AL TARCA AND HENRY,NOYES, 824- PETALUMA BOULEVARD SOUTH - VARI'ANCE Tape 6 - 141). Item 2.311 - To consider a variance request by Al Tarca and Henry Noyes to permit construction ,of a 13 , fo.ot - 6 inch wide.driveway to.serve a proposed parking lot in the rear of 'the building located at 824 Petaluma Blvd. South (formerly Red Carpet Realty). The public hearing was opened. Speakers: Dick Lieb, #1 Bodega Ave:, Petaluma, representing owners Marion Moore 884 Petaluma Blvd. South The public hearing was closed. Motion introduced by Comm. Head, seconded by Comm. Popp, to approve a variance - fora reduced driveway width for 13' 6" as shown on the submitted plan after the- f:irs:t 20' from the front property line;'and that the driveway width be expanded in the sou.therl'y.direct.;on to measure 16 in width between the front property line and a point not less than 20' back from the front property line, based on recommended-findings. AYES: 4 NOES: 0 ABSENT: 3 (Hilligoss, Lavin, & Shearer) Comm. Bond noted that he wanted feedback from the City Engineer regarding draining at-this property. II. NOVAK DEVELOPMENT CO., CASA DEL ORO II, SARTORI-& CASA GRANDE - EXTENSION OF TENTATIVE MAP Tape 141 - 152 Item.6.470 - To, consider a request by the Novak Development Co. to extend the I - : •Id':C Page 2 of 4 PETALUMA PLANNING COMMISSION MINUTES JANUARY 25, 1983 147 II_ Novak Development Co. - continued the time limit for filing the final map and improvement plans for Casa Del Oro'II, 47 proposed single family lots at Sartori and Casa Grande. Motion' introduced by Comm. Bond,, seconded by Comm. Popp, to grant a six month extension forthe Casa Del Oro Unit II Tentative Map to run through 8/2/;83. A Y 'LS: 4 NOES: 0 ABSENT: 3 (Hilligoss, Lavin, & Shearer) i III. 1983.`PLANNING COMMISSION CALENDAR Motilon introduced by Comm. Popp, seconded by Comm. Head, to adopt the proposed 1983 Planning with the deletion of December 27, 1983. AYES: 4 NOES: 0 ABSENT: 3 (Hilligoss, Lavin, & Shearer) PLANNING MATTERS 1. League of California Cities - Names of commissioners.were drawn to determine who would attend the' League of California Cities Conference on March 2 4. An inquiry was made to see if all. members could go to the meeting. 2. Clarification of Condition - All Points Towing, #1 C Street - Use Permit Upon questioning by the Director, it was" the consensus of the Commission that the words "tow truck ":should be deleted from Condition #4, minutes dated.11/23/82. SOUTH - VARIANCE i ITEM 2.311 FINDINGS I. !There are peculiar and unusual conditions inherent in the property in question sufficient to cause a hardship, and that such conditions -are not common to all or most of the properties in the immediate area. r 2. hardship peculiar to the property and not created by any act of the owner exists due to existing building location. 3. !Such a variance is necessary for the preservation and enjoyment of substantial - property rights possessed by other properties in the same zoning district and in the vicinity, and that a variance will not constitute a special privilege of the recipient not enjoyed by his neighbors. 4. iThe authorizing of such variance shall -not be of substantial detriment to adjacent property, and will not materially impair the purposes of the Zoning Ordinance or the public interest.
