Gray, Associate Planner APPROVAL OF MINUTES: The minutes of May 1.5, 1973 .were approved as s.ubm.tted. CAMB?.IDGE ;rSCUARE #3 The, staff explained the location of the site and SUBDIVISION that an allotment had been approved by the City TENTATIVE MAP: Counq.i.1 for a portion of the development. The conditions of approval as; .recommended by the Director of Community Development were,r' read and the Commission further advised that all of the improve - ments we to be constructed during this phase of development and that any additional housing would be based upon future allocation. The building.sethack requirements listed in Condi- ti,on #12 were questioned and it was agreed by the Commission to change the condition as follows: 'All b uilding setbacks on cul -de - sacs or knuckle sections shall be placed f`ar- enough back from the street to allow - 65 foot width at the buildi setba °ck line inaccordance with-Se 22.7..403 of the Subd `vision Ordinance- as amended. The width of Lot #17 was also questioned, but staff advised that Condition. 06.6f the Tentative Map would insure compliance with zoni ordinance requirements. Conim. BAlshaw asked what the intent was as far as landscaping and a grrea't deal o:f dscus,sion followed with regard to setting 'a.policy for landscape requirements Staf advised the Commission that,past procedure was for lawn or. ground cover in the front yard and one tree for each lot. It was agreed that an average of one st reet tree -per lot should be required in accordance with the approved list of trees. A great dea°l:of discussion followed regarding the dedicat' %on of land or the payment of a fee in lieu thereof: for' park and recreational purposes. It was the recommendation of the s`'Aff_ that a parr should not be included in this development, since the development had been reviewed by the Subdivision Petaluma pity Planninc; Commission �ti notes, N'ay 29, ;1973 1 • Committee in light of the park and recreation element of the General Plan,, Environmental Design Plan and existing park dedication policy. Comm. Balshaw felt that the East side needed additional recreational atea°s for the children and suggested the d ;edication of the southerly corner of the property adjacent to an undeveloped area, with the intent of requiring similar dedication from the next developer when. adjacent land is considered for development. There was some discussion as to whether this iaould be agreeable to the City Council and Parks Recreation, and Comm. Balshaw accordingly' recommend°- "ed that Condition 09 be changed as follows: "Nine tenths acres shall be dedicated for parks purposes within this development at su.ch.a location that is determined by the Pepreation Commission. If this is not pla usible or feasible,, the fee in lieu thereof shall be adhered to in - acc,ordance with Section 2 'of the Subdivision Ordinance." Mr. M&3ivern suggested that the Planning Commission should have a studv session with the Parks & Recrea- tion Commission so that an agreement on park policy could be reached for :future developments. Chairman Popp asked him to arrange such a study session. The :applicant was asked, if he understood the recuire- ments the Tentatve,Map. He was reminded that -the Planning Commission, in keeping with the Subdivision Ordinance, had the authority to impose further conditions if they felt it necessary. Comm.- Balshaw made the motion to recommend approval ! of the Tentative Map and conditions of approval, with recommendations for amendment•.as discussed, and Comm. Bond seconded the motion. Balshaw felt the school groixnds should not be fenced but allowed to be open to the public.. Mr. Lesl.y Meyer, Superintendent of Schools, was called up ©n for comme'nts.xegarding the requirement for a 5 -foot fence along S' unnyhills Drive. I °Ie informed, the Commission that although he knew of no specific requirement for a fence, that it was normally done and he felt it would be desirable for the neighboring families. Mr. Meyer stated the School. grounds are open as much as possible to the public and that installation of gates or other.. openings would provide acc,essability. Fie added that if fencing was utilized landscaping would be desirable. Comm. —Bond made a motion to.r.ecommend approval of the 'Tentative with conditions of approval as cited, with-the exception of Condition 015 which would 'take a special: .action_,, and Comm. EIR was filed by the School District with the State but does not cover the guidelines necessary ,f'or .our procedures for EIR'si, nor has it been prepared by a City approved Consultant. it was the, .determination that the use in the area possibly could be compatible, but there are factors that must be ironed out to comply with State law. Comm. Popp opened the Public Hearing. A recess Maas called at 9:40 p.m. and the meeting resumed at 9:45 p.m. 4 Petaluma City Planning Commission Minutes, May 29, 1973 ,Mr. Lesly Meyer, Superintendent of Schools, • addressed the Commission and gave a brief history of the San Antonio Continuation High School and why a new site was required. He added that although he would not consider the site for an elementary or regular high school, he felt that it was the proper site for the type of school proposed and that past experience had shown the people did not want residential areas utilized for this purpose. Mr. Meyer stated he was surprised by the .recommendation of the staff_ and requested the Planning Commission grant permission to move ahead, adding that their legal advisors had told them they could go ahead regardless of the City's regulations. The Armory and Pacific Telephone Company had informed him they had no objection to this project. Art La.Franchi, President of the Board, and Bob Stimson and Dan Plumley, members of the Board, spoke in support of the development. They requested the Commission to consider the fact that this was a matter of a public agency doing a public job that would be of value to the community and that the U.S. Government had deeded, the property to them for this purpose. It was their opinion that there would be no adverse effect upon the environment and the question was raised as to what the significant impact anticipated was.. The Commission.was informed that the time element was very cr.itica -1 as this school was needed for the utilization of 160 students in September, and also asked why the school district i had not been informed of problems at an earlier date. They concluded by requesting the Commission to pass on the matter this evening. Mr. McGivern ex p lained that although the School District had forwarded an EIR (prepared by their own architect) direct to the State, that agency had not sent. a copy to .the City of Petaluma for evaluation. Furthermore, he felt the question of whether the Council of Intergovernmental Relations or the City of Petaluma is the "Lead Agency" should be resolved and proper procedures followed to avoid a possible challenge by a mearby land owner or citizen for non- compliance with State law. The staff advised that Bill wurzburg of the School District had been advised by telephone of the contents of the staff report. It was also reiterated that the EIR for- warded to the State had no, comment regarding flood- ing of the site and mitigation factors, nor sufficient amplification of other adverse land use environmental • effects. The.Public Bearing was closed. 16M Petaluma City Planning Commission Minutes, May 2:9, 1.973 Comm. Balshaw rzade the motion that the Planning Commission .find and determine that the subject 1` project will not have a significant effect upon the environment and that the Director of Community Development should be directed to prepare - and post a Negative Declaration ref-iecting the Commission's decision. The applicant etas advised that the Use Permit appli- cation would be acted upon by the Commission on June 19, 1973 to allow for the 10-day period for public appeals of the Negative Declaration required by State l aw -. COUNTY OF SONOMA The staff :report recommending approval of the Use MENTAL HEALTH Permit was read and the Public Hearing opened, SERVICES bEPT. USE PERMIT U4 - 73: M.r. F. C. Jordon, Administrative Assistant of the Sonoma County Mental: Health Services, addressed the Commission informi them of the background of the Mental Health Program and why an office was required in Petaluma. No comments were offered from the { audience and the Public Hearing was closed. The staff was asked if any of the neighbors had called stating o.bjedtions. Mr. Anderson replied, that a few had been concerned about tax increase and possible noise from the proposed usage. He had advised the callers that it would not have an affect on their taxes and that the noise factor would be less than a possible rental inasmuch as this was only a nine to five operation, and they had seemed �) satvisfled. A discussion followed regarding the adequacy of the parking spaces. Comm. Bond made the motion .to grant the requested Use Permit and Comm. Balshaw seconded the motion.
