Waite advised the audience that this hearing was' for informational purposes nly. No action would be taken at this meet -ing -other than the Commission I considering whether there was sufficient cause'to schedule a public hearing on the Use Permit. A lengthy discussion was held with many members of the audience voicing opinions,''both pro and con, regarding the Dodge City Amusement Center. Items of concern discussed were: - Presence of drug dealers in and about the Washington Square area - Groups of people obstructing entry and exit areas at nearby offices and commercial businesses - People having difficulty getting to their vehicles People sitting on cars - Incidents of verbal harassment 1 - Incidents of female employees of some businesses being followed and harassed - Incidents of fights - Numerous'. calls to the Police Department A question was raised.as to the City's ability to enforce the "No Loitering" ordinance: Comments were made by persons referring to the fact that at times when the Police Department has responded to calls °they have been unable to make an arresti'because there are specific charges -that cane ".be filed against the offendingdparties. Comments were made by people indicating the fact that the Brotman family had vigorously attempted to keep the area in front of his Dodge City Amusement Center clear of people congregating, and that he has also attempted.�to disperse people loitering the immediate area of the Dodge City Amusement Center. NORTH - PUD DEVELOPMENT PLAN AMENDMENT Item 3.245 - to discuss . a proposed PUD Development Plan amendment to Permit substitution of new trees for the removal of an on -site Oak tree. Motion - introduced by Comm. Shearer; seconded by Comm. Harberson that the Commission recommend the approval to the amendment of the PUD Development Plan as outlined in the staff report. AYES: 6 ABSENT: Comm. Lavin ROYAL'OAKS MOBILE HOME PARK, NO. MCDOWELL BLVD. Request by the applicant, David D. Young, to waive the requirement for undergrounding a portion of the storm drain facilities for the Royal Oaks Mobile Home Park development. The Engineering Dept. stated no problem.would be.created by waiving this requirement as long as the property remained under one owner who would be responsible for maintenance. Motion introduced by Comm. Popp; seconded by Comm. Tencer to grant the applicant's request for waiver of the requirement to underground the storm drain facilities for the Royal Oaks Mobile Home Park. The project shall be subject to site plan and architectural approval in accordance with Section 26 -400 of the Zoning Ordinance. Petaluma Ecumenical Project - E.I.Q. Evaluation i Findings: 1. The project will provide much needed low cost housing for elderly citizens Go in the City. 2. Only minor additional traffic will be generated by the use. f f 3. Neighborhood shopping facilities are conveniently accessible to the site. Petaluma Ecumenical Project - PUD Rezoning Findings: 1. Said Plan clearly results.in a more desirable use of land and a better physical environment than would be possible under any single zoning district or combination of zoning districts. 2. That the PUD District is proposed on property which has a suitable relationship to one (l) or more thoroughfares; and that said thorough- fares are adequate.to carry any additional traffic generated by the development.. 3. That the plan for the proposed development presents a unified and organized arrangement of buildings and service facilities which are appropriate in relation to adjacent or nearby properties and that adequate landscaping and /or screening is included if necessary to insure compatibility. 4. That the natural and scenic qualities, of the site are protected, with adequate available public and private spaces designated on the Unit Development Plan. 5. That the development of the subject property, in the manner proposed by the applicant, will not be detrimental to the public welfare, will be in -the best interests of the City and will be in keeping with the general.;intent and spirit of the zoning regulation of the City of Peta- luma,. with.the Petaluma General Plan, and with any applicable Environ- me r ntal.Design Plans adopted by the City. a 222 Jack Ingerson - Use Permit Conditions.: M7 1.
