DIRECTOR'S REPORT: May have a joint workshop with City Council to discuss the Housing Element revision on Jan. 25th or Feb. 8th. Staff will contact the Commission as to the specific date and time. The public hearings were opened on 1) the environmental documentation, and 2) the revised P.U.D. Development Plan. A lengthy discussion was held and several members of the audience voiced concerns about.drainage and.slides at the project. Both public hearings were closed. The Commission members agreed that there was inadequate environmental documentation. Motion introduced by Comm. Harberson, seconded by Comm..Tencer to not accept previously prepared environmental documentation as adequate and refer back to staff for additional information on drainage and slides, both onsite and offsite; to the Petaluma River -.and including McNear Ave. and Mt. View Ave. areas; and to examine a.change of lot size and patterns from that proposed by the,applicant. REZONING /UNIT DEVELOPMENT PLAN (Tape Side 2 002 - 484') Item 11.674 - To evaluate the Impact Questionnaire for the Nizibian Custom Lot Subdivision at Mt. View Ave. and Canyon Drive for-22 custom residential lots. AP #'s 19- 232 -06, 16, 19, and 20. The staff report was given on both the environmental analysis and the development plan. The public hearings were opened on l) the environmental analysis, and 2) the rezoning to P.U..D., and 3) the development plan. A number of local residents of the Canyon Drive - Mountain View Avenue and the applicants spoke regarding the project. Staff was presented with pictures taken by Kenneth Godfrey of flood damage'of surrounding areas. Al,B`adenhop presented 'staff with plans of cul-de-sacs for the project.. The ; public hearings. .were closed. Motion introduced by Comm. Shearer,.seconded by Comm. Tencer to recommend the City Council direct staff to issue a Negative Declaration based upon recommended findings with the following changes: Finding #2 changed to .read: "A study will be made prior to the tentative map to determine the adequacy of the Mt. View Rd: storm drainage system to accomodate runoff from the project, for review by the Planning Commission. it Finding #3 changed to read: 'An erosion control plan will be developed prior to.the tentative map to protect cut /fill slopes after grading, for review by the Planning Commission." No significant adverse environmental effects will result from the project as proposed, or any potentially significant effect will be mitigated by the proposed design and execution of the project. 2. 'A study will be made prior to the tentative map to determine the adequacy of the Mt. View Road storm drainage system to accommodate additional .runnoff from the project; for review by the Planning Commission. 3. An erosion control plan will be developed prior to the tentative map to C9 protect cut /fill slopes after grading; for.review by the Planning T 'Commission. 4. Large lot sizes, specific building envelopes and step down construction will help minimize grading. Page 6 282 ACORN TERRACE - E.I.Q. ITEM 11.697 FINDINGS: 1. An initial environmental study has been conducted. 2. No significant adverse environmental effects will result from the project as proposed, or any potentially significant effect will be mitigated by the proposed design and execution of the project. 3.. Traffic mitigation measures in the form of a contribution toward signalization of the. Sycamore /Petaluma Blvd. intersection will be considered at the time of tentative map review. 4. An erosion control plan for lots not built out with Phase I will be prepared and submitted the tentative map. ACORN TERRACE - P.U.D.'REZONING AND UNIT DEVELOPMENT PLAN ITEM 3.285 FINDINGS: 1. Said clearly results in amore desirable use of land and a better physical environment than would be possible under any single zoning district or combination.of zoning districts. 2. That the'PUD District is proposed on property which h`as a suitable relationship to one (1) ,or more thoroughfares; and that.sa•id thoroughfares are adequate to carry any additional traffic generated by the development. 3. That the plan for the proposed development presents a unified and Organized arrangement of'•buiiding,s and service.facilities which are appropriate in relation to adjacent or nearby properties and that adequate landscaping, and /or screening is included if necessary to insure compatibility. 4. That the natural and scenic qualities of-the site.are protected, . _ with adequate available public and private spaces designated on the Unit Development Plan. 5.. That the development of the subject property, in the manner proposed.by the applicant,. will not be detrimental to the public welfare, will be in.the interests of the City and will be in keeping-with the general intent and spirit of the zoning regulations of the City of.Petaluma, with the Petaluma'General Plan., and' any applicable Environmental Design Plans adopted by the City. Page 7 283 ACORN TERRACE - P.U.D. REZONING AND UNIT DEVELOPMENT PLAN ITEM 3.285 CONDITIONS: 1. Call out on development plan perimeter fencing designed to the approval of S.P.A.R.C.(Site Plan and Architectural Review Committee) . 2. Project CC & R's and Homeowners Association bylaws shall be ^ submitted prior to final approval of any tentative map for the V project and be subject to approval by the City Attorney and :Community Development and Planning Director prior to approval of any final map. 3. The project shall be subject to design approval by the S.P.A.R.C. Committee in accordance with Section 26 -400 of the Zoning Ordinance. Approval shall be accomplished prior to approval of a tentative map. Conditions shall be incorporated as conditions of the development plan. 4. Minimum setbacks for all buildings shall be consistent with R -1 -6,500 zoning district unless otherwise shown on the approved development plan. 5. All dwelling units shall'be designed to the approval of the Community Development and Planning Director to insure interior sound levels from.exterior noise sources do not exceed 45 DBA.in habitable rooms and 40 DBA in bedroom areas. 6. On -site parking of recreational vehicles and trailers shall be prohibited. Said prohibition shall also.be specified in project CC & R's. 7. The revised recreation area plan and landscaping addendum shall be incorporated into the overall development and landscape plans. B. The landscape plan shall be revised to-show 'landscaping of any off -site cut and /or fill slopes. Maintenance and 'slope easements shall be required and such.laridscape materials shall be maintained by the property owner's association. 9. The development plan shall indicate an underground drainage system to carry water from the slope which drains toiward.the Kilbride and.Cincera properties. 10. Fire-Department requirements shall be'incorporated as conditions of the Unit'Development Plan._ 11. An erosion control plan for graded, unbuilt lots shall be submitted for review and approval by the Community Development and Planning Director and Cify Engineer prior to final map approval.. 12. The existing on -site oak tree shall be preserved and a protection plan to protect the tree during development be provided for Planning Department approval. Since.previous on -site trees have been removed in conflict with existing City.zoning requirements specifically to the Page 8 .. 284 ACORN TERRACE - CONDITIONS - continued contrary, it is recommended that the developer be required to post a $20,000 bond or other suitable mechanism to guarantee preservation of the remaining trees. Such bond shall'.be forfeited upon ,failure to perform requirements or upon additional tree loss as determined . by the Community Development and Planning Director. 13. Development plan approval shall be upon approval of the proposed General Plan /EDP amendment'by the City Council. .1
