Freitas, Community Development and Planning Director Warren Salmons, Principal Planner APPROVAL OF MINUTES: Comm. Hilligoss wanted a typo corrected on Page ,1 of 9 under Approval of Minutes first line, the word "he" instead of "is. " Staff wanted to correct Page 3 of 9, Park Place VII Tentative Map Extension should bel through September 9, _1983, rather than the 8th. The minutes of May 10, 1983 were approved as corrected above. DIRECTOR'S REPORT: Mr. Freitas advised that the city council had completed its review of the General Plan /EDP Amendments and agreed with the majority of the commission's recommendations. 'In its last meeting, the council wanted the entrance to'- town classified as Industrial, and to leave McNear Hill as is. COMMISSIONER'S REPORT: Comm. Lavin advised that he had made the comment -- which was carried in the paper- -that we ought to pro- actively look for clean industry; and that he had received many cards, letters and phone calls opposing this concept. I. Dorothy Benson, Pinky's Pizza Parlor, 321 Petaluma Blvd. - Arcade Use Permit (Tape 21 Item 1.391 - To consider an application from Dorothy Benson, representing Pinky's Pizza Parlor, for a use permit to recognize the existing coin operated amusement games as an arcade at 321 Petaluma Blvd. South. The public hearing was opened and closed by Vice- Chairman Tencer. Motion introduced by Comm. Popp, seconded by Comm. Head, to approve a use permit for an arcade for up to 10 machines at 321 Petaluma Blvd.. South (AP# 008- 125 -14), with bicycle parking waived; based on recommended findings and conditions. William ?Berliner, Chicago Bi 'Restaurant Tape 34;' - .48) �7 2 Petaluma Blvd. North - Use Permit for Fast Food Item 1.390 - To consider an application from William Berliner, representing Chicago Bill's, for a use permit to operate a fast food restaurant at 22 Petaluma Blvd. North. -The public hearing was opened and closed. Motion introduced by Comm. Head, seconded by Comm. Lavin, to approve a use permit for Chicago Bill's for a fast food restaurant at 22 Petaluma Blvd. North, based on recommended findings and conditions. AYES: 5 NOES: 0 ABSENT: 2 (Bond, Shearer) Ryder Homes, - Park Place. Subdivis III,. R Way - PUD Development Plan Amendment (Tape 48i!;- 90) is - Dr. between Rainier Ave. and: Banff Item 3.298 - To consider an application from Ryder Homes to redistribute 12 of. the housing units previously approved in Park Place Subdivision III, located near Maria Dr. between ;Rainier Ave. and Banff Way. The public- hearing was opened and closed. - k Motion introduced by Comm. Lavin, seconded by Comm. Head, to recommend to the city council approval of an amendment to the Park Place III PUD Development Plan for housing plan changes as described in staff's report dated May 24, 1983, based on recommended findings. AYES: 5 NOES: 0 ABSENT: 2 (Bond, Shearer) r PLANNINCG MATTERS: IV. McBail C,o:, Spring Meadow III, Ely and Caulfield - Tentat Ma (Tape 90 99) Mr. Freitas advised that this item was for both Spring Meadow II" and I1I, however, the Spring M adow II Final Map was approved by the city council on May 23, 1983. Item 6.483 - To consider a request by McBail Co. for an extension of the time . limit for filing final map for Spring Meadow III, 43 units located at Ely and Caulfield. Motion introduced by Comm. Popp, seconded by Comm. Head, to approve an extension for the Spring Meadow III Tentative Map for an additional six months through December 1, 1983, based on the recommended condition.. AYES: 5 NOES: 0 ABSENT: 2 (Bond, Shearer) i ADJOURNMENT: The meeting was adjourned at 7:54 p.m. to the next regularly scheduled meeting of June 14, 1983. The proposed use, subject to the recommended conditions of approval, will conform to the requirements and intent of this ordinance and the Petaluma General and Environmental. Design Plans. The use is provided as a conditional use in ;a. C -H, Highway Commercial, zone, and therefore is consistent with the Service Commercial General Plan designation of the area. 2. The use, under the circumstances of the particular case; will not constitute a nuisance or be detrimental to the public welfare of the community. The arcade use 'is accessory to the main use of the site as a restaurant. , Amusement games have been in operation at this location for some time, and have not' caused any significant problems. Conditions: 1. The use permit shall be referred back to the Planning Commission should complaints be received or problems develop resulting from the operation. 2. Berliner, Chicago Bill's, 22 Petaluma Blvd. No. - Use Permit for Fast Food Restaurant Item 1.390 Findings:, I 1. The proposed restaurant, subject to the attached conditions, will conform to the requirements and the intent of the Petaluma Zoning O rdinance and with the General and Environmental Design Plan d 1 esignation of Central Urban Commercial for the area. I 2. The use will not constitute a nuisance or be detrimental to the public co w.�elfare of_ the community. Conditions: I � P� 1. A program of daily litter collection for the use shall be conducted to prevent the accumulation of litter in the surrounding area. 2. Drily advertising signs which conform with the sign program. approved for the "Mill" shall be used on the outside of the subject building space. 3. Improvements to the exterior of the historic landmark building shall not be undertaken without the grant of a permit by the Planning Commission, as per Section 17 -500 of the Petaluma Zoning Ordinance. Said plan clearly results in a more desirable use of land and a bet physical environment than would be . possible under any single zonh district or combination of districts. 2. The Planned Unit District is proposed on property which has a. suitable relationship to Rainier Avenue and North McDowell Blvd; and said are adequate to carry any additional traffic generated by the development. 3. The plan for the proposed development presents a unified and organized arrangement of the buildings and service facilities which are appropriate in relation to adjacent or nearby properties and that adequate landscaping is included to insure compatibility. 4. The natural and scenic qualities of the site are protected, with adequate available public and private spaces designated on the Unit Development Plan 5.
