public hearing was opene and ' closed. Motion introduced by Comm. Waite;
seconded I by Comm. Shearer to. approve the Use Permit t based on the recommend-
e4conditions. The Chairman noted there was a 10 day appeal period in
which to appeal the decision of : the Commission to'the City Council.

seconded by Comm. Shearer to recommend' to the City Council approval of the
Tentative Subdivision -Map, based on the,recommended conditions with the
following modifications:
Conditiori,5 wreads -,All on site sewer lines shall be private.. Any revision
of project'CGandR's needed to reflect this condition, including maintenance
of ,said lines, shall be made.
Commission recommended this condition should,be high-
lighted, and' a policy should be set by the Council on who. is responsible
.for the maintenace of on -site sewer mains.

to limit the Grantor's/Board's ability to deed an exclusive right ofuse of

R's needed to reflect this condition, including maintenance of said

7. Trees planted in perimeter landscape areas shall be located in such a way

9.. Final map and landscaping plan shall reflect an easement access to the

Diamond Head to occur ,through Homeowners Association with the Association
having first right of transfer upon resale of property or, upon willing
consent of owners. CCandR's must be ready for approval prior to Final
