APPROVAL OF MINUTES The minutes of November 23, 1982 were approved as
submitted.

Friday, 9 a.m. to 3 p.m.

Motion to approve the applicant's request by Comm. Head failed for lack of a second.
Motion by Comm. Tenc.er, seconded by Comm. Hilligoss, to recommend to the city
council that the PUD Development Plan be adopted with the following
conditions 1) That the three models be approved as submitted, and 2) That
the applicant submit at least one additional and distinctly different housing
model Jor approval to be used on approximately one -half of the parcels now
shown 4o be developed with Plan 2, subject to the approval of SPARC, and to
be shown on.the final adopted development plan.

In individual statements given after the above action, it was mentioned
that it was the intent of the commission-in-adopting the above conditions

the St. James school building use permit, based on recommended findings.

for lack of a second.

USE PERMIT FOR SCHOOL
Findings
1. That the proposed use will conform to the requirements and the intent
of the Zoning Ordinance and the Petaluma General Plan/ Environmental
Design Plan and
2. That such use will not. under the circumstances of the particular case
constitute a nuisance or be detrimental to the public welfare of the
community.
Conditions
1. School use shall be limited .to the hours of 9 :00 a. m,.. and, 3•:00 p.m.,
Monday through Friday.
2. The total number of students enrolled at the school shall be limited to
25.
3. That the school serve only students in grades K -12.
4. That high school age students be discouraged from driving to school
and parking in the area.
5. That students not be permitted to loiter outside' the church /school
building.
6. That in the event noise complaints are received such a$ the use of
musical instruments and or a public address system, the school shall be
required to prove compliance with the City's noise performance standard
as outlined -in Section 26 -600 of the Zoning Ordinance, performance
standard procedure, . and Section 22 -301 of the Zoning Ordinance
(performance standard measurement for objectionable elements, noise) .
7. That . the items noted in the attached Fire Marshall/ Building Inspection
letter be completed within 30 days of use permit issuance.
8. That the use permit be reviewed whenever any impacts such as noise,
loitering, or excessive nonresidential parking on the surrounding
neighborhood appears to be occurring...
9. This use permit shall be'reviewe'd in June 1983,

FINDINGS

1.;, The classroom location is adequately isolated to prevent potential
noise disturbances in the residential neighborhood.
2. The classrooms are not expected.to generate any appreciable traffic
or; parking demand in the area.
3. The proposed building design is architecturally compatible with the
existing on -site church.

Co CONDITIONS
1.!, The proposed.addition and future parking lot shall be subject to site
plan and architectural design approval in accordance with Section 26 -400
of the Zoning Ordinance..
2. Permanent parking designed and built to city standards for a minimum
of!14 additional vehicles shall be completed prior to classroom building
■ occupancy, but in no case more then nine months from the date of use
permit approval.
3q A trash enclosrue screen shall be designed to meet city standards and
constructed to accommodate all debris generated by the facility.

2.310 SUSAN DEHAAN, 501 WEBSTER STREET - VARIANCE FOR DETACHED GARAGE
FINDINGS:
_ r
1. There are peculiar and unusual conditions inherent in the property ink,.
question sufficient to cause a hardship in that a previous
non- conforming garage once existed on the property.
2. A hardship peculiar to the property and not created by any act of the
owner exists. At the time the previous garage was built zoning codes
did not exist, or permitted its creation.
3. Such variance is necessary for the preservation and enjoyment of
substantial property rights .possessed by other properties in the same
zoning district and in the vicinity, and that a variance, if granted,
would not constitute a special privilege of the recipient not enjoyed by
his neighbors. Numerous previous garages non- conforming as to
setback and placement have been approved for, replacement where they
have been of the same or . lesser size and in a location which was
same or of a more conforming nature.
4. The. authorizing of such variance shall not be of substantial detriment
to adjacent property in that the proposed garage" will be further from
the neighboring house, than the previous one, and will not materially
impair the purposes of this ordinance or the public interest...

FINDINGS
