Motion introduced by.Comm. Head; seconded by Comm. Cavanagh to recommend
the City Council authorize issuance of a Negative Declaration, based on
the recommended findings.

Item1 3.368 - to consider an application to rezone AP No. 006- 031 -26 from
R -M =G, Garden Apartments, to PUD, Planned Unit District, located between
Magnolia Avenue and Cherry Street, east of Liberty Street Extension. The
public hearing was reopened and closed.
Motion introduced by Comm. Head; seconded by Comm. Cavanagh to recommend
approval to the City Council of the PUD rezoning and Unit Development
Plan:, based on the recommended findings and conditions with the following
modifications .
Cond -tion 1 - delete - approved by Fish and Game Condition 1 read as
follows: The creek located' along the northern property line shall be
preserved in its natural state as much as possible. All new landscape
material along the creek- between the proposed "unit fencing and the center
linefof the creek shall be of a variety native to the natural Petaluma
creek environment, -appt-oved- b,y - Fith —aad -Came -, and subject to the review
and approval of the Public Works Department and SPARC.
Add Condition l3 to read The applicant shall submit design improvement
plans for a children's recreational area and spa to be installed within
six months; of the.final zoning approval by the City Council and plans to
be reviewed by the Site ..Plan and Architectural Review Committee (SPARC).

Item 6.494 - to review the Tentative Subdivision Map for a'25 condominium
unit project. The public hearing was reopened and 'closed.
Motion introduced by Comm. Head; seconded by Comm. Waite to recommend to
the Ginty Council approval of the Tentative Map, based on the recommended
findings and conditions with the following modification.
Condition15 changed to read - All required modifications to the tentative
map shall be completed prior to forwarding to the City Council of the
development plans and tentative map.

3.268 - PUD REZONING
Findings
1. The proposed development clearly results in a more desirable land use plan
and a.better physical environment than would have been possible under the
existing RMG, Garden Apartment zoning district regulations, or under any
other single zoning district or combination of districts.
2. The district is proposed on property which has a suitable relationship
to Liberty St. as provided via the' c rcle.dr.ive, Liberty. St. and Magnolia
Avenue are adequate to carry the additional generated by the pro-
ject.
3. The development plan presents a unified and organizedarrangement of
buildings and service facilities which are appropriate in relation to
adjacent or nearby properties, and adequate landscaping is proposed.
4. The natural and scenic qualities of the site are protected, with adequate
available public and private spaces designated on the Development Plan.
5. The development of the subject property, in the manner proposed by the
applicant and as amended by the City, will not be detrimental.
'Conditions
1. The creek located along the.northern property line shall be preserved in
its natural state as much as possible. All new landscape material along
the creek between the proposed unit fencing and the centerline of the
creek shall be of a variety native to the natural Petaluma creek environ-
ment,.and subject to the review and approval of the Public Works Department
and SPARC.
2. Pruning of any mature tree shall be minimized. A precise ground survey
certified as to accuracy by a registered civil engineer shall be sub-
mitted showing.the exact location of existing fencing, tree canopy peri-
meter, and tree trunks. Elevations shall also be provided of trees in the
vicinity of Units 1, 4 18, and 24, and the proposed par course which show
the relationship of the dwelling units to the existing tree canopy, and the
relationship of the existing.and.proposed grade to base of the tree. Units
or improvements with the potential to disturb the existing trunk or tree
canopy (e.g. Unit 1) shall be redesigned to fit beneath the canopy„ shall
be relocated, or will be required to be removed. For dwelling units pro-
posed to be located under the tree canopy, a knowledgeable tree expert
shall certify that the proposed unit locations will not endanger the long '
term health of the trees. The completeness and accuracy of -such reports .
shall be subject to the approval of the Community_Development; and Planning
Department prior to final action on the rezoning by the;: City Council.

3. The Conditions, Covenants, and Restrictions (CC' &R's) shall be updated to
reflect the current status of the development project. Provision for the
maintenance and use of the par course, common areas, access easements, and
recreation building shall be added.
4. 9ccess to interior rear yards of certain units has been provided across
the private yards of adjacent units and has not been included within the
common area (see Exhibit A attached). The property lines of these units
must be adjusted, or a common access easement shall be provided through the
CC &R's and shown on the Tentative Map. If easements are chosen, they
shall be landscaped and common maintenance provided by the homeowner's
'Association in perpetuity. Maintenance for this landscaping shall be
shown in the CC &R's for the subdivision. Such easements should be provided
across the entire front yard area of Units 18 and 24, or the property lines
adjusted accordingly.
5. 'The P.U.D. plan does not reflect all of the retaining walls noted on the .
tentative map. The design and materials for the retaining wall shall be
:subject to the approval of the Chief Building Inspector and the Community
Development and Planning Director.
6. To mitigate the potential not -se impacts of 'operations at the Petaluma Bus
;Barn and Neilsen's Freight Lines, noise contours shall be developed and
:mitigating design features proposed to reduce interior sound level con-
tours to 40 DB(A) in habitable rooms.
7. Automatic irrigation system plans and proposed security measures shall be
submitted to the Community Development and Planning Department for review
and approval prior to the issuance of any building permits.
8. The applicant shall comply with all building and fire codes and all other
applicable City codes.
9. The proposed trash enclosure design shall be adequate to accomodate front
`loading refuse dumpsters. The materials for the trash enclosures should
'be masonry-block in lieu of wood fencing with solid view- obscurring wood
:gates and concrete pad at grade. The masonry'block used should compli-
ment the proposed .retaining wall materials. Site plan locations elevations,
And screening enclosures for proposed electric transformers shall be
:submitted.
10. The chimney location reflected in the outline of the units on the site plan
, and tentative map plan does not appear to match the elevations submitted..

out of the common area.

Section 20.16.420 of the Subdivision Ordinance specifies that the City Engineer
shall prepare a written report of recommendations on the Tentative map in relation
■ to thej,Public Improvement requirements of the Subdivision Ordinance and the pro -
visions of the Map Act.
1. The,final map should comply with 66434E of the Subdivision Map Act which
explains which areas must be surveyed.
2. The proposed grading may necessitate construction of drainage swales, retain-
ing walls, or fill slopes that protect adacent property as well as property on the
subdivision.
