MINUTES: Minutes of -February 10, 1981 were approved as
corrected. Page 2, Oak Mead- North Bay Park -
E.I.Q.';.IEvaluation,' motion should read: to direct staff to prepare a Negative
Declaration and recommend to the City Council the Negative Declaration be
approved based . on the recommended findings. Motion introduced by Comm. Head;
seconded by Comm. Tencer to amend the February 10th minutes. AYES: 7

Item 2,293 - to consider a variance to reduce the required side yard setback in
an R -1- '10,000 single family zone from 8 ft.. to 5 ft. and to reduce a required
rear yard setback from 25 ft. to 5 ft. The public hearing was reopened and
closed.
Motion introduced by Comm. Head; seconded by Comm. Waite to grant the variance
and reduce the side yard setback from 8 ft, to 5 ft. and to reduce the rear
yard setback from 25 ft. to 5 ft. based on the recommended findings.

Comm. Head explained his reason the variances was the original
structure was created and approved by the City and this seems to be the only
economical way the applicant can approach the.problem and eliminate the hazards
of his neighbors.

approve a modification to the Country West Shopping Center Development Plan.

The Christensen Development project was removed from the agenda because of a
technicality. Under Title 14, Division VI, of the California Administrative
Code, Resources Agency, projects meeting the criteria of Section 15161.6
shall be deemed to be of statewide, regional or areawide significance. EIRs
and Negative Declarations prepared on a project shall be submitted to the
State Clearinghouse and ABAG for review and comment. State law requires that
large industry and commercial projects have a 30 -day review at the State level
before the City gives a final review. The:Commiss'ion will make a recommendation
to the Council, the final approving body, on an EIR or Negative Declaration for
these projects.
PLANNING MATTERS: Trailer Park Ordinance
Comm'. Head asked if any progress had been made
where trailer parks could be z on a con-'
dominium basis and trailer owners could buy their trailer pad'.. 'Mr. Freitas
stated that a PUD (Planned Unit Development) Zone or a_ SPP -PUD, Special Pilot ■
Project Zone could be used to create a condominium mobile, 'home park.

PLANNING MATTERS CONT'D Allotment Review Committee
Mr. Freitas informed the Commission there
will be an Allotment Review Committee
meeting Monday, March 16, 1981 at 8:00 a.m.
Landscaping Requirements
Comm. Cavanagh asked if provisions were provided
where a follow up is made on landscaping required
on projects. Mr. Freitas stated that an inspection is given prior to occupancy
permits being signed and that a special.provision of the Zoning Ordinance can
be used to require upgrading of landscaping that later is permitted to deteriorate.

Findings
1. There are peculiar and unusual conditions inherent in the property
sufficient to cause a hardship in that. the property contains steep
terrain. Such conditions are not common to all or most of the pro -
perties in the immediate area.
2. A hardship peculiar to the property and not created by any act of the
owner exists due to the,steepness of the site. (.In this context personal,
family, or financial difficulties, -loss of perspective profits and
neighboring violations are not hardships justifying a variance).
3. Such variance is necessary for the preservation and enjoyment of sub -
stantial property rights possessed by other properties in the same district
and in the vicinity, and that a variance, if granted, would not constitute
a special privilege not enjoyed by his neighbors.
4. The authorizing of such variance shall not be of substantial detriment to
adjacent property, and.will not materially impair the purposes of this
ordinance for the public interest.

3.' As previously established under the Jim Winkle use permit (approved
December, 1980), and agreed upon by the property owner, a coordinated
Sign program for the entire site shall be submitted to the Community
Development Department for administrative approval. All on site signs
(including the free - standing directory sign) shall be made to conform to
this program prior to April 1, 1981.

shall also be replaced prior to April 1, 1981, as agreed to by the property
owners.

RECOMMENDATION, The. staff that the Commission approve the modification
to ^she approved Country West Shopping development plan and the use
permit request based on the standard findings and subject to the following
conditions:
1. No outdoor storage'of goods, tires, machinery, trash or vehicles under
repair shall take place on -site unless fully screened by the proposed outdoor
enclosure on the eastern side of the building.
2. All auto repair and servicing shall take place indoors.
3. The project and the revised Shopping Center bevelopment Plan shall be
subject :to design approval by the S.P.A.R.C'. Committee in accordance with
Section 24 -600 of the Zoning Ordinance.

be used for future signs) shall not exceed fifteen (15) feet in height.
