APPROVAL OF MINUTES The minutes of February 20, 1974 and February 26,
1974 approved as submitted.
CORRESPONDENCE -:
A'memo from the Assistant City Engineer was
.read with regard to 'the failure of -Mr. Moran
of M & M Ice Vendirng Machine to either post
the required bond�.or place ' a cash deposit as
required by the City Code.. The Commission
requested *that - the Director of Community
Development pursue the matter to determine what
action was necessary on .their part.

by the staff. It Was noted that a Variance
was necessary to remove t he nonconforming
status, of the existing dwelling. The stj:ff
clarified that there was a mixture of single
and multi-fAmi'ly- - dwellings in the area and the
duplex would be compatible with the existing
housei the setback allowance was questioned
and it 'Was clarified that the. duplex would be
set back 21 feet from the front property line,
which: was :compatible to adjacent homes, and the
home.s 'on 'either side were;-removed 15 to 20
feet .from. the side property lines. The
Cbmmi,saion. was presented with plans for review.
The app'li addreosed the Commission, - stating
that there 'was an apartment next door and
another up the street. and - he felt. the proposal
wa.s� compatible w-ith the surrounding area.

Comm: Balshaw'made a. motion to approve the
requested, variance- subject to conditions as
cited in the s.taf;f report and Comm. Waters
seconded the motion.

Comm. Waters asked the.applicant if it was
feasible_ to move the duplex.. Mr. Belluomini
replied that it was and the Chief Building
Inspector had approved the move.
Comm. Balshaw made a motion to approve the
requested site design subject to conditions of
approyal of the Site Design Review Committee
and'Comm® Popp .seconded the motion.

Mr, Belluomini asked, if the driveway was to be
cement or asphalt and was told to coordinate
that item with. the Fire Chief as the conditions
Of approval stated that.it would be done to the

LARRY VENT.URI - ' The staff informed the Commission why the

PRIVATE STREET: Mr..Larry Venturi advised the Commission that
all of the .garage area at the rear of the lot
would be demolished which 'would afford a 28 foot.

house would be' retained.,
Chairman Bond asked the applicant why he had
chose to divide the parcel as he,did and Mr.
Venturi replied that the lots were .reasonably
large enough for the area and it was also due.
to,economics. He added that he wished to retain
the larger.-lot at th-e rear for his home.
It was confirmed that there were several lots
65 feet wide *within approximately 200 yards.
The access was questioned, and Mr. Venturi
advised that Lots #2,'3, and 4 would be served
• from the private street and only Lot #1 would
have access on Schuman Lane.

Mr. 13oeh1j.:e advised the Comms;so.n that a street
maintenance agreement ,satisfactory to the
City Attorney would have to be submitted, and
Mr. Venturi advised' that his .attorney was
drawing;' the agreement up.
Comm.. Waters made .a. motion to approve the
modification, to the provisions of the Sub-
divison Ordinance and Comm. Bel.lovich
seconded the motion.

LAWRENCE, J.:BEAL - A review of'the and reasons why a,

the applicant to provide a total right -of -way
width of 20 feet for the frontage road,to allow
two -way traffic movement and other require -
ments of the City _Engineer relating thereto
were not appropr=iate. It was felt that the
one -way s.treea wo a traffic
hazard and the: - requirement for a_ two -way
street wbuld impose a; hardship on the applicant.
Mr,.. Bob Koenit4ex, representing Mr. ; Beal,
informed the Copmis;sion, he - had contacted the
City. Attorney and explained his objections
to this condition. Mr. Robert had given him
his oral.opinion that it was not a legal
requirement, of thet City as the. City could
request the applicant to provide the land but
could not require him to put in. the ..street
improvements since there. was existing frontage
on an improved street. Mr. koenitzer also
informed the Commission that he had met with
rail, road Rersonnel,, and they advised him it
was ot possible to meet the 20 -foot width

street requirement for the entire length of
the ,parcel as required 'by the City Engineer
because; of the placement of the railroad tracks
and the railroad's. right -of -way requirements.
Also, it had not been considered feasible to
relocate'the utility poles. Mr. Koenitzer
informed the Commission that curbs and gutters
presently existed on the one- way-street adjacent
to the site.
Discussion followed regarding the aspects of
the one -way street and the placement of appro-
priate signs if the street would be ,allowed
to remain one -way.
Mr. Koenitzer explained that a'Narance w:as.
requested because of the irregular shape of
the lot. He added the project had been
coordinated with the railroad who were agreeable
if certain conditions were met.
Comm. Popp made a motion to grant the variance
requested and Comm,. Bell.ov:ch seconded the
motion.

The Public Hearing to consider the Use Permit
was opened and the public was asked for
comments. There was no response. Mr. Koenitzer
addressed the Commission stating that it was
felt that the use was appropriate for the area
and would be compatible with other uses.

Comm,.. Bellovich made a motion to grant the
requested Use Permit with conditions as stated
in` staff report, and Comm. Popp seconded
the motion.

MODIFICATION TO , The Pub. Hearing was, opened. Barbara Lind,
ZONING ORDINANCE Secretary of tthe Mayor" s Select Committee on
NO. 10712 Historic Preservation., addressed the Commission.
stating that,it was the'wsh,of the Committee
to delay discussion on the proposed historical
section to the zoning ordinance until the next
regular scheduled,meeting of the Planning
Commission.
Comm. Popp ma *ade a motion to continue the Public ,
Hearing until March 19, 1974 and Comm., Waters
seconded the motion. The vote was unanimous.
OTHER B`US•INESS: Comm. Balshaw informed the Commission that one
of the recommended bike routes mentioned in
the,b,ike study was along East Washington Street.
He felt that.someone should take action to
restrict parking along East Washington and also
along the portion ;of So. McDowell Blvd. that
was to.be widened since people were starting
'to park there. The .staff was directed to
determine the proper. action required.
Chairman Bond informed the Commis,slon that one
of the conditions on the Youngstow-ne Mobile -
home Park site -des-ign called for a 10 foot
easement for a bicycle path,. He felt that if
this condi.t'ion was imposed on property owners
at this time when a.concrete plan has not been
adopted,,, that a provision be made for the
easement to- revert back, to the property owner
at the .end of. a specified number of years if
not utilized. The staff was directed to explore
the possibility - of this provision 'with the
City httorney,.City, Engineer., the Bicycle
Committee and the'Recreation Commission..
