APPROVAL OF MINUTES: The minutes of June 19, 1973 were approved with the
following additions. On page 2 the vote for Lyle
.Hood's site design had been omitted and should read
"4 AYES 0 NOES. 2 ABSENT 1 ABSTAINED -" On Page 7,
Comm. Balshaw requested further clarification
should be made by adding, "The Commission was in
agreement 'that the addit'ion'al four acres should not
change the total number. of units upward from 268."
after the,third paragraph.
CORRESPONDENCE: Mr. Gray .informed the Commission that Senate Bill
No. 594 had been adopted, and in effect extends the
date for adoption of the open space and conservation
elements of the General Plan and the date. when eon-
.sastency of the General. Plan with the Zoning Ord -
nance must be accomplished to January 1, 1974.
Mr. Anderson informed the-Commission of an item
from the Sonoma County Agenda regarding the,realign-
went at Gossage Avenue and Petaluma, Boulevard North.
The projedt report from the County was read which
stated the purpose.o;f the °realignment was to provide
better site distance relative to the two streets and
that at the present time it was a definite safety
hazard. This realignment.,would result in the re-
moval of eight trees ranging in size from 20 inches
to 3`6 inches in diameter.
A great deal of discussion followed regarding the
safety factor involved and the general feeling that
the tees should be preserved. Comm. Waters then
made the motion to direct the staff to inform the
County that although there is a recognized safety
problem in this area, the Planning Commission does
not,concur with the proposal for this realignment
and that the County explore the pos:sib.lite's of
alternate plans to solve the safety problem and

preserve the trees, Comm. Hood seconded the
motion

SITE DESIGN REVIEW
COMMITTEE REPORTS:
1n Mr, & Mrs. Romero Ja Maffia, Jr. - Duplex
proposed at 721 "H" Street in a R -C District:
Mr. Anderson informed the Commission that the
Site Design Review Committee had concurred
with the staff's recommendation f,or approval
subject to the conditions of approval as
cited in the staff report and Exhibit "A ".
A brief discussion followed after which Comm.
Balshaw made the motion to approve the site
design subject to Exhibit "A" and the condi-
tions of approval as cited and Comm.. Hood
seconded the motion,

at 210 Vallejo Street, including a variance
for 5" rear yard 'setback.
Mr. Anderson gave a, synopsis of the staff re=
port with the recommended conditions of approval
and explained why the variance had been requested.
The Sete Design Review Committee had recom
mended approval of the variance and concurred
with the conditions of the staff report.
The audience was asked if anyone wished to.
speak in opposition of the granting of this
variance and no comments were offered.
Comm. Balshaw stated for the record that he would
not be willing to give the owner of the office
building parking lot adjacent to the rear of the
subject site a variance if he would come in for
a minimum side yard. Mr. Anderson informed the
Commission that the parking at the rear of that
office building was necessary for the existing
structure. The Commission was informed that a
variance could be granted on the subject develop-
ment if it was, found that the Findings of Sec -
tion 26 -30:3 of the zoning ordinance had been met.
Comm, Hood questioned the maneuverability of
the driveway and parking lots and a great deal of
discussion followed, The Commission agreed the
most s.oixtherly parking space should be marked
"For Employees Use Only °" or "For Compact Cars

The question arose if the office building
plans had been expanded since originally
piesented at the time of rezoning and the
owner, Mr-Newm4li 8. Nelson, clarified that

OMOTIVE The staff reminded the Commission that all

garage for repair and maintenance of passenger
cart and trucks at 121 Lakeville St had been
discussed at the last meeting of the Commission
and that the recommendation was for approval
with conditions as cited .

approval,
Comm, Hood remarked that the staff report indi-
cated that a variance to allow for a 5-foot
setback on the northwesterly side property line
would be required accordin ' g to the proposed
plans. Mr, Anderson explained to the Commission
why the variance was required according to the lot
arrangement and that granting of such a variance
would not be detrimental to surrounding properties.
Mt. Web informed the Commission that the variance
Was requested because there wer=e similar rights
enjoyed by adjoining property owners, who had
been, granted variances, He explained to the
Commission why a variance mas desirable for.this
particular site,
Comm., Daly made a motion to grant the variance and
Comm: Balshaw seconded the mot=ion. Before the vote
Was taken, Comm. Hood questioned the Inqation of the
building on the site and why the variance had not
been presented more thoroughly to Ae Commission.
He did not agree that the neighboring properties
enjoyed similar rights and felt more information
was needed to make a decision on this variance-
-Considerable discussion of the area ensued by the
Commissioners, after which the staff recogni2ed

the fact that a more thorough staff report and
analysis was necessary and stated it would be
done,, Mr. Gravy suggested . acting on the use
,permit citing the variance as a condition and
thereby rendering it invalid if the .variance
was not granted, Comm.. Balshaw suggested
getting a sign -off from adjacent property
owners.
Comm. Daly withdraw his introductory motion to
grant the variance and Comm., Balshaw withdrew
his second,
Comm, Bond made a motion to table the variance .
until the next meeting when a more complete
re.Port would be available and Comm. Waters
seconded the .motion.

OTHER BUSINESS:
The City Council refereed an application by Jack
J Clement for an outside sewer connection for
four single - family dwellings to be located at the
westerly end of Morning Stun Drive. The council
had f e,lt it was a planning matter and therefore
felt. the Commission should review the application.
Mr. Gray' gave thei at;aff report which recommended
approval of the outside sewer connection.
Annexation of this general area was discussed and
the staff clarified that one of `the conditions
required for annexation was that an assessment
district be created to improve 'Sunnyslope Avenue
to City standards, and two annexation studies
indicated the residents were not ready for annex-
ation,
The applicant addressed 'the Commission and informed
I them that he had purchased the lot with design in
! mind and had sought a lot'that would fit the

Environmental Design Plan. He added he intended
a nice development and showed the members of the
Commission plans depicting it,

Comm Balshaw stated he_did not approve of peri-
pheral development outside of the City limits. Mr.
Gray informed the Commission that it is the general,

policy�of -the City to discourage approval of
° sewer extension-to small lots but that it appeared
this proposed development exceeded that category
and would be. a comfortable, subdivision. He
added it i s also the policy that hookups will be
j permitted where available next to the property,
but that the applicant was required to come to
the City Council for approval

Mr. Gray.informed the Commission that the City
Council ` wanted to.-....receive direction from the
Commission as to whether or not this development
fell within the sphere of the EDP and the General
Plan and were looking for a means to determine the
actual stopping,point.on granting this type of
application and set future policy,
Comm. Bond questioned how further breakdown could
b.e prevented and was told that any additional•sewer
hookups would -have to� go back to the City for
approval.
' Comm. Hood felt the plan for development was good

would-serve as a safeguard for the area by
setting a precedence. He therefore felt it should
,be acted- on favorably.
' Comm :Popp and Waters expressed concern about the
adjacent properties and the fact.that this develop -
Met was not contiguous for annexation, and, felt
that a study of- the surroLinding area was needed,
°Mr.o, Gray advised the Commiss they could
:recommend this particular hookup of the.sewer and_
further° recommend to the City Council that a letter`
!. be directed to the Board of Supervisors for a.joint
4 study session on this area -.
Comma Balshaw asked for the opinion of -the staff and
Mr. Gray answered tlat if .Planning had enough staff
the. entire area around the. periphery of the City
should be studied anc7 prezoned and all applications
for hookup within the area would,be reviewed as if
they. 'w.ere .within the ;City. In lieu of that method
the City could only deal on a case to case basis
I nd established policies. Mr. Gray added the staff
' felt that this particular development judged on its_
own merits meets all of the criteria of. the City,
meets•th intent of the EDP and General Plan, and.
sets La precedence, setting density for extension
of sewers under the current policy.' and therefore
would recommend approval..,_

Comm. Balshaw made a motion to recommend
approval of this.connection for the four units
based upon.the determination that the develop -
men=t is of a desirable character, but that
prior to acting on any future requests from the
City Council such as this the Commission would
desire to have plans-submitted" as would be
submitted- a normal in- cl3ity development. He
added that he also felt a'study of the area
should be made.
Comm. Bond.' stated he felt- a study session
should be scheduled and the motion died for
a lack of a second.
Comm,. Bond made a motion,to suggest a study
session regarding peripheral developments with
the County in- concert with them and possibly
the City Council, so that the Commission could
formulate a policy.response to the City Council
a s requested. Comm. Waters seconded the motion.

Mr. Gray reminded the Commission that the County
would move ahead on the lot split and if granted
would probably condition :t.upgn. the granting of
the sewer hookup and that the City would still
have to make that determination.,
Comm,.Bond a motion to request the City Council
to hold the matter of the sewer and water connection,
for this development in abeyance until a study
session could be held. Comm. Waters seconded the
motion..

Mr. Gray suggested to the Commission that in order
to expedite the adoption of the amendments to the
Residential Development Control System and the
Housing Element, that both of these documents be
presented to the Council. before their next meeting
on July 16, 1973, The Council could then act upon.
the Residential Deve>lopnent Control System Amend -
ments on that -date as they did not require Planning
Commission action Also the staff wished to.have
a joint study session with the Council and the
Commission at 7 :00 p.,m on July 17, 1973, on the
i Housing Element so . that both- parties could be
introduced to it together. Mr. Gray added that

August 15, 1.973 is the deadline for submittal of
applications under the. Residential Development
Control System. The.members: of the Commission
agreed to this time schedule - however, Chairman
Popp stated he would not be able to attend that
meeting.
Councilman Daly gave, a briefing of the City
Council meeting of July 2, 1973. The Commission
was also informed that the Council would meet
again on July 16, 19:73,_ at which time the seat-
ng of the Commission would be determined,
Comm. Balshaw suggested that in the future the
Commission not only approve site designs but re-
quire the developer to sign mantenance' agreements
with the City. He stated he had recently - noticed
the following discrepancies:
1.. Round Table Pizza - No landscaping done,
2e Quik -;'top - Overgrown with weeds
3. Barta Hide - Trees were dying,.
Comm. Balshaw also asked what would happen to the
trees in front-of the swimming pool when Washington
Street was widened and also i it were possible to
do some landscaping before the widening,
Mr. Gray advised that the Building Inspector would
be directed to check the three sites for appropriate
action and he would inquire about the trees in front
