Motion introduced by Comm, Head to recommend the city council approve the
proposed development plan amendment based on standard findings and recommended
conditions., with a- condition added' to read: recommended tb the city council
that it review feedback from the homeowners association. Motion failed for
lack of a second.
Motion introduced by Comm. Tencer;-seconded by Comm. Shearer, to recommend
the city council approve the proposed development plan amendment for Shelter
Hills II based on standard findings and recommended conditions, with
Condition #1 changed to read in line 2: "shall be relocated out of the
Garfield Drive P.U.E.," and Condition #5 changed to read in line l: "Units
o will be moved to provide : a -16' setback from the proposed - school site property
line."

Item-3.263 -..To consider an application from McBail Company to amend the
unit development plan and phasing schedule for the Norths'tar development.
Item 6.489 To consider art application to amend the phasing schedule shown
on the tentative map and modify . certain conditions for this project to
reflect the revisions to the plans.

on, findings previously adopted and recommended conditions, with the

CONDITIONS - P.U.D. DEVELOPMENT PLAN AMENDMENT
1. The six foot high fencing proposed in the rear .yard of lots 2'and
3 shall be relocated out of the Garfield Drive P.U.E.
2. Lots 32, 33,-and 34 shall each be provided with'two outdoor parking
spaces served from the private driveway.
3. The project shall be subject to site plan and architectural approval
in- accordance with Section 26 -400 of the Zoning Ordinance.
4. All fencing, trash enclosure screens, mailbox kiosks, roof pitches,
roofing materials, outdoor lighting, decorative sidewalk textures,
security measures, sound insulation measures, energy conservation
methods and ;remote control garage door openers shall match that used in
the = remainder of the project.
5. Units will be moved to provide a 16' setback from the proposed
school site property line. Heavy evergreen tree screening shall be
developed along the property line which the project shares with the future
school site.
6. The Garfield-Drive-entry to the project shall be improved with a
stamped'concre pattern to match the Me'adowview Drive entry.
7. Mailbox kiosks shall be developed to serve the future tenants.

5. Development landscape plan shall indicate lawns or mix of ground
cover, shrubs and trees for all units in all yard areas fronting
streets A mix of landscaping materials shall be required for each lot,
approved by SPARC, and installed prior to occupancy of each dwelling
unit. The density of planting materials shall meet City landscaping
standards and shall include street trees as required by City Code.
6. The project shall be subject to design approval by the S.P.,A.R.C.
Committee in accordance with Section -400 of the Zoning Ordinance.
Approval shall be accomplishe'd' prior to approval of a tentative map.
Conditions shall be incorporated as conditions of the development plan.
7. Specific design of cul -de -sac parking areas shall be subject to
final approval by the Community Development and Planning Director, City
Engineer and Fire Chief.
8. Mirimp setbacks shall be consistent with R- 1,6,500 Zoning District j
except for those shown on the approved development plan.
9. All dwelling units shall be dt�signed to the approval of.the
Community Development and Planning Director to insure interior sound
levels from exterior noise,sources do not exceed 45 DBA in habitable
rooms and 40 DBA in bedroom areas.
10. Recreational vehicle parking and trailers shall be prohibited in
cul -de -sac parking islands.
11. Landscaping of creek buffer /urban separator shall be consistent
with plans for improvements to Sunrise area buffer.
12. Post and cable fencing along Northstar Drive and where creek buffer
intersects Ely and Maria Drives shall be indicated on Development
Landscape Plan.
13. Landscaping shall be indicated for triangular remainder parcel on'
Maria Drive.' Ownership of .this parcel shall.•be given to the homeowners
association'.
14. All portions of the recreation /detention area not .proposed . to be'
completed with Phase I'shall be-turfed, irrigated;.and maintaine&.until
improvements to those. portions have been made in later phases Irrigation

�J. The proposed subdivision, together with provisions for its
desiign and improvement, is consistent with the General Plan.

CONDITIONS
1. The applicant shall comply with all requirement of the city engineer
outlined below:
A. Use of.the. flood storage basin shall-be engineered so as to detain
the waters at a. rate that is not to exceed the run -off of undeveloped
land for a '24 -hour 100 -year event.
B. The subdivider shall be required to put up half the cost of the
culverts that may be required at Maria and at Ely.
C. The off-site channel.improvements downstream of this property should
be required during Phase III or Phase IV construction stage, whichever comes
first.
D. The extension of sewer mains to serve the properties above this
particular property should be investigated.
2.. All existing widths and grades of adjacent streets shall be shown
on the tentative map. The easternmost street that stubs into Park Place
IV shall line up with the planned Park Place street, and given the same
name., other streets in the project shall be subject to approval by
the City Street Naming Committee. The curved section of Maria .Drive
between Sunrise and Park Place Subdivisions shall be straightened somewhat
to reduce excess curves.
3. Lots shall contain a minimum area of 4.,000 square feet. No lot shall
have a minimum width less than 30 feet at the building setback lines. Front
building setback lines shall vary between 20 and 25 feet to prevent a row
housing visual effect.
4. All grading and drainage design shall be consistent with the require -
ments of. the Sonoma County Water Agency.
5. The Capri Creek right -of -way shall be dedicated to the City.
Creek right -of -way landscaping shall be" maintained by a Homeowner's
Association. 'However, the Sonoma County Water Agency shall be required
to provide for any necessary hydraulic maintenance.
6�. Final subdivision map approval shall be consistent with the
phased housing allotment schedule established for the development, and
map approvals limited to portions of.the project having full allotment
award.
7. Any proposed off -site improvements and easements shall be
subject to written consent by the affected property owner(s).
8.. A masonry wall, of a minimum height of six (6) feet shall.be
erected along the Ely Blvd. frontage in the 'public right -of -way' design
and i:n the location is subject to approval of the City Planning
Director.

10.1 , An assessment district shall be formed prior to approval of the
final map to provide for maintenance of the storm water retention system
forjthe project. This assessment district shall be comprised of all
affected properties within Northstar development area. Details of the
assessment district formation shall be .worked out in conjunction with
thei'Community Development, Public Works, Enaineering and City Attorney
