The first draft copy should be ready early next week for review. II i COMMISSIONERS' :REPORTS Comm. Tencer wanted to know when the General Plan updates will be presented.. Mr. Freitas advised that two General Plan Land Use Element Amendments occurred in February. Public hearings in con- junction with the Housing Element will be May or j June. The last 1982 amendments will be presented j in the fall. 'I 1. NIZIBIAN SUBDIVISION, CANYON DR. & MT. VIEW AVE. - UNIT DEVELOPMENT PLAN (Tape 016 - 172) Item 3.277 - To consider a unit development plan for the Nizibian (Windmill) Subdivision (AP#'s 19- 232 -06, 16, 19, and 20), 22 custom residential lots to be located at Canyon Dr., and Mt. View Ave. The public hearing was opened by Chairman Lavin. Speakers: Stuart Hirsch, 522 "J" Street, representative of Petaluma Tomorrow Joe Nizibian, 5 Troy Court The public hearing was closed. 1 Comm: Head questioned whether there should be a vote on the unit development plan without specific soils and drainage reports. Chairman Lavin pointed out that it is ,a conceptual overview, and detailed: soil and drainage studies will be presented at the tentative map stage. Motion by Comm. Harberson, seconded by Comm. (AP #'s 48- 141 -42, 43). Popp 'to recommend the' City Council approve the subdivis'i.on ordinance modification for the Streeter Parcel Map based on recommended findings. AYES: 7 4. Thejpublic hearing was opened and closed. Motion introduced by Comm. Head, seconded by Comm. VILLAGE MEADOWS SUBDIVISION, EDITH /MADISON STRS. - TENTATIVE MAP - EXTENSION OF 'TIME (Tape 532 - 569) Item 6.424 - To consider a request from the McBail Company for a final six montih extension of time (.to September 2 1982) for filing of the final map�for Village Meadows, 67 attached single family dwellings. Motion introduced by Comm. Waite, seconded by Comm. Head to grant a final extension of the Village Meadows Tentative Map to September 2, 1982. AYE S• 7 .I 7. (Ta e 574 - 578) Item 6.340 - To consider a request from the Qantas Development Corp. for a final `six month extension of time (to September 30, 1982) for filing of the final map' for Park Place 6, 117 attached single family units. ADJOURNMENT The meeting was adjourned at 9:18 p.m. Page 5 of 8 NIZIBIAN SUBDIVISION - UNIT DEVELOPMENT PLAN 1 3 ITEM 3.277 FINDINGS AND CONDITIONS i Findings: 1. !Said Plan clearly results in a more desirable use of land and a i ibetter physical environment than would be possible under any single ,zoning district or combination of zoning districts. 2. -"That the PUD District is proposed on property which has a suitable 1{relationship to one (1) or more thoroughfares; and that said !"thoroughfares are adequate to carry any additional traffic I'lgenerated by the development. LO 3. IThat the plan for the proposed development presents a unified and lorganized arrangement of buildings and service facilities which are appropriate in relation to adjacent or nearby properties and that Q ; adequate landscaping and /or screening is included if necessary to co !!insure compatibility. Q 4. 1 ,That the natural and scenic qualities of the site are protected, with adequate available public and private spaces designated on the Unit Development Plan. 5. That the development of the subject property, in the manner proposed by the applicant, will not be detrimental to the public welfare, will be in the best interests of the City and will be in keeping with the general intent and spirit"of the zoning regulation of the City of Petaluma, with the Petaluma General Plan, and with ' applicable Environmental Design Plans adopted by the City. P.U.D. Development Plan conditions: 1. J Project CC & R's shall be submitted prior to final approval of any tentative map for the project and be subject to approval the City Attorney and Community Development and Planning Director prior i to approval of any final map.. 2. 'Development landscape plan shall indicate lawns or mix of ground - cover, shrubs and trees for all units in all yard areas fronting streets. A.mix of landscaping materials shall be required for each ilot, approved by SPARC, and installed prior to occupancy of each dwelling unit. The density of planting materials shall meet City !landscaping standards and shall include street trees as required by II �City Code. ;I 3. ,The project shall be subject to design approval by the S.P.A.R.C. Committee in accordance with Section 26 -400 of the Zoning !Ordinance. Approval; shall be accomplished prior to approval of a tentative map. Conditions shall be incorporated as conditions of ;the- development plan. 4. A permanent maintenance mechanism shall be established for the proposed stone walls at the Mt. View Road entry and any other common improvements. The walls shall be relocated out of the I ublic right -of -way. An erosion control plan and soils study shall be developed and approved prior to the tentative map submittal and be subject to approval of the Community Development and Planning Department and Planning Commission.. 6. A drainage study shall be conducted to determine if the Mt. View Road drainage system will be overtaxed as a result of this project. Necessary improvements shall be reflected on the tentative map. Study to be completed prior to tentative map submittal and be _ subject to approval by the Community Development and Planning Director and Planning Commission. 7. The development plan shall clearly specify building envelopes and setbacks for each lot. 8. If the existing house and barn are not removed, the development Plan should be revised to make sure they do not straddle the proposed lot lines. 9. As a custom lot subdivision, floor plans and exterior elevations shall not be repeated. The development plan and applicable CC & R's shall include all architectural design parameters proposed by the applicants in the Residential Development Control.(Allotment) application. 10. Development plan.approval "shall be, contingent upon approval of the - proposed General Plan /EDP amendment by the City Council. Page 7 of 8 ACORN TERRACE - TENTATIVE MAP - ITEM 6.52 I. FINDINGS: 1.11The proposed subdivision, together with provisions for its design and Lmprovement, is consistent with the General Plan. 2. 3. IThe proposed subdivision is compatible with the objectives, policies, eral land uses, and programs specified in said General Plan. ,The site is physically suitable for the type of development proposed. 4. IThe site is physically suitable for the.proposed density of development. 5. 'The design of the 'subdivision and-the proposed improvements, there ::r will not cause substantial environmental damage, and no substantial or avoidable injury will occur to fish or wildlife or their habitat. 6. 'The design of the subdivision and the type of improvements will not cause serious public health problems. 7. The design of the subdivision and the type of improvements proposed will not .conflict with easement, acquired by the public at large,.for access through or use of property within the proposed subdivision. 8.JIThe discharge of waste from the proposed subdivision into the existing community sewer system will not result in violation of the existing require- ments prescribed by the Regional Water Quality Control Board. References on the map to "Cemetery Lane" shall be changed to "Sycamore Lane The "proposed use" statement shall be revised to delete reference to a recreation building and a sports court. A Planning Director's signature block shall be added to the Map. The modification is necessary for the preservation of and enjoyment of a substantial property right of the petitioner. 3. Granting of the modification will not be detrimental to the public welfare or safety, or injurious to other property in the vicinity. PFTALUi1A LIMOUSINE SERVICE, JOS EPH HARRIS, - AUTOMOBILE•'FOR HIRE PERMIT ITEM 9.174 - FINDINGS 1. The proposal will provide. needed transportation service and will have no significant adverse effect on traffic in the City. 2. The location of the pick -up and delivery points`proposed by the applicant, and the dispatch (after hours) location are appropriate for this use. VETERANS TAXICAB SERVICE, JOHN.REYES - AUTOMOBILE FOR HIRE PERMIT ITEM 9.175 - FINDINGS 1. The proposed taxicab service will have no significant adverse effect on traffic in - the city. 2. 'The pick -up and delivery location is appropriate for this use. The dispatch location is outside the jurisdiction of the city. CONDITIONS 1.
