PRESENT: Commissioner Head, Hilligoss *, Lavin, Popp, Shearer, and Tencer
*arrived at. 7:40 p.m.
ABSENT: Commissioner Bond
STAFF: Gregory C. Freitas, Community Development and Planning Director
Les Ruh, Assistant City Engineer
APPROVAL OF MINUTES: The minutes of March 22, 1983 were approved as
submitted.
CORRESPONDENCE: Mr. Freitas outlined staff's reply to Mrs. Lelouarn
regarding the condition of Cherry St. Chairman Shearer

staff's reply to Mrs. Lelouarn.
DIRECTOR'S REPORT: Mr. Freitas advised the following were distributed to
each commissioner:
1. Copy of the Housing Element; this will be
updated in August.
2. Copy of le.tt_er from city manager to NOAH
regarding flood questions.
3. Copy of staff's comparison of general plan ands: =
zoning; _
Also, a reminder was given to the commission of a plan- ,
ed workshop with the city council on flood pond /park
basins on 'Monday, April 25th, at 7 p.m.
COMMISSIONERS' REPORT: Comm. Popp addressed Martin Brody, reporter for the
Argus Courier regarding deletions in his article about the
commission's workshop: 1) New state law regarding all .
phases .of planning; 2) EIQ, and reason for it; 3)
Findings re use permits. and variances.

approved* condition to a use permit ,for an accessory dwelling at #I

The public hearing was closed.
Motion introduced by Comm. Popp, seconded by Comm. Head, to approve an amended
Condition #1 of the use permit at #1 Wallace Court to read as follows:
APRIL :12. 1983
Thee unit shall meet the 1979 Uniform Building Code and City of
Petaluma Building Code requirements. Immediate health and safety
LO item's shall be taken care of within 30 days. Remaining building code
occupancy requirements shall be met by May 12, 1983.

III. Ray Cola�izzi, 900 Western Ave., Variance to Delete Parking Requirement

Ave. (APYi.6- 371- 12).for a.variance to-permit a portion of the existing grocery
to be con into rental office space without providing on -site parking.
The public hearing was opened by Chairman Shearer:

The- public hearing was closed.
Motion in roduced by Comm. Lavin, seconded by Comm. Head, to grant a variance for
two on -site parking spaces at 900 Western Ave., based on recommended findings.

Chairman Shearer requested that the Traffic Committee review this area in regard to
parking. Mr. Freitas advised that he would inform the committee of this.

Item 1.382 - To consider a request by Petaluma Poultry Processors for a use permit at ,
2700 Lakeville Highway for the purpose of constructing a 5,900. sq. ft. addition to the
existing processing plant, and a 2,080 sq. ft. addition to an existing shop maintenance
building, and to consider an environmental impact questionnaire for the above.
The public hearing was opened by Chairman Shearer:

Motion introduced by Comm. Head to continue this item died for lack of a second.
Motion introduced by Comm. Lavin, seconded by Comm. Hilligoss, to. continue this
item, to the next meeting of April 26, 1983

PLANNING MATTERS:

Item 6.478 - To consider a request by Oakmead North Bay Partners for an extension of
the time limit for filing a final map for Oakmead North Bay P ark.
Motion introduced by Comm. Head, seconded by Comm. Lavin, . to approve an
extension for the Oakmead North Bay Industrial Park tentative map for an additional
six months to September 20, 1983.
AYES: 6 NOES: 0 ABSENT: 1 (Bond)
Comm. Lavin led a discussion regarding the commisson-'s role should not be involved
with economic justification -with issues brought before it. It was the consensus of the
commission to explore this matter :further. : (Tape 994 -076).

will conform with the list of conditional uses permitted in
the
P.U.D. zone in which the site is located, - and with
the
"Industrial" land use classification specified on the General
-and
Environmental Design Plans.

public welfare of the Community.

Item 2.313
Findings;
1. Peculiar and unusual conditions inherent in the property in
question exist because the site was legally developed prior to the
requirement of on -'site pari king. Such - conditions constitute" a
hardship which is , not common - to most of the properties in the
immediate area
2. The hardship is peculiar to the property and not 'created by any
act of the owner 'because the site was legally developed prior to
the requirement of on -site parking.
3. A variance is necessary for the preservation and enjoyment of
substantial property rights possessed by other properties in the
same zoning district and in the vicinity and would' not constitute. a
special. privilege of. the recipient not enjoyed by- his neighbors -- -
4. The authorizing of such variance will not be of substantial
detriment to the adjacent property, , and _will. not_ materially impair
the purposes of the Zonin * Ordinance or the
