no time shall future noise levels exceed City Standards, i.e. Zoning Ordinance and General Plan, either off -site or within other areas of the building occupied by tenants other than Donal Machine, Incorporated. 2. All work - related activities shall take place indoors. 3. No storage of any type shall take place outdoors (i.e., customer 0 vehicles, machinery, equipment, parts, materials, items under repair, trash, scrap material, etc.) . To achieve this, a container for trash O and a container for scrap material shall be provided indoors. ® 4. This project shall be subject to SPARC review with special emphasis on the following: a. Parking area shall meet City Standards. b. The existing dumpster on the site shall be relocated indoors or provided with a trash enclosure meeting City Standards prior to occupancy by Donal. C. The area west of the detached lease space shall be landscaped and maintained. d. Landscaping shall be provided along the west side of the mechanical equipment area, subject to staff approval. e. Area between the parking lot and the loading area (along west elevation) shall be landscaped. 5. This use permit may be recalled to the Planning Commission at any 'time due to complaints regarding noise generation or other operating characteristics. At such time, the Commission may repeal the use permit or add modified conditions of approval. 6. No signs may be erected on the site without issuance of a sign permit. 7. If applicable to the parking area, this project shall conform to current Council policies on floodplain development; i.e., there shall be zero net displacement of flood waters in the flood plain, subject to the satisfaction of the City Engineer. If the City Council should change that policy, this condition will be revised to reflect the change. 8. All requirements of the Chief Building Inspector shall be met: a. Provide toilets for men. and women. 9. All requirements of the City Engineer shall be met: a. Comply with requirements of Industrial Waste Inspector: floor drains need to be plugged. 10. All requirements of the Fire Marshal shall be met. R Hui V. MCNEAR RESIDENTIAL PUD, PETALUMA BOULEVARD SOUTH, AP NO's 006 - 450 -04, 13 and 006 - 460 -01, 06 (File No. 6.839) . 1. Consideration of EIQ . 2. Consideration of Vesting Tentative Map for 198 unit residential condominiums. The public hearing was opened. SPEAKERS: Walter Kieckefer - 472 Ignacio Blvd., Novato - developer; answered questions regarding condominium conversion, parking, etc. The public hearing was closed. After Commission discussion, this item was continued to the meeting of August 25 for clarification from staff regarding existing condominium conversion policy, parking expansion upon conversion, rental for low and moderate income renters and tenant protection upon conversion.
