PRESENT: Commissioner Head, Hilligoss, Popp, Shearer, and Tencer ABSENT': Commissioner Bond and Lavin STAFF: Gregory C. Rasmussen, Associate Planner Co APPROVAL OF MINUTES: Mr. Freitas' advised that he had received a letter from the Petaluma Poultry Processors requesting the word "Lakeville" be inserted-after the word "new" in the first sentenc -of Cond. #11, page 7 of 12. The commission did not approve. the requested chance on Cond. #5, Page 5 of 12 regarding parking requirements. The minutes of April' 26 were approved as corrected. CORRESPONDENCE: Mr. Freitas presented copies of A New Planning Law For Calif fornia for the commissioners to review. G DIRECT,OR'S REPORT: Mr. Freitas advised the the planning department will be f. receiving a new publication regarding the general planning process, and the commission would be supplied with copies. The use, subject to the conditions which have been attached, will ,conform to the requirements and intent of the Zoning Ordinance and 'Environmental. Design Plan. The operation is a conditional use in the M -L, Light Industrial zoning district, and is consistent with the Industrial designation of the General Plan /EDP. 2. 1 , he use will not constitute a nuisance or be detrimental to the public Co welfare of the community as conditional. Conditions 1. The project shall be, subject to site plan and architectural approval in accordance with 'Section 26 -400 of. the Zoning Ordinance. C . 2. The "Future - Development" portion of the site shall be kept free of weeds and storage at all times. 3. ,All on -site cranes shall be kept in a horizontal and fully screened ,position. All of the material stored on -site shall be fully screened at fall times. The storage use will not under the circumstances of the particular case constitute a nuisance or be detrimental to the public welfare of the community. Conditions 1. The barn shall be modified to meet all building and fire code requirements prior to. use. 2. The existing barn shall be replaced with the originally approved storage and truck repair building within 2 years. The proposed use, subject to the required conditions of approval, will conform with the list of conditional uses permitted in the P.U.D. zone in which the site is' located, and with the "Industrial" land use designation specified on the General and Environmental Design Plans. 2. Such use will not constitute a nuisance or be detrimental to the public 'welfare of the community. Condi 1. A11 outdoor advertising and identification signs shall conform with the s ign program approved on the Petaluma Business Center P.U.D. development plan. 2. The - use shall meet the requirements of the Building, Fire and - c Engineering Departments An industrial- waste questionnaire - -shall be ompleted, and a sewer use permit assued prior to initiating food I roduction. State Health Department clearance shall also be secured. 4. Failure to comply with these conditions or with the requirements of zoning ordinance by the continued operation of this business shall be grounds for reconsideration of this use permit by the Planning Commission. The proposed structure, subject to the recommended conditions, is a conditional use in an R -1 -6500 ' zone and will conform to the requirements 'of the Petaluma Zoning Ordinance and the Environmental Design Plan designation of Urban. Low Density. 2. The use will not constitute a nuisance or be detrimental to the .public welfare of the community as conditions are provided to minimize or mitigate potential problem areas. Conditions 1. The proposed driveway to the accessory unit shall be narrowed to a width . of 12 feet and the existing gravel driveway (serving the detached garage) shall be paved at a minimum width of 10 feet. 2.. A landscape plan,for the entire lot shall be submitted for review and approval by the -Site Plan and Architectural Review Committee. " 3. The siding colors and materials shall be consistent with the architectural design period of the main building. Both the main building and. the proposed accessory building shall utilize the same siding, subject to SPARC review and 'type approval. 4. Curb, gutter and sidewalk improvements shall be provided to the satisfaction of the City Engineer. 5. All work on the main building, accessory building, landscaped areas, and street improvements shall be completed prior to occupancy of the accessory structure. 6. The project shall - be subject to payment of storm drainage impact fees as provided for in Resolution 9565 N.C.S., and, as calculated in Chapter 17.30 of the Petaluma Municipal Code.
