based upon recommended findings..

conditions.

'General Plan /EDP Amendment, or any potentially significant effects will
be mitigated by the proposed design and execution of the project.

CONDITIONS:
1. Masonry sound walls along Frates Road and Ely Blvd. shall be
.eight feet in height.
2. Prior to final map approval, applicant shall establish .
permanent maintenance mechanism for common areas including;
cul -de -sac parking islands, traffic islands at project entrances,
and Ely and Frates Road frontages including masonry wall,
landscaping and.bike path. Agreement subject to approval by the
Community Development and Planning Director, Public Works
Superintendent and City Attorney.
3. Project CC & R's and - homeowners association bylaws shall be
submitted prior to final approval of the tentative map and be
subject to approval by the City Attorney and Community Development
and Planning Department.
4. Development plan (landscape plan) shall include lawns or
ground cover, shrubs and trees in all yard areas fronting streets,
subject to approval by the Site Plan and Architectural Review
Committee.
5. The project shall be subject to design approval by 'the.SPARC
Committee in accordance with Sections 26 -400 of the.Zoning
ordinance. Approval shall be accomplished prior to tentative map
approval.. Conditions shall become conditions of the, development
plan.
6. Specific design of cul -de -sac parking islands shall be subject
to final approval by the Community Development and Planning
Director, City Engineer and Fire Chief.
7. Specific design of Ely and Frates frontages shall be subject
to approval by the Community Development and_Planning Director and
City Engineer.
8. Minimum setbacks shall be consistent with.R- 176,,,500 zoning
district unless otherwise established in project CC & R's.
9. All dwelling units shall be designed-to the approval of the
Community Development and Planning Department to insure interior
sound level from exterior noise sources do not exceed 45 DBA in
habitable rooms and 40 DBA in bedroom areas.
10. Project CC & R's shall prohibit recreational vehicle parking
in cul -de -sac parking islands.
11. Development plan shall reflect comments contained in City
Engineer's memorandum.
12,. A bus pull -out for municipal bus system shall be reflected on
the development plan at the Ely Road entrance, in lieu of the
; proposed bus shelter.

CONDITIONS continued.
13. Major private street loops shall be at least 27' wide'at all
:points. Minor private streets shall be at least 25 wide. These
areas shall meet these standards prior to tentative map approval.
All turning movement areas shall meet Fire Department approval and
00 1 shall be capable of accommodating fire apparatus.
14. All rook coverings shall be fire retardant and no more than 2
'abutting properties or dwelling units shall have shake or wood
shingle roofs.
.15. All buildings containing 3 or more living units shall be
equipped with approved fire alarm systems.
