Motion by Comm. Shearer, seconded by Comm. Popp to recommend the City Council approve the P.U.D. Unit Development Plan based upon recommended findings and conditions, with condition #4 changed eliminating the words: "converted into condominiums, or" and eliminating any reference to age limitations. The project conforms to the.General Plan /EDP for which the Petaluma Ma,s.ter EIR was prepared and certified. 2. Additional focused studies have been prepared and have identified no significant impacts. 5. That the development of. the subject property, in the manner proposed by the applicant, will not be detrimental to the public welfare, will be in the best interests . of the City and will be in keeping with the general intent and spirit of the zoning regulation of the City of Peta- luma, with Petaluma General Plan, and with any applicable Environ- mental Design Plans adopted by the City. (a) NORTHSTAR SUBDIVISION - P.U.D. REZONING AND UNIT DEVELOPMENT P LAN Item .3.263 - FINDINGS co 1. Said;;Plan clearly results in a more desirable use of land and a better I physical environment than would be possible under any single zoning district or combination of zoning districts. 2. That the PUD District is proposed on property which has a suitable relationship to one.(1) or more thoroughfares; and that said thorough- fares are adequate to carry any additional traffic generated by the development. 3. That the plan for the proposed development presents a unified and organized arrangement of buildings and service facilities which are apprbpriate in relation to adjacent or nearby properties and that adequate landscaping and/or screening screening is. included if to insure compatibility. 4. That' the natural and scenic qualities of the site are protected, with adequate available-public and private spaces designated on the Unit Development Plan. 5. (a) c)►°1® NORTHSTAR SUBDIVISION Unit Development Plan (Case File 3.263) Conditions:. 1. Call out on development plan security fencing for Recreation Area designed to the approval of the S.P.A.F.C. (Site Plan and Architectural Committee). 2. Applicant will establish permanent maintenance mechanism for all common areas, and includinq'the Ely Blvd. landscaped setback and wall, cul -de -sac parking and traffic islands, creek /urban separator area and r remainder parcel on Maria Drive. 3. Improvements in creek area shall be subject to final review by the Community Development and,Planning Director, City Engineer, Sonoma County 'Water Agency and California Department of Fish and Game. 4. Project CC &R's and Homeowners Association by -laws shall be submitted prior to final approval of any tentative map for the project and be subject to approval by the City Attorney and Community Development and Planning Director prior to approval of any final map. 5. Development landscape plan shall indicate lawns or mix of ground cover, shrubs and trees for all units in all yard areas fronting streets. A mix of landscaping materials shall be required for each lot, approved by SPARC and installed prior to occupancy of each dwelling unit. The density of planting materials shall meet City landscaping standards and shall include street trees as required'by City Code. 6. The project shall be subject to design approval by the S.P.A.R.C. Committee in accordance with Section 26 -400 of the Zoning Ordinance. Approval shall be accomplished prior to approval of a tentative map. Conditions shall be. incorporated as conditions of the development plan. 7. Specific design of cul -de -sac parking areas shall be subject to final approval by the Community Development and Planning Director, City Engineer and Fire Chief. 8. Minimum setbacks shall he consistent with R-1,6,500 Zoning District except for zero side yard setback on one side f each lot. 9. All dwelling units shall be designed to the approval of the Community Development and Planning.Director to insure interior sound levels from exterior noise sources do not exceed 45 DBA in habitable rooms and 40 DBA in bedroom areas. 10. Recreational vehicle parking and trailers shall be prohibited in cul -de -sac parking islands. 11. Item 11.694 FINDINGS: 1. bli-tigation measures for potential future archaeological finds are required as a condition of the P.U.D. Development Plan. 2. Measures to mitigate.nose disturbances created by the nearby railroad - and by other less significant sources are required as a condition of the P.U.D. Development Plan. 3. All measures recommended in the Traffic R port for the project, are requred.as a condition of the P.U.D. Developm nt Plan to mitigate potential adverse on and off -site traffic related impacts. 4. If any subsurface archaeological materials are encountered within the rezoned area, all wofk shall be immediately halted and a qualified archaeological consultant contacted in order to evaluate the materials and formulate appropriate strategies for their preservation and protection. 2. All noise mitigation measures recommended in.the Noise Study prepared for the project shall be integrated into design plans. 3. All traffic mitigation measures recommended in the Traffic Report shall be integrated into design plans. 4. Tle proposed apartment project shall be redesigned to include at least 38 additional on -site parking spaces subject to the approval of the Community Development and Planning Department. 5. The existing natural rock outcropping on the site shall be preserved. All existing on -site oak trees shall be permanently preserved in healthy growing condition. Any future modifications to the Petaluma Creek Floodway area shall be subject to prior approval by the Planning Commission. 6. The project shall be subject to site plan.and architectural approval in accordance with Section 26 -400 of the Zoning Ordinance prior to the issuance of on -site development permits. 7. Use of the 11.73 acre vacant portion of the,site shall be limited to uses permitted in the Agricultural District as specified in the Zoning Ordinance. 8. The northernmost street turn- around shall be fully landscaped. 9. A =eekside pedestrian path shall be developed along the full length of the 17.56 acre site. 10. Development rights to the full strip of land located to the east of the 1.7.56 acre development in the Floodway shall be dedicated to the City for the purpose of creating permanent open space, prior to the issuance of any building permits for the project. 273 (e) 274 O AK CREEK - TRAFFIC RECOMMENDATIONS ITEM 3.273 1.
