2 THE IMPROVEMENTS AND CONFIRMING
3 THE DIAGRAMS AND ANNUAL ASSESSMENTS FOR
4 LANDSCAPE ASSESSMENT DISTRICTS

9 WHEREAS, the City Council adopted its Resolution No. 97-158 NCS, Describing
10 Improvements and Directing Preparation of Engineer's Report for Fiscal Year 1997-98 for the Landscape
11 Assessment Districts, listed in Exhibit A on file, pursuant to the Landscaping and Lighting Act of 1972;

13 WHEREAS, each report was duly made and filed with the City Clerk of said City, whereupon
14 said Clerk presented it to the Council for consideration;

16 WIiEREAS, said Council thereupon duly considered the report and each and every part thereof
17 and found that it contained all the matters and things called for by the provisions of said Act and said
18 Resolution No. 97-159 NCS, including plans and specifications of the existing improvements listed in
19 Exhibit B on file, and the proposed new improvements; (2) estimate of costs; (3) diagrams of the districts;
20 and (4) assessments according to benefits, all of which were done in the form and manner required by
21 said Act;

23 WHEREAS, said Council found that the report and each and every part thereof was sufficient in
24 every particular and determined that it should stand as the report as amended for all subsequent
25 proceedings under said Act, whereupon said Cotuuil pursuant to the requirements of said Act, as
26 amended, appointed Monday, August 4, 1997, at the hour of 7:00 PM of said day in the regular meeting
27 place of said Council, Council Chambers, City Hall, 1 I English Street, Petaluma, California, as the time
28 and place for hearing protests in relation to the levy and collection of the proposed assessments for said
29 improvements, including the maintenance, thereof, for Fiscal Year 1997-98, and directing said Council to
30 give notice of said hearing as required by said Act.

32 WHEREAS, notices of said hearing were duly and regularly published and posted and for certain
33 districts mailed to property owners in the time, form and manner required by said. Act, as evidenced by
34 the affidavits and certificates on file with said Clerk, whereupon said hearing was duly and regularly held
35 at the time and place stated in said notice and;

37 WHEREAS, persons interested, objecting to said improvements, including the maintenance,
38 thereof, or to the extentofthe assessment districts, or any zones therein, or to theproposed assessments
39 or diagrams or to the Engineer's estimates of costs thereof, filed written protests with the City Clerk of
40 said City at or before the conclusion of said hearing, and all persons interested desiring to be heard were
41 given an opportunity to be heard, and all matters and things pertaining to the levy and collection of the
42 assessments for said improvements, if any, including the maintenance, thereof, were fully heard and
43 considered~by said Council;

45 WHEREAS, State law has been amended to require the filing of written ballots approving or
46 disapproving any assessment increase in excess of the maximum assessment amount, and said ballots
47 were du]y mailed to all of the property owners in certain districts where the proposed assessments were
48 increased, and property owners were notified that said ballots are require to be filed with the City Clerk
49 by the conclusion of the Public Hearing held on August 4, 1997 on or after 7:00 P.M. in the CityCouncil
50 Chambers at City Hall in order to be counted.

1 BE IT RESOLVED by the City Council of the City of Petaluma, County of Sonoma, as follows:

3 1. That the protests against and ballots voting on said improvements, including the maintenance;
4 thereof, or to the extent of the assessment districts or any zones therein, or to the proposed assessments,
5 or to proposed increases in assessments, or diagrams, or to the Engineer's estimates of costs thereof, for
6 Fiscal Year 1.997-98 have been received, considered and counted.

8 2. That in certain districts were the proposed assessments were increased, the written ballots that
9 were received by the City Clerk prior to the close of the public hearing have been counted- and the'
10 proposed assessment increase in all of the certain districts failed as shown in Exhibit D, on file with the
] 1 City Clerk, and that the Engineer's report has been amended to reduce the costs and assessments in
12 certain districts to prior year assessment amount.

14 3. That the public interest, convenience and necessity require and said Council does hereby order
15 the levy and collection of assessments pursuant to said Act; for the construction or installation of the
16 improvements, including the maintenance, thereof, more particularly described in said Engineer's Report
17 and made a part hereof by reference thereto.

19 4. That the Landscape Maintenance Assessment Districts and the boundaries thereof benefited
20 and to be assessed for said costs for the construction or installation of the improvements, including the
21 maintenance, thereof, are situated in the City of Petaluma, California, and are more particularly described
22 by reference to maps thereof on file in the office of the City Clerk of said City. Said maps indicate by a
23 boundary line the extent of the territory included in each district and of any zone thereof and the general
24 location of each district.

26 5. That the plans and specifications for the existing improvements and for the proposed
27 improvements to be made within the assessment districts or within any zone thereof contained in said
28 report, be, and they are hereby finally adopted and approved.

30 6. That the Engineer's estimates of the itemized and total costs and expenses of said
31 improvements, if any, maintenance and servicing thereof, and of the incidental expenses in connection
32 therewith, contained in the report as amended, be, and it is hereby, finally adopted and approved.

34 7. That the public interest and convenience require, and said Council does hereby order the
35 improvements to be made as described in and in accordance with said Engineer's Report, reference to
36 which is hereby made for a more particular description of said improvements.

38 8. That the diagram showing the exterior boundaries of the assessment districts referred to and
39 described in said Resolution No. 97-159 NCS, and also the boundaries of any zones therein and the lines
40 and dimensions of each lot of parcel of land within each district as such lot or parcel of land is shown on
41 the County Assessor's maps forthe fiscal year to which it applies, each of which lot or pazcel of land has
42 been given a separate number upon said diagram, as contained in each report,. be, and it is hereby, finally
43 approved and confirmed.

45 9. That the assessments of the total amount of the costs and expenses of the said improvements,
46 if any, upon the several lots or parcels of land in each District in proportion to the estimated benefits to be
47 received by such lots or parcels, respectively, from said improvements, and the maintenance, thereof, and
48 of the expenses incidental thereto, contained in said report, be, and the same is hereby finally approved
49 and confirmed.

1 10. That the assessments included in said Engineer's report, as amended, for certain assessment
2 districts are to be credited by the amounts shown in Exhibit C, on file with the City Clerk; for the FY 97-
3 98 assessment only.

5 11. That said Engineer's Report, as amended, for Fiscal Year 1997-98 be, and the same is hereby,
6 .finally adopted and approved as a whole.

8 12. That the City Clerk shall forthwith file with the Auditor-Controller of Sonoma Countythe
9 said assessments, together with said diagrams thereto attached and made a part thereof, as confirmed by,
10 the City Council, with the certificate of such confirmation thereto attached and of the date thereof.

12 13. That the order for the levy and collection of assessments less one time credits for the
T3 improvements and the final adoption and approval of the Engineer's Report, as amended, as a whole, and
14 of the plan and specifications, estimate of the costs and expenses, the diagrams and the assessments, as
15 contained in the Report, as herein above determined and ordered, is intended to and shall refer and apply
16 to the Report, or any portion thereof, as amended, modified, revised or corrected by, or pursuant to and
17 in accordance with any resolution or order, if any, heretofore duly adopted or made by this Council.

19 14. That the Sonoma County Auditor-Controller and the Sonoma County Tax Collector apply
20 the Landscape Maintenance Assessment Districts assessments, listed in Exhibit C, on file with the City
21 Clerk, to the tax roll and have the Sonoma County Tax Collector collect said assessments in the manner
22 and form as with all other such assessments collected by the Sonoma County Tax Collector.
