j Dick Lieb reminded the C'omm that a re-
zoning application on which he was.representing
the applicants had been tabled in October, 1972,
and asked when this case would be brought back
I to the Commission. Mr. Anderson explained that
j the rezoning applicat'on: referred to was
Paulud'ci, Howe, and DeMartini requesting rezon-
ing-from R -M -1,500 to C-N for their properties
located, on Ellis Street. and Alma Court. This
rezoning had been tabled until after the annual
{ review.of.the E .D .,P ,. has been made. Chairman
Popp directed the staff .to look into this rez
ing,and'determine when it.could be brought back
before the Commission.

informed by:..the applicant that it was not.
Comm,. Waters,. felt .that site would
create a traffic problem- - and,.was told that the
City Engineer had reviewed the Environmental -
Assessment Statement and did not feel-a traffic
problem - w o uld exist, and that applicant would

be required to widen Copeland Street approxi
mately'six along the frontage of-the leased
site area to provide sufficient total right-,of—
way width for two twelve -fp.6t lanes and an eight
foot parking lane. Comm. Water expressed-disap-

the City Council had adopted the new..guide.lines

be available to handle Environmen "tal Impact
i Reports,. The applicant would select the consultant
who would then contract with the City and make a
I complete report. Mr. Gray added that the Environ-
j mental Assessment Statement would still be retained
and• "Possibly modified., but it will now be called
the Environmental Impact Questionnaire,"

M & M ICE VENDING Chairman Popp�opened.�the ;public hearing. Mr.
MACHINE COMPANY Anderson furnished the Commissioners with photos
USE PERMIT U1 -73: sand displays and read the ,staff report, with recom-
mended conditions of-approval, after which the
applicant was-called upon for comments.
_ Michael J: Moran, the applicant, stated he could
keep the machine stocked with. ice at all times.
He added the machine was�no t designed to return
coins•when empty;, however-, it would not take the
coins. when empty..and a sign would be placed on
the'ma,chine stating this. Mr_ Moran asked the

up as he was only on a month -to -month tenancy
basis 'and did not want to go through a great
deaL of expense under those circumstances. No

Comm Hoo.d. asked about . ground cover planting and
if�.there. was water available for maintenance.
The applicant.stated water was.not` available,
but he could -use synthetic cover: Mr..Gray inter -
j,e that it might ,be 'possible to use some
plants. which could live on atmospheric water.
Comm:. Hood commented-that a good deal of cover
was shown; and 'if 'it were to' be required, it
should be ma and ;suggested using ; rock

The staff report-re.comm ending approval of the
REZONING Z7"73:
rezoning was read by.Mr. Anderson,.`
Popp opened the - public hearing and asked if the
applicant or audience had a I ny comments. None
were off.ered'an d public hearing'was closed.
Comm. Waters inquired what.,the Environmental
Design Plan designation for the site was and
was informed it, was commercial. Comm. Balshaw
did..not feel that C7-N was appropriate zoning
for this use. ' Mr. Gray responded.that it could
be either C-0, Pr C-,N, but;- felt it, f it - under
the permitted uses and intent of the C-N District.
No objection of this zoning cla,ssificati-on was
voiced, bythe remaining Commissioners.
Comm�. Hood , questioned ! setbacks and Anderson
informed him that at the site designx,eviiew stage,
the applicant would be required to comply with
the Zoning Ordinance as it was not felt that a,
hardship factor-justifying a variance for a,zero-
foot rear yard setback existed.
Comm. Hood brought out the fapt that this
proposed development, doesnat. on Wash-
ington Street, but was on Vallej;qtreet,
and asked what could stop future requests

future requests would be treated individually
on their own merits. Mr. Anderson informed

that the C -N designated use is.

districts and this rezoning would straighten out
the present uneven zoning.boundary. Mr. Gray

and the-site in -question.
Comm. Balshaw made the that the Commission
not,;approve the rezoning request in that it is

OTHER BUSINESS:
The applicant advised that his rezoning re-
.quest was denied by the Planning Commission, but
that he could appeal decision to the City
Council.
Mr. Gray commented that ,the- Commission had .been
furn. shed the staff: report" regarding modifications
to the Master Plan of Zoning bring fit into
conformity with Z_onin'.g Ordinance No. 1072 N.C.S.
He explained that approxii :ately 2,000 letters had
been sent-out-to property owners advising them
of meetings set for April .3rd and 4th and. requested
that,, if possible, a member of the Zoning Committee
of-the, Planning. . Commission.`be'present for these.
meetings. Mr. Gray advised -the Commission that
new zones, which had- .be en:crea'ted to.replace the
old zones, would allow more flexibility. After
the __Meeting -with the,- ,property owners this week,
the staff reports would be completed.,and'a public
hearing was there- fore..requested for April 17 -;
1973 -. In. response to ,a•query_ from Comm. Balshaw
as to whether this would meet. the State require-
meats for "consistency," Mr. Gray explained that
consistency" meant a logical progression taking
place be;tween,.current,- ,zoning -and the long ,range
objectives of the General Plan and that it did
not mean "the same as."
Chairman Popp requested that any of the'Commis-
sioners who could attend ,the scheduled meetings.
