ZONING ORDINANCE AMENDMENT - AMEND ART. 13, SEC. 400 AND ART. 10, SEC. 300 (Tape 13 -138) Item 11.643 - to consider a Negative Declaration on Ordinance 1072 N.C.S. Art. 13, Section 400 Art. 10, Section 300. The public hearing was opened and closed. Motion introduced by Comm. Waite.; seconded by Comm. Cavanagh to recommend the City Council authorize staff to issue a Negative Declaration on Ordinance 1072 N.C.S. by amending Art. 13, Sec. 400 to add Subsection 414 to allow limited and speciality food stores as conditional uses in C -H Districts, based the recommended findings. AYES: .6 ABSENT: COMM. LAVIN Motion introduced by Comm. Tencer; seconded by Comm. Item '6,316 - request by George Thenn, Jr, representing Scenic Land Properties, Inc, Iand Daniel F. Reidy, Attorney, a second extension of time be granted on the approved subdivision map for the McNear Manor project. i Motio- n introduced by Comm. Cavanagh; seconded by Comm. Head to grant a second extension of time on the McNear Manor Tentative Subdivision Map.. The Tentative Map would be extended to November 5, 1981. AYES: 6 ABSENT: COMM. Shearer requested a map be included which displayed all the street improvements recommended. in the E.I.R. as mitigating measures for both projects. Comm. Waite questioned the increased_ run -.off flows from the projects onto McNear Avenue'. Motion introduced by Comm. Tencer seconded by Comm. Head to recommend to the City Council the adoption of the Draft E.I.R. and to certify the adequacy as an Environmental Impact Report,; along with addendums, comments and supplemental reports.
