DIRECTOR'S REPOR Let-ter received regarding Petaluma Gardens and will
distributed during staff's report.
Agenda revised to include item. #2 for Madison Manor;.
public hearing to consider :a modification to the
previously approved tentative subdivision,map.
Upon. request by Mr;. Robert Hirsch, Chairman Lavin d rected.staff to present
Petaluma Gardens first if there was no objection from anyone in the audience.

Item 3.176 - To consider an application from Robert Hirsch for a revision to
the approved Development Plan for Pe.taluma'Gardens, a P.U.D. located near the
intersection of Washington and Ely (reduction of proposed units from 101 to
57 elderly rental units).

Mr. Vivas pointed out to the Commission that a settlement_- iad been involved
with this project, and,should be considered with the condition's. The public

Motion. introduced by - Comm. Waite,, seconded by -Comm. Tencer; to recommend the
City Council approve the revised PUD Development Plan based upon recommended
findings -an,d conditions, with the following changes: Condition .#6 changed to
read, "13 onsite parking spaces," and Condition #17 the word "ri!quest" changed
to read, "obtain."
AYES: 6 ABSENT: 1 (Harberson)
It was'the consensus of the Commission to recommend the City Council consider
incorporation of the settlement as a condition after coiisultation with the City

1. hn order to receive a housing allotment exempt -on for the project,
not more than fifteen (15) housing units may be constructed in any one
(1) construction year.
2. The applicant shall comply with all requirements of.the City
Engineer outlined in the attached correspondence.

in accordance with Section 26 -400 of the Zoning Ordinance prior to Final

5. Grading and drainage design shall be subject to approval by the

provided on all lots to enclose yard areas behind the building front
walls in accordance with the setback requirements specified in the
Zoning'Ordinance. wherever fencing already exists, the Community
Development Department shall determine which measure should be taken.
8. The CC & R's (Conditions, Covenants and Restrictions) pret;red for
the prpject shall be subject to approval by the City Attorney prior. to
Final Subdivision Map approval.
9. Parcels shall be correctly numbered. All front yard setback lines
shall'.be shown on plans. Gross density figures shown on the
"Plan metric Calculations" chart shall be corrected. The Coma,-nunity
Development Director's signature block shall be provided on plans.

drain to the proposed street.
