CORRESPONDENCE: Mr. Freitas advised the Commission that a petition had
been received from the Second St. Property Owners
Association. The petition requests consideration of an
amendment to the General.Plan for the east and west sides of Second Street
between G and H Streets. The Commission was requested to refer this item
to the Planning Department staff for review.
A motion was introduced by Comm. Head, seconded by Comm. Shearer to refer
the re'guest by the Second St. Property Owners Association for review of
amendment to the General Plan to the Planning Dept. staff.

DIRECTOR'S REPORT: Mr. Freitas'reported to the Commission that the McNear
Manor Tentative Map had expired and the allotments lost.
A motion was introduced by Comm. Tencer, seconded by Comm. Shearer, to set a
hearing date for possible rezoning of the former McNear Manor property to
be reclassified to a Study Zone.

Item 1:350' -to consider a use permit application from Matthew Roche for the
purpose of serving alcoholic beverages for consumption on the premises
at the;I,DeSchmire.Restaurant (AP #6- 221 -39). The Planning Director indicated
that the applicant was present and that staff was in agreement with the
applicant.'s request for a delay in installation of some of the improvements
for tto a year.
A motion was introduced by Comm. Popp, seconded by Comm. Waite to approve
the us'e permit based on the standard findings and subject to the conditions
included in the staff report.

ZONING ORDINANCE AMENDMENTS SECTIONS 1 -203, 11 -363, 12 -303, 13 -303, 12 -403,
13 -404 AND_2.1 -407

Public hearing to consider amendments to various Sections of the Petaluma
Zoning Ordinance 107,2 N.C..S. to establish standards for location of amuse-
ment games in businesses which do not have use permits to operate as arcades.
The public hearing was opened.

The public hearing was closed.
A motion was introduced by Comm. Head,.seconded by Comm. Popp'to recommend
that .the.City Council review and approve the proposed zoning ordinance
amendments with the requirement that the installation of one or more games
would require a use permit. Motion failed.
AYES: 2 NOES: 4 ABSENT: 1 (Comm. Harberson)
A motion was then introduced by Comm. Waite, seconded by Comm. Shearer, to
recommend that the City review.and approve the - proposed zoning
ordinance amendments.
AYES: 4 NOES: 2 ABSENT: 1 (Comm. Harberson)
The motion failed for lack of sufficient majority vote. (A six person
Commission requires a 5 aye vote to carry the motion)..
A motion was then introduced by Comm.. Tencer to recommend that the; -City
Council adopt the proposed ordinance with the amendment to the 'definition
"arcade" to exclude those establishments that prohibit minors and that
the requirement for a use permit for those establishments be eliminated.
Motion failed for lack of a second.
It was the unanimous consensus of the Commission to continue this item to
the next regular Planning Commission meeting which will be held on
May 25, 1982.

1. The exterior walls of the building in which the cardroom is to be
located shall be repainted,.subject to administrative design approval, prior
to.�-,opening of the use..
2. The applicant shall comply with all provisions of City Code`Section
6.20 pertaining to cardrooms.
DESCHMIRD RESTAURANT - 304 BODEGA AVENUE
ITEM 1.350 - Conditions
1. Plans providing for improvements to the.par area located behind .
the restaurant (including: asphaltic - concrete paving, concrete curbing
and perimeter landscaping) to City standards shall be ,submitted to the
City for design approval within 30'days and all improvements completed
prior to July 1, 1982.
2. A lease agreement which secures a minimum of eight (8) off-site
parking spaces for a period of at least ten (10.) years shall be
submitted to the City for review and approval within 30 days. Off -site
parking must be improved to conform with applicable'City parking lot,
landscaping and irrigation design standards within one year of use
permit.approval. Plans for such area and proof of lease must be-
approved within 30 days of use permit approval.
3. All existing sculptures, benches, etc. shall be. permanently removed
from the public sidewalk. The front building trim shall be repainted
using the same color. The existing fence located to the rear of the
site shall be repaired.
5. A trash enclosure screen shall be constructed to the rear of the
site within four months, subject to design approval by the Community
Development Department.
