AILEEN TOCCHINI, 904 "C" STREET, AP NO. 008 - 361 -46, (File 1.538). 1. Consideration of EIQ. 2. Consideration of conditional use permit to allow a day care service for up to twelve children. 1 This is a public hearing continued from the Planning Commission meeting of September 9, 1987. SPEAKERS: Aileen Tocchini - applicant - 904 C Street - described her day care center operations and her search for a new location, hours of operation, etc. Steve. Galtney - 913 B Street - Concerns regarding noise, rear fence between his backyard and Tocchini's being pushed over by tree - children's noise complaints. Dan Tocchini - described development plans for new pre - school - cannot take tree facing 913 B Street down but will fix the fence. John Rankin - Applicant's lawyer Parking and traffic negligible, lack of complaints regarding present operation. Edna Flor - 22 10th - Back part of lot is next to Tocchini property - no complaints with traffic, _feels..center is a good one_. Sandy McMann 1204 Kathlyn Way - has a child at Tocchini day care - feels center is very good. Jerry Amarol - 750 Cindy Lane - has children at Tocchini day care - feels center is very good. Marge - 415 7th St. #19 - has children at Tocchini day care - very good day care. Ray Williams - 923 Ashwood Ct. - Has had day care from Tocchini day care - very good center. Bill Jones - 905 C Street - Does not feel neighborhood is proper location for a large day care center - residential neighborhood is incompatible for day care center. Gail Baker - 1400 Skillman Lane - has child at day care - very good L.Gll LGl Jeff Ludwig - Consulting Planner for applicant - General Plan expresses encouragement of daycare; noise problem negligible; State approved center; suggests use permit to expire when day care center is established elsewhere; children's outdoor time will be shifted to have fewer children outside at a time. The public hearing was closed. A motion was made by Committee Member Tarr and seconded by Committee Member Parkerson to grant a Mitigated Negative Declaration, based on the amended finding. The use in this location will possibly create adverse environmental impacts in the area of noise which will be mitigated to an acceptable level by conditions of the conditional use permit. A motion was made by Commissioner Tarr and seconded by Commissioner Doyle' to grant the use permit based on the following amended findings and conditions. The proposed use in this location will not constitute a nuisance nor be detrimental to the public welfare of the community. Conditions 1. Outside play hours to be limited to 6- -ch*dren- -a- time - - to --be between the hours of 9 AM and 4 PM only 2. A six -month review by staff (with a notice to Commission) will be required earlier review if complaints are received 3. Fence., tree,, and noise issues to be pursued. Repairs will be made to fence 4. This use permit is for this applicant only at this address only PUBLIC HEARING II. BILLIE ERKEL (CAVANAGH INN), 10 KELLER STREET, AP NO. 008- 051 -05, (File 1.522A). 1.. Consideration of conditional use permit amendment to allow accessory uses at bed and breakfast inn. 329 3 The public hearing was opened. SPEAKERS: Billie Erkel - 10 Keller Street, applicant - described operations, requested up to 100 people outside; parking not a problem on weekends. The public hearing was closed. A motion was made by Commissioner Read and seconded by Commissioner Parkerson to grant a conditional use permit amendment based on the findings and subject to the conditions as amended. The proposed expansion of use, subject to the following conditions, will conform to the intent of the Zoning Ordinance and policies of the General. Plan. 2. The proposed expansion of use, subject to the following conditions, will not constitute a nuisance or be detrimental to the public welfare of the community. Conditions: 1. Permitted accessory uses should be limited to use of the ground floor area of the inn for conferences, weddings, fundraisers and similar events attended by non - guests of the inn. 2. All conditions of the use permit granted February, 1987, shall remain in force and in effect. 3. Inside attendance at- ­aTry­or - evernt-or- activity shall not exceed 49 people; outdoor attendance of up to 10.0 people on Saturday or Sunday daytime only to be allowed 4. Daytime events (occurring and concluding prior to 6PM) shall be limited to a maximum of three events per week; evening events (commencing after 6PM) shall be limited to two per week. Expansion of these limitations are subject to additional consideration by the Planning Commission. 5. Live music, if provided- for accessory activities, shall be staged from inside the house with no outdoor placement of speakers permitted. No amplified music allowed outside 4 331 6. This use permit may be recalled to the Planning Commission for review at any time due to complaints regarding traffic congestion, noise generation or other potentially detrimental operating characteristics. At such time, the Commission may repeal the use permit amendment or add /modify conditions of approval. PLANNING MATTERS III. Annual review of conditional use permit. 0 ® This was not a public hearing - 15 minutes of public comment was allowed: 00 Valentina Majors - 18 Cochrane Way - noise should be treated subjectively not quantitatively; fence needs repair; drug paraphenalia found; parking lot and interior noise objectionable; need more landscaping/ sound proofing. Mike Knope - 16 Cochrane Way - has reduced traffic /vandalism on Cochrane Way; headlights shine over fence, parking lot noise, rug cleaning (outside motor) at night; need increased fence height/ substantiated security during non - daylight hours one year review. Mike Jones - 89 Mission Dr.- General improvement; need fence to Veterans Building; loiterers in adjacent lot (rear corner) . Matt Hudson - Applicant attorney - Some problems have been alleviated; street access from Cochrane may be a problem; back -up generator screening not necessary due to limited use; Landscaping will be taken better care of; metal' shed painting is not necessary; did not feel yearly review of use permit is necessary; noise levels are low. Kitt ,Groves - 13 Cochran Way - Concerns regarding fence height; car lights hit bedroom window; vandalism of fence. A lockable gate may be permitted. 4. All trash bins shall be contained in an enclosure. 5. APPEAL OF ADMINISTRATIVE DECISION, 14 5TH STREET. The question before the Commission is whether the use of the property should be restricted to uses consistent with the General Plan or whether the underlying zoning can be utilized to determine land use in the interim until our zoning map is brought into consistency with the General Plan. R 333 This was not a public hearing, however, the applicant's representative was allowed to speak. Dick Lieb - Applicant's representative - felt that Petaluma's orientation is changing to tourist - oriented; Owner believes a restaurant use is the only economically feasible use; house was boarded and posted "no trespassing" today. AIRPORT OPEN SPACE MASTER PLAN. 1. Review of Petaluma Airport Open Space Master Plan. A motion was made by Commissioner Read and seconded by Commissioner Parkerson to recommend to the City Council approval of the Petaluma Municipal Airport Open Space Master Plan, subject to the recommendations listed in the staff report. Each phase, prior to preparation of construction drawings, shall be subject to specific design review by the Site Plan and Architectural Review Committee and the Parks and Recreation Commission. Master Plan text shall be amended, subject to staff review and approval, as follows: Page 1 - amend fifth paragraph to more accurately portray condition and status of Williamson Act lands. Page 1 - amend last sentence to state "Homes will be both one and two story wood frame structures". 7 334 Page 5 - second paragraph of Features: should insert "proposed" before golf course on Casa Grande. Page 7 - reference to Williamson Act Lands shall include a more definitive reference such as (conceptual design only) . Page 8 - first sentence under Proposed Facilities - access - should read: Proposed pedestrian pathways will ultimately" provide continuous access through the site... Page 11 - last paragraph under Athletic Facilities should be expanded to read: proposed for "lands currently protected under" Williamson Act "should development be proposed". ADJOURNMENT: 10:45 PM.
