Freitas, Community Development and Planning Director Warren Salmons, Principal Planner Les Ruh, Assistant City Engineer APPROVAL OF MINUTES: The minutes of July 12, 1983 were approved as submitted. DIRECTOR'S REPORT: There will be a Technical Rating Comm i ttee this Thursday at 5 p.m. COMMISSIONERS' REPORT: 1) Chairman Shearer welcomed Councilman Balshaw to the commission. 2) Commissioner Head :requested staff to review obstructed corners in the city for traffic hazards. 3) Commissioner Hilligoss reported that there was a ground breaking . ceremony for the Petaluma E'cumenicasl Project at 2.31 Wilson St. yesterday for ten modular units for low income seniors. Washington St. - Use Permit Tape 25 274:) Item 1.397 - To consider an application from Joseph and Lori Shea, doing business as '!Pizzuti's Pizza and Pasta," for a use permit at 706 E. Washington St., for the purpose of conducting` a I pizza and pasta shop. The public hearing was opened: Speaker: Lori Shea, applicant, 349 Ridgeview Dr., Petaluma The public hearing was closed. Motion introduced by Comm. Head, seconded by Comm. Tencer , to deny a use permit for 706 E. Washington St. due to parking and traffic hazards. Washington .St. for a fast food restaurant based on recommended findings and conditions, with Condition #7 added to read: Amusement games shall be prohibited. and Condition #8 added to read: There shall be no left turn entering or exiting the property. AYES: 4 NOES: 2 (Shearer, Tencer) ABSENT: I (Lavin) Comm. Popp requested staff to determine thepolicy regarding proximity of fast food restaurants to each other, and to file an immediate appeal to the city council if the commission's action is in conflict with existing council policy. McDowell, Use Permit for (Tape 274 - 802) Item 11.758 - To evaluate the environmental impact questionnaire for the following: Item 1.397 - To consider applications from Gary Stokes for two use permits at the southwesti corner of Casa Grande Rd. and So McDowell Blvd. for the purpose of con- structing a Quik Stop convenience market and expanding the existing shopping center. Chairman. Shearer directed staff to combine presentations for the above. The public hearings were opened: Speakers: Diane Arapov, 321 Bond Ave., Petaluma John Jacino, 417 Casa Verde Circle, Petaluma Connie Dolcini, 1315 San Rafael Dr., Petaluma John Bessermin, 2024 Clelia Ln., Petaluma Gary Stokes, applicant and owner of portion of project 2630 Pacer Lane, San Jose, CA 95111 The public hearing for the convenience store use permit was closed. Motion introduced by Comm. Head to direct staff to issue a negative declaration for the project. Motion failed for lack of a second. Motion introduced by Comm. Tencer, seconded by Comm. Popp, to deny a use permit for the convenience market at the southwest corner of So. McDowell and Casa Grande. AYES: 5 NOES: 1 (Head) ABSENT: I (Lavin) Comm. Head to deny the use permit for the shopping center. Motion failed for lack of a second: III. Viking Freight Systems, Inc., 1230 No. McDowell. Blvd. - Variance (Tape 802 - 051) Item 2.314 To consider a request by Viking Freight Systems, Inc., for variances to permit the use of outdoor lighting at. ; 1230 No. McDowell Blvd. to exceed the maximum 16 foot height limit permitted by Section 22 -304.1 of the' Zoning Ordinance; proposed parking lot- fight standards at a maximum of 25 feet above ground and building light fixtures on building roofs up to 22 feet above ground. Popp, to approve variances for outdoor lighting at 1230 No. 'McDowell Blvd. to allow the parking, lot light standards at & maximum of 25 feet above ground and building light fixtures on building roofs up to 22 feet above ground, based on findings listed in staff report. AYES: 6 NOES: 0 ABSENT: 1 (Lavin) Comm. Head directed staff to review the lighting standards in industrial parks to con - sider a zoning_ ordinance amendment. IV. Remo Rebizzo, 76 Oak Street - E.I.Q. & General Plan /EDP Amendment Tape 051 to 251) Item 11.740- To consider an environmental impact questionnaire for the following: Item 8.83 - To consider an application from Remo Rebizzo to amend the General Plan /EDP for the parcel located at 76 Oak St. from Urban High Density Residential (20 units /acre) to Central Urban Commercial. Ostrander (Rancho Arroyo Racquet Club) and :Van Aylea (Redwood Oil Co.) AP #'s 7- 412 -11, 12 and 150-020-1, 2, & 3 to consider including in the PCD district all of the other .properties in the proposed assessment district (Rancho Arroyo Business Park aka Industrial Avenue Assessment Area). Motion introduced by Comm. Popp, seconded by Comm. Balshaw, to initiate such a rezoning and also adding parcels 007 - 412 -08, 150- 020 -04, and 150- 020 -05 for consideration within the zone, and that a public hearing, be scheduled in the near future to' consider the rezoning request. Item 8.84 = To consider the proposed General Plan /EDP Amendment from Planned Residential, 7.0 dwelling units /acre, to Urban Medium Density Residential, 15 dwelling units per acre for the Lakeville Square Apartments project. John Wagstaff, planning consultant for the City of Petaluma, presented the Draft Environmental Impact Report on the proposed Lakeville Square Apartments prepared by Wagstaff and Brady, 1824B 4th St., Berkeley. It was the consensus of the commission to continue these items to the meeting of August 9, 1983 ADJOURNMENT: The meeting was adjourned at 11:51 p.m. by Chairman Shearer to the next regularly scheduled meeting of August 9, 1983. N 0 seating for sit down dining shall be permitted until additional parking shall be secured at a ratio. of one .space for every 2.5 seats in accordance with Section 20 -205 of the Zoning Ordinance. 2. To insure the safety of motorists entering the site, the existing 14 -foot wide front parking stall shall be replaced with a curbed landscape area subject to design approval by the Community Development Department in N_ accordance with Section 26 -400 of the Zoning Ordinance. Such improvements shall be completed prior to the issuance of an occupancy D.,'rmit . 3. All existing illegal signs on the parcel shall be removed within ten (10) days. A sign program for the entire building shall be submitted for review and approval by the Community Development Department prior to the installation of any future signs on the parcel. 4. The parking lot shall be improved to current City standards by the addition of concrete curbing, landscaping and irrigation systems around the perimeter of the parking lot (adjacent to the parking stalls) and existing- planter areas. Such improvements shall be completed within 60 days of use permit approval. 5. A' proper retaining wall shall be constructed between lots 7- 063 -39 and 7- 063 -40 and all fencing shall be repaired for replaced where necessary Within 60 days of use permit approval. 6. The use permit shall be reviewed periodically to determine that the user is not exhausting more than its proportionate share of on -site parking stalls or reducing the available street parking on Vallejo Street. 7. There are peculiar,• and unusual, conditions inherent in the property in question sufficient to cause a hardship. Such conditions. are created by the height of the large vehicles which use the freight facility and are not common to all or most of the properties in the immediate area. 2. A lighting security hardship peculiar to the prop_ .erty and. its use exists which is created by excessive narrowness of the Zoning Ordinance as to lighting, height. 3. The requested `lighting variance is necessary for security and. for the preservation of substantial property rights possessed by other properties in the same zoning district and in the vicinity, and will not constitute a special privilege of the recipient not enjoyed by his neighbors. 4. The requested lighting variance, subject to the attached conditions, will not be of 'substantial ° detriment to adjacent property, and will not materially impair the purposes of the zoning ordinance or the public interest.
