Balshaw, Bond, Hilligoss, Horciza, Matttei, Popp,. Waters ABSENT: None STAFF: Frank B. Gray, Director of Community Development Chairman Hilligoss welcomed the new Planning Commission.member, Comm. Edward E. Horciza. APPROVAL OF MINUTES: The minutes of November 19,. 1974 were approved as submitted. It. was noted that'if the request was approved the house on this lot would be constructed without windows on .'the. side facing, the proposed bike path, The • Commiss`ion.was. advised that. it could either grant the modification to.allow the reduction in minimum lot width, area and aggregate side yard, or they could.deny the request and hold the developer to the requirements of the Tentative Map, which states that the developer is to provide for a 10 -foot wide linear park, An explanation of the situation was requested and the.Commi_ssion was.informed that the developer had stated that.he did not realize until detailed engineering had been accomplished that the Sonoma County:Water Agency flood control embankment encroached -into the 10 -f6ot strip of property dedicated to the City, reducing it to five feet of land at that particular lot. It was further explained that the Commission had required.30 feet for a linear.park at the time of the Tentative.Map approval, but that the developer had.appealed this requirement..to the.City Council. The Council in.turn had approved a proposal for a 20 -foot wide linear park which tapered down to a 10 -f.00t „wide strip in order to allow the developer to create Lot #24. Mr. Gray advised the Commission that he was not aware-of the situation until he reviewed the site during the grading stage. Mr, Jon Joslyn, Qantas Development Corporation, stated Petaluma City Planning Commission Minutes -, December 3; 1974 that they had dedicated .10 :feet- from the property line of the Sonoma County Water Agency flood. control channel and- -did not. realize at tha -t time that the flood control channel, .encroached :on. this 10 -foot strip of property, Mr. Gra was asked:. if. - the. Water Agency had been Y� g Y contacted,..... He replied. that they had and had ,s.tated that the flao.d contr.ol channel had been constructed many .years ago and to the best of - their ability had been constructed in.the right place; however, erosion also entered. into the picture. Comm Mattel informed the Commission tha',t one of the reasons the..Council. had accepted the 2:0-foott linear park was; :that it was felt the 2 :feet plus the width of the channel would be e open space. .'Mr. Joslyn.sta;ted.that'the Sonoma County Water Agency road on the. oppos.i-te•-side of the channel would be. the natural place for a bike path, and it was'-not the 'developer.' s . de.cis;ion to place the bike path *on. their side of the property. Mr 'Gray that since the: developer.claime.d no, one 'had discusserd the bike path with them until the Tentative Map .stage he felt .it had weighed heavily on.the City Council's decision:to :reduce the linear park ,to 20 feet. He then informed the Commission that a third alternative'i would - be for the City to purchase the lot. Redesigning of . the house -was discussed* :to ,obtain the - desired. 15- feet .o.f aggregate side yard. Access . from the rear of the p:ro;pe;rty for recreational vehicles was also questioried,e : Mr, Joslyn- replied that re- designing 'house -was not that simp,l,e and that access from the rear could not be. obtained, since, it was - Young:,America Homes' p.ro.perty and would also violate the security of, the recreational parking yard. Mr. Gray read the specific findings that the Commis- sion must -make to grant the modification request and reminded the Commiszi,on of the applicant's promise to P rovide• a 10- -foot, wide linear park.. Mr. Joslyn interjected that the promise was only to dedicate 10 feet of their property, which they had done,, Discuses 'on -followed. regarding contacting the Sonoma County Water .Agency regarding the regradingg�of the banks and proper measures to eliminate future erosion.. -2- Petaluma City Planning Commission'Mnutes, December 3, 1974 Comm„ Balshaw then made. a motion to deny the request. Comm, - Waters seconded the motion with the condition that the City Attorney be requested to contact the Sonoma County Water Agency regarding the encroach - ment. AYES 7 NOES 0 ABSENT 0 Comm. Balshaw-recommended that in the future property dedicated for park purposes be specified as being in usable condition. USE PERMIT U,6 -74 - The applicant's request for a Use Permit to allow a DONALD IVERSON & shop for specialty and"design.painting on automobiles DOUG BRIANS: at 4222 Petaluma Blvd. North was briefly explained to the Commission and the-three conditions of approval recommended by the.staff were read, The'Public Hearing was opened.. Mr. Doug Brians addressed the Commission, explaining the usage re- quested and that only a small air brush would be utilzed.•in.the operation. Chairman Hilligoss questioned the ditch adjacent to the proposed shop, and Mr.,.Br.ians replied that Mr. Amaral would have to.complete ghat- grading before their occupancy of the building., Comm, Bond questioned the parking, and Mr. Gray advised that the Commission.could legally require that no cars should be stored outside except in a parking space assigned to the use by the owner of the build - ing. He.also clarified that space for the entire warehouse .center had been previously calculated and the owner would now have-to indicate to the applicant those spates which would4be specifically for his use. The Public Hearing was closed. Comm. Popp made a motion to grant the Use Permit with the conditions of approval as recommended by the staff,. Comm. Balshaw seconded the motion.. AYES 7 ' , NOES 0 ABSENT 0 ELIM LUTHERAN CHURCH The Commission.was advised that the E1im Lutheran USE PERMIT U15 -74 Church was an existing non - conforming use, Therefore, & a Use Permit would be required for the construction SITE.DESIGN REVIEW: of the - parking lot which the church had proposed to help reduce the amount of curb parking. It was noted that the'Site Design Review Committee had concurred -3- Petaluma City Planning Commission Minutes, December 3, 1974 with the . r -ecommended conditions of approval of the staff, and these conditions were then 'read. Comm. Bond questioned the relationship between the seating and the "riumb:er of parking spaces required and was informed that requirement. would only exist if it was. new construction or an addition to the existing structure. The Public Hearing was opened. Mr, Earl - Anderson informed the Commission that he had talked to the planning staff and had been informed that the parking propased.was adequate for the seating of the church. No further comments were offered and the Public Hearing was closed. Comm. Waters made a motion to grant the.Use Permit as requested and Comm. Bond su, - onded the motion. AYES 7 NOES .0 ABSENT 0 Mr:. Anderson questioned the possbi_lit;y of ' one -way traffic on :Baker Street and was told to refer the matter to the Traffic Committee. Comm. Bond made a motion to approve the site design review with conditions of approval as stated. The motion was seconded by Comm. Horciza. AYES 7 NOES 0 ABSENT 0 USE PERMIT REVIEW Mr., Gray advised the Commission ; that ; Mr. Al Stack - AL STACK AUTO had been in to. -see, him and had also written a letter WRECKERS: to the ; C.omm ssion. The letter was then read to the Commission... _ It stated that Mr. Stack had received the letter informing him of the meeting this evening, but he had :prior commitments and could not attend. He 'therefore requested a continuation of the Public Hearing until the next Planning. Co- mm'ssion meeting, and stated that.it.was his intention to meet the requirements of the ts'e Permit and also to terminate the lease on the adjacent property as soon as possible. Mr. Gray further advised that the City Attorney ha been-consulted -and ' he felt it was only, fair to allow Mr. Stack to be heard at the next meeting. The Public Hearing was opened A short discussion fo,llowed, after which Comm,. Waters made 'a motion to continue the.Public'Hearing until December 17, 1974. The motion was seconded by Comm._ Popp. r • AYES 7 NOES 0 ABSENT 0 -4- Petaluma CityPlanning Commission December - 3 1974 A recess was called.; at 8:55 - p-,m. and the meeting resumed at 9:00 p.m. REPORT TO .COMMISSION �Mr% Gray .,stated.that the Commiss on had requested REGARDING THE`; that they be kept-informed on.the proposed hospital PROPOSED HOSPITAL site selection study,. He therefore briefly reviewed SITE. "SELECTION: the sites considered and the prior discussions held regarding the..feasibility and, /:or problems relating to each site. It.wa;s noted that the County planning staff an -d the City staff both.concuired in recom- mending the.Lucches.i.Park.s:ite for the hospital with the..County and Citizen's Advisory Committee recommending.an alternative.of the'Denman Flat site, Dr.. Groverman, ..P.residen.t.- of�.the Hospital Board, spoke briefly, informing the Commission of the imp.or- tance of-one adequate hospital instead of isolated hospitals with.dupl'icated:services, He also spoke regarding the future use of the existing Hillcrest - Hospital. Discussion followed regarding the possibil- ity of putting North McDowell Blvd.. through to Redwood Highway. OTHER BUSINESS - : The Commission was -advised,that Mr. Robert Meyer, the City Manager, had filed an appeal regarding the �. conditions which the Planning- Commission had placed on the s: to design review of the Petaluma Public Library. This appeal was then read, In accordance with request from the Commission, Mr. Gray reported that joint parking requirements for the Keni;lworth.Recreation Center and the Public Library, if considered as a unit, would amount to 83 spaces for the recreation center and 11.0 spaces for the library., totalling 193 required spaces. It was noted.that 80 spaces are now available for.the two facilities combined... Mr.. Gray further advised that there are approximately 50 spaces presently available adj acen.t. to the site off of Payran Street, . and room for over 1.50' cars on the .east side of Fair- grounds,,Drive. He.added that development of the site adjacent-:to Fairgrounds Drive for parking purposes would cost roughly $70,000, or $470 per parking space.
