F'REY AUTOMOTIVE Th'e, staff report regarding the Environmental ENVIRONMENTAL IMPACT Impact Questionnaire was­ read by the staff QUESTIONNAIRE & recommending that.the Planning Commission find USE PERMIT U5 -7.3: and determine that thge project will not have a significant effect upon the, environment and that the Director of .Community Development should be directed' to prepare a Ne.gat'.ve Declaration The 1 s °t :aff report regarding the Use Permit applic;a- tion was read for further edification of the project and a site plan furnished.to the Commissioners for their review. The Public Hearing was opened and the audience asked for comments for or against the Environ- mental Impact' Questionnaire., Mr.'Dick.Lieb., representing Frey Automotive, explained this project r.es:ulted as' a need for expansion of Mr. Frey's facilities and that a letter had`been furnished.the City stating the Sonoma County Flood Control or the City of Petaluma would not be responsible for flood damage if the property and building pad were not filled to the elevations recommended. The .Public Hearing was'closed Comm. made-the 'notion that the Planning Commission find and determine that the subject project will not have a sign -ifi „cant effect upon the environment and that the! Director' of Community Development should`be directed to prepare and post -a Negative Declaration reflecting t1re Commission's decision. The motion was seconded by Comm. Balshaw. Lyle Hood ,addressed the Commission stating that'his engineer, the Ci the Fire Chief and-himself had discussed the items as suggested by the Site Design Review Com- -mittee.. Mr. Hood stated' they positioning of the fire hydrants..would depend on amount of available watex'flow and he had determined to use commercial driveway standards. The Commission reviewed the site plans and discussed-the driveway width And sidewalks. Comm. Waters made the motion, to concur with the reco ,the Site: Design Review Committee for approval subject to the conditions of approval of the staff and the City Engineer. The motion was seconded by"Comm. Balshaw. AYES '5 NOES 0 ABSERT 2 ABSTAINED 1 2. Correspondence had been.received from Douglas Oi , 1 Company requesting a,change in Condi- tion #15 of the site design approval for the service station proposed to be located at Stoney Point R.oad -and Petaluma Blvd. North. The Site Design Review Committee recommended adding to this condition% or an adequate backflow prevention device acceptable to the 'Chief Building. Inspector sh,all,be installed two feet from the buildings.where the build- ing drainage system meets the sewer line." This alternative would also prevent sewage pollution from the service station..restroom fixtures in.th�e event flooding occurred. Comm. Daly made -the motion to concur`' with the Site Design Review'Com:rfiittee recommen- dation and Comm. Waters-seconded the motion. AYES 5 NOES 0 ABSENT 2 -2- PLANNING COMMISSION MEETING.MINUTES JUNE 19, 1973 PETALUMA:CITY HIGH mr. McGivern presented a brief synopsis of the SCHOOL DISTRICT USE, conditions of approval recommended in the staff PERMIT U;6 -73: report. The continuation of thePublic Hearing was opened and the audience asked for comments. Mr. Meyers, Superintendent of Schools, addressed the.Commission regarding the condition requiring 9'3 parking spaces. He stated that a s=tudy had been made which,indica:ted only 30 -35 parking , spaces were utilized at the presentschool and the 'school district, wished to control the amount of parking spaces. He added that if the demand for additional parking was needed at a later date it would be provided. I Mr, McGivern advised the Commission they had the authority to reduce the amount of parking spaces based on testimony given if they chose to do so and a brief discussion followed. The Public Hearing was closed. Comm. Daly made the motion to accept the recommen- dati'on of the staff for ap.p;roval_ with conditions as cited with the exception of Condition #3 which should be reduced to require a minimum of 36 j parking spaces and additional parking to be pro - vided when needed in order that parking for this facility be provided on-site. Comm. Hood seconded to the motion,. AYES 5 NOES 0 ABSENT 2 -.. MODIFICATIONS TO THE Continuation-of, the,Public Hearing to consider RASTER PLAN OF mod'if.i °cations to the Master 'Plan of Zoning to ZONING: bring it into consistency with Zoning Ordinance No. 1072 N.C.S.: Area.No,, 28: Mr.. Gray presented a synopsis of the staff re- port :for the lands of the Petaluma Cooperative Creamery, recommending a change to C -H zoning for the creamery parcel and _R -C for the Moose Lodge parking lot. 'The audience was asked for comments and Mr. Webb, 4,32 Baker Street, addressed the Commission to advise them of the portable u.nitts used to run the deepfreeze for the- c_reamery'which were located on the Moose Lodge parking lot. He stated they were running constantly and created a noise ' nuisance.. Mr. Webb was also concerned about possible undesirable aspects if this small area was rezoned to R -C. 3 - 1 .PLANNING: C01 MEETING MINUTES JUNE 19, 1973 Mr.; McGivern advised that if there was a noise nuisance it would have nothing to do with the zoning. However, if a noise nuisance existed, it would have to be abated and,Mr. Webb could • file a complaint with the Community Development Department. A brief discussion followed and the staff assured the Commission that an inspection would be made to determine if a noise nuis °ante existed. Area No.: :'32 Mr.. Gray further advised Mr. Webb that if the units . ewere established in a -legal manner, that under the provisions of the R -C district,. they . Would-be non -- conforming. If they were not es=- tablished through appropriate-- procedure, they would.be considered illegal uses and would have t:o be abated . Comm. Daly made the motion to concur with the recommendations of the staff to rezone the creamery parcel to C -H and the Moose Lodge parking.lot to R -C and Comm. Waters seconded the motion. AYES 5 NOES 0 ABSENT 2 The staff report was read by Mr. Gray for the area .between Sixth and Seventh Streets, "F" and "G" Streets. The audience was asked for comments and Mr. David Traversi, representing the owners of the hatchery property, explained to the Commission why they had.requ'ested this parcel to be placed in a "S" Study District. The owners wished to give careful cons'idera.ti.on for 'the proper usage of this area to conform with the surrounding residential property, and the eight months time element in the zoning ordinance for a "S "IiStudy District would enable them to do so. The Public Hearing was closed. Comm,. Hood asked how large the parcel for the "S" District was and Mr. Traversi told him it was 46,000 square feet'and the building occupied . 32,000 square feet. Comm. Hood made the motion to rezone the lands of the .hatchery to a "S Study District and Comm. Balshaw seconded the motion: AYES 5 NOES 0 ABSENT 2 - 4 - PLANNING COMMISSION MEEETIN.G MINUTE'S' JUNE. 19 , 1973 Comm. Waters .made the motion to rezone the-lands which are in apartment use to R -M -G and Comm. Daly seconded th'e motion. AYES 5 NOES 0 ABSENT 2 MODIFICATIONS TO The staff report was read recommending various ZONING ORDINANCE changes, to the Zoning Ordinance and the Public NO. 1072. N.C.S.: Hearing was opened. Mr.,Dick Li.eb questioned the definition of "Multiple Dwelling Units` contained in the recommended change to Section 26 -400. i After a short discussion the Commission determined. to delete "Multiple Dwelling Units" and add "More than One Dwelling Unit on a Single Parcel." The Public Hearing was closed. 5 - A duplication in the section numbering was noted and appropriate change of the. last item to "Section 1.3- 20;9 " was made. A brief discussion followed regarding commercial parking lots for passenger vehicles. Comm. Balshhaw' questioned the change to Section 25 -302 and it was explained by the staff there were many small neighborhood businesses such as gasoline stations and small neighborhood stores that would . have to be abated in the next year if the 3 year abatement time element remained in the zoning ordinance. The .staff felt that it would only be necessary to abate such usages if they became a nuisance or were kept in ,a run -down condition. The Commission determined to add "as determined by , the City Council" to Section 25 -302. Comm. Balshaw made the motion to concur with the recommendations of the staff as amended by the three changes made by the Commission and Comm. Hood seconded the motion AYES 5 NOES 0 ABSENT .2- SUN TERRACE.-PARK Mr; McGivern explained the time element involved SUBDIVISION TENTATIVE regarding the Tentative Map to the;Commission MAP: inasmuch as due to,the many delays encountered the Tentative Map original'ly submitted had ex- R entative Map pLred. He added that the evised.T had been accepted, however the fees have not 'been paid as yet, Mr. McGivern suggested that a condition of ap.ptoval•be added re4diring that the fees for the Revised Tentative Map 'shal:l be paid 5 - PLANNING COMMISSION MEETING MINUTES JUNE 19, 1973 j by a prescribed date set by the. Planning Commission; and i n ot paid by that date.,; th e m would auto - '� ma•tica.11y The City Attorney had advised �. that the P`l,anning Commission could take action on the original Tentat Map to extend it another year and then take action on the Revised Tenta- tive Map. The staff felt it should be :considered as.a new map with new conditions of approval. A question was raised on the expiration date of the authority to build the 149 units and further discussion brought. out the facts that the time element is six months after a building permit is issued and no other time element would apply as this a llotment. was :.not under the Residential Development Evaluation Board allotments or proced- ures. Mr. Ken President of U.S. Equities, ad- dressed the.Commission and stated he agreed with the staff that a great deal of time and effort had been contributed by them and he would be willing to pay the fees. He added he would like it considered as a.Revised Tentative Map, A short discussion followed and the Commission set- June 30, 1973 as-the deadline to pay the re- quire- fees. It was brought out that the ex- piration date the original Tentative was April l9 1913 and the granting of a ygar extension would end on .April 19, 1974. Mr Poulsen- stated this would allow them sufficient time to file a Final Map. Comm. p.aly made the motion to extend the time on the origs:nal Tentative Map from April. 19, 1973 to April 19, 1974 and that applicable fees be collected for the Revised Tentative Map, and Comm. Waters seconded the motion. AYES 5 NOES 0 ABSENT 2 A brief synopsis of the recommendations of the Subdivision Committee and the recommended condi- s t approval for this Revised Tentative Map { was presented. The dedication of four acres of land for park and recareational putposes, which had eminated from a meeting of the Commissioners and the Parks &e Recreation Commission, was-specif- ically brought to the attention of the Commission. A recess was called at 9;30 p.m.. and the meeting read purned at 9035 p.m. Mr. Ken Poulsen, U.S. Equi•ties,, Inc., addressed the Commission and gage a brief summary of the.back- ground that had transpired on this development,. He advised, that 4 -1y2 acres had to be purchased from the adjacent property owner, which are 'currently I -6- PLANNING COMMISSION MEETING MINUTES JUNE 19, 1973 outside the City limits., in order to provide the open channel treatment for a 100 -year storm for the 300 units . originally proposed.. Mr. BIzot., Charles Delk & Association, showed the Comm°s °sion the changes on the Revised Tentative Map to include the additional property acquired, treat- ment. of the .open channelzaton,. the 'landscaped park- way,..and the bicycle paths and sidewalks, through the parkway area® i Comm, questioned if additional units could. now be.planaedbecause of the additional 4 -1/2 acres. The s`t °aff explained that the City Council had previously i approved.9A units on 28.5 acres and they would have to make a determination on the .additional acreage as 1 it , still had to go through the prezoning and annexation j process The. Commission• was in agreement that the additional four acres should •not change the total number ,of units upward from 2,68. Mr. Poulsen addressed the Commission regarding various conditions -of approval, With ,regard to Condition 44 for phasing,, he stated it might be necessary to shift phasing 1slightly due to economics but it was their - intent to build in phases of 65 -70 units and that buildings would remain in. locations, as shown® He was • , advised' this was permissible as long as the 149 units were adhered: to. With regard to Condition #8, Mr® Poulsen.advis;ed the Commission that management con - tracts cannot be awarded for'more than one year in accordance with State law® He further stated that the City Manager had been contacted regarding the necessary annexation in Condition #16 and he had indicated no major problems, Mr. "Poilsen stated it was their intent to get rid of the structures bordering on Ely Road in the first j phase of development but didn't know the annexation procedures He was advised that first the property would'•have to be prez,oned and then annexed, and 'that units - outs de the City :limits could, not be acted on until the. annexation was complete. Also inundation measures would have to be taken. 'care of before any development occurred® the time element involved was discussed and an estimate of a minimum of three months to finalize annexation given. Mr. Poulsen asked, that. Condition #'14 be. deleted as they are, already providing ,, a :park , are`a along a the creek: which is double, what the State guide- 1 lines requires for open space for the property, and.that ionly 26% coverage had been planned for the unit phase. He was advised that this r iJ I i 1 PLANNING' COMMISSION MEETING MINUTES 0 -JUNE 19, 1973 OTHER BUSINESS: Counciaman Daly gave a review of the June 18, 1973 meeting of the_City Council. In reply to questions raised at the last Commis°sio;n meeting, the staff furnished the following infor- ,i mation: 1., Regarding the property adjacent to the,north side of the Petaluma Plaza., it is the opinion of the City Attorney that the requirement for reversion to original zoning which existed at the time this 10 acr--e parcel was rezoned i to C -C District does not apply. 2. According to the City Manager! the EXXON people have stated they will have the im- provements completed and their station moved by September 1973. 3. Three locations .are being considered for future use:of the Greyhound depot, i.e.., the - train station switching yards site, the Fair' grounds, and a parcel adjacent to the Petaluma. - 8 - parkway was required only because of the flood control program and would be dedicated to the Sonoma County Flood Control Agency. Also, the. Subdivision ordinance requires 1-1/'2 acres per 100 units for park and recreational dedication and the Parks and Recreation Commission had. determined that the land for .the planned green- belt at the north-end of the- development:.be dedicated rather than the ln, -Lieu payment. It was,also brought out that FAA guidelines would 1 not. allow any development in the flight path of the airport. I - Comm. Waters made'the, motion to approve the Re- wised Tentative Map with the conditions of approval II° as recommended by the Director of Community .De- I velopment and the City : Engineer with the addi- i tional. condition that al required fees would be paid by the end of the fiscal year. Comm. Daly seconded the motion. AYES 6 NOES 0 ABSENT 1 i Comm. Balshaw requested that the additional site plan map be included in the official file as an Exhibit.. The applicant was advised he could appeal the park requirements t'o the City Council. OTHER BUSINESS: Counciaman Daly gave a review of the June 18, 1973 meeting of the_City Council.
