Freitas, Community Development and Planning Director Warren Salmons, Principal Planner Les Ruh, Assistant City Engineer co APPROVAL OF MINUTES The minutes of August 23, 1983 were approved Q with the following addition to Item VI, Page 4: (Commission requested staff to research existance of Council, General Plan or other policy with regard to fast -food restaurants and to appeal the issuarice of a use permit for the pizza facility if such policy was found and indicated a clear approval conflict.) :1 DIREQ-TOR'S REPORT 1. P1rovided the Commission with a statistical table showing the status of lbw /moderate housing projects within the City of Petaluma. 2. Asked for Commissioner's suggestions regarding a new agenda format. 3. Notified the Commissioners that the department had recently received a copy of the State Important Farmlands Map and were reviewing it for - • accuracy . 4. Informed the Commissioners that Commissioner Balshaw, Director Freitas and City Manager John Scharer had been appointed by the Council as C ity representatives on a new Tri- County 101 Corridor Transportation Committee being set -up by Marin County''. (1) 238 Motion introduced by Commissioner Popp seconded by Commissioner Hilligoss to direct the Community Development and Planning Director to issue a negative declaration based upon standard findings. The proposed warehouse, office /lab and RV storage, uses, subject to the attached use permit conditions, will conform to the requirements and the intent of. the Petaluma Zoning Ordinance, General Plan and Environmental Design Plan. 2. , In adopting the recommended conditions, the uses will not constitute a nuisance or be detrimental to the public welfare of the community. CONDITIONS 1. All on -site landscaping and irrigation shall be continuously maintained in healthy growing condition. Failure to do so for more than .30 days shall require review of the use permit. 2. Parking and outdoor storage areas created by the proposed removal of the "two corrugated .metal buildings" shall be improved with an asphaltic /concrete surface, concrete curbing and landscaping. 3. All existing unused concrete pads and mechanical equipment located in the parking and outdoor .storage areas shall be removed and replaced with an asphaltic- concrete pavement. 4. The, outdoor storage of recreational vehicles and loading bins shall take place only within the, fenced storage area. No outdoor, storage of any kind shall take place in the required public or employee parking spaces. Public and employee parking spaces shall remain available to the public and employees_ during: normal working hours. 5. The project shall be subject to design approval by the SPARC Committee. 6. Outdoor signs shall not be erected to advertise the facility without first being granted a sign permit and all such signs shall follow an approved design theme to be reviewed and approved by SPARC . 7. Bonding to ensure the completion of improvements partially under way and more than one -half installed shall be limited to 30 days. As a condition of use permit approval., street improvements to Cinnabar Road will be required to insure adequate vehicular access to the site. 3. The potential noise disturbance created by the cabinet shop will be required to be adequately mitigated through the City noise performance standards as a condition of use permit approval. FINDINGS (1.403.) 1. The proposed cabinet shop, subject - to the attached use permit conditions will conform to the requirements and the intent of the Petaluma Zoning Ordinance, General Plan and Environmental . Design Plan. 2. In' adopting the recommended conditions, the. use will not constitute a nuisance or be detrimental to the public welfare of the community. (3 ) 8. All old driveways along Lakeville Street shall be removed and replaced I ith sidewalk and square curb to City standards. Old concrete pads aind walls in ''the 'yard areas along Lakeville shall be removed and replaced by landscaping as shown' on the' approved plot plan. 9. Dedication of sufficient right -of -way, as determined by the City Engineer; to - permit construction of additional travel lane' on Lakeville S treet frontage. II. The existing on -site residence and garage shall be removed prior to occupancy of the Phase -II building space. Phase -II development shall be completed within. 4 - months of Phase -I occupancy in order for the use permit to remain valid and in effect.. 6. No storage of machinery, products, parts, equipment, lumber, debris, etc. shall take place outdoors except within the enclosed rear yard storage area. III. Motion introduced by Commissioner Popp. seconded by Commissioner Balshaw to recommend to City Council that the .Zoning Ordinance be amended to add Section. 10 - 403, 10 - 403.1 and 10 403.2. . 10 -403 to read One - family dwellings or duplexes are conditionally allowed under the following circumstances: 10. - Where a finding can be made that residential use is consistent with the General Plan /EDP land use element, because the site is within an area designated as Residential/ Commercial Combining area. (4) 241 1;0 -403.2 - Where a minimum of 6,000 square feet of lot area is provided for one dwelling unit, and 10,000 square feet of lot area for duplexes, and where at least 800 square feet of usable yard area is provided for each unit. The proposed drive -thru order station-is located far enough away from the abutting residences (90 feet) to significantly reduce the potential for future noise disturbances. 3. The potential for excessive .on -an(d -off site litter. accumulation _will be litigated as a condition of use permit approval. 4. East Washington , and , Lakeville Streets are adequate in design to accommodate the future traffic and traffic movements generated by the use. 0 (5.') E FINDINGS (1.393) 1. The proposed fast -food restaurant plans, subject. to the . attached use permit conditions, will conform to the requirements and the intent of the Petaluma Zoning Ordinance, General Plan and Environmental Design Plan. 2. In adopting the recommended conditions, the use will not constitute a nuisance..or be .detrimental to. the public welfare of� the community. CONDITIONS 1. A program of daily litter collection shall be conducted to insure `.that an accumulation of on- and -off site litter does not occur. 2. Both on -site driveways shall be dhh1J b/J /add posted for right turns in and out only. . No _ left turning maneuvers onto East Washington or Lakeville Streets shall be permitted. 3. The permitted hours of operation for. the. restaurant .shall be as follows: 7 a. m. to 12 p.m. on Fridays and Saturdays 7 a.m.. to 10 p.m;. Sunday through Thursday The permitted hours for use of the outdoor food order microphone shall be ,as, follows: 8 a.m. through 10 p.m. daily The permitted hours- for truck delivery and garbage pickup .shall be as follows: 6 a.m.. through 8 p.m. daily 4. Posts and chains shall be .installed at each driveway entrance and shall be used during hours when the restaurant is not in operation for security purposes -:to restrict ..ni'ghtime. parking, subject.. to, design and location > approval by the Community. Development Department. 6. Authority shall be granted by the property owner to the City Police Department to permit the .police to enter the site during hours of non- operation for the purpose of preventing any loitering. 7. Upon receipt of - complaints from the :public regarding the operation of the facility, the Commission shall require remedial actions to prevent future disturbances. 8. That the narrow width of the lot and present building location and the fact that they were created prior to adoption of the subdivision r dinance constitute special circumstances in that not enough room exists for a normal driveway width. I 2. That the R1 -6500 zoning designation permits lots of less than one third the size of this lot, yet the existing lot dimensions preclude creation of lots of this size. J. That the modifications will not be detrimental to the public welfare or safety or injurious to other property in the area as the lots which can be created have room for reasonable single- family buildings and additional dwellings can be restricted.
