with conditions as cited was read. by the
staff. Comm. Waters, the representative
for the Committee, stated it was - a definite
improvement for the area and a proper usage.
Comm. Waters made the motion to approve
the site design as recommended by the Site
Design Review Committee and Comm. Balshaw
seconded the motion,.

for a 'plant at Lakeville highway, and Frates

The -Site Design Review Committee report
recommend approval of the site design
with conditions as cited, w'as read by the staff.
Mr. William McDevitt, representing Stero,
showed the building plans to the members
of, the Commissiorn and explained the design
proposed. The color of the building was
discussed and Mr- McDevitt said that was
flexible.and could be coordinated with the
staff.
Comm. Waters stated he felt that a maintenance
clause should be included to .insure that

lands,c -aping would not be allowed to deteri,o-
rate.
Comm. Mond questioned why this development was
considered categorically exempt from th:e
requirement of an .Environmental ,Impact
Report and the staff informed him that
inquiries 'to appropriate agencies as to the
possibility of` an environmental impact had
all been negative,.. Under the provisions of
Resolution No. 6262 N,.C.S., the Director of
Community Development then has the authority
to make a determination if he finds, with
certainty, the proj.e will not have a sig-
nificant effect on the environment. This
determination is subject to appeal to the
Planning Commission.
Comm. Balshaw questioned the comments from the
Division of Highways and was informed the only
requirement they lzad stated was that an
encroachment permit be obtained, which is
one of the conditions of approval They
had indicated ,that the existing setback would
be adequate for any future widening of
Lakeville Highway.
Comm. Balshaw made the motion to concur
with recommendations of the Site Design
.
Review committee for ;approval of this' project
and Comm. Bond seconded the motion.

The staff questioned if it was intended that
a maintenance clause be included as a condi-
tion of approval and the Commission re-
plied the approval .of the maintenance as-
pect and color of -the building would be
the responsibility of the staff.
3. Frey Automoti Service Request for a
variance to allow for a. reduction in required
sideyard setback from 2'0 feet t to 5 feet for
a ,proposed autmotive garage at .121 Lakeville
Street:
The Commission was reminded that this item
had been discussed at a previous meeting and
further clarification and information had
been determined necessary. It was noted that
the determination had been made that other..

neighboring property owners enjoyed similar
rights..
Comm. Bond .made the moti -on to approve the
variance as recommended by the Site Design
Review Committee and Comm. Waters seconded
the motion.

FREY AUTOMOTIVE It. was noted that, th was a continuation
USE PERMIT U5 -73: of a public hearing to consider the Use
Permit appli..cat`ion submitted 'by Frey Auto-
motive for an automotive garage at 121
Lakeville Street in. a M -L District.
The staff report recommending approval
of the Use Permit was read. Comm. Balshaw
recommended that outside parking be limited
to 72 hours as a condition of the use
permit. Mr. Frey stated he had no objection
to the 72 -hour limitation and that he had
no intention of :parking cars outside
overnight unless it was impossible to move
them because of needed repairs.
TIye audience was asked for comments for
or against. Noy res,pons'e was given and the
Public Hearing was closed.
i The staff recommended adding the following -
condition, "No cars shall be parked on the
site in the open for a period exceeding

Street was read. It was noted that the
Site Design Review Committee 'iad re-
viewed this EIQ*and concurred with the
staff's ' recommend, - atLon. Based on the in-
formation presentd to them, the Commis-
sion found and determined that the sub -
j,ect project would not have a significant
effect upon the environment and

should therefore receive a Negative Dec -
laration.
Comm. Bond therefore made a motion directing
the Director of Community Development to
prepare and post a Negative Declaration
reflecting the Commission's decision.
The motion was seconded ,by Comm. Balshaw.

The applicant was advised that the site
design application . would be acted upon
by the Commission at the;next meeting to
allow for the 10 -day period for public
appeals of the Negative Declaration as
. required by State law.

CAMILLE 1 ,4N`1'ERPRISES Mr. Gray informed the Commission that
- ENVIRONMENTAL a draft Environmental Impact Report had

H. Laidlaw for Camille .Enterprises pro -
posed Keokuk apartments.. He further
explained that because of the fact that
this EIR had been started prior to the
implementation of the State guidelines,
it was not as detai;le`d and specific as
it should be, howe'ver� i`t complied with
the intent of the California Environ-
mental Quality Act requirements.
f� Mr. Dennis Boehlje referred to Section
f 4' 15012 of the State Resource Agency's
; "Guidelines for Implementation of the
California Lnvir_onmental Quality Act of
1970" and gave a brief explanation of
the procedures involved_ in EIR prepara-
tion and evaluation,,. He then presented
the staf'f's evaluations and the recommen-
dation that the Commission find that the
project will not have a significant
adverse impact on the,.environment and
that the proposed project by given.en-
vironmental approval.
An; explanation of the map and allocation
was requested by the Commission and Mr.
Boehlje- explained that the City Council
had approved the transfer of the 36
units allocated to M. Forman to be
added to Camille "s allotment of 51 units

for a total of 81 units, on the site, not
including the sh °aded portion marked "Not
a part of' previous allotment." The de-
velopment of the. shaded :poxtion would be
s•ubect to -allocation of additional units
under the Residential Development Control
System.
The Public Hearing was opened and Mr. Gerald
T. Stewart, 24.Seventh Street, asked the
Commission what the difference was be-
twe;en. the original guidelines and the cur-
rent guidelines, and what conditions
were not presented in the EIR to the
Commission. The staff stated that the
! best way to ;answer the question was to give
it Mr. Stewart a copy of both guidelines for
his perusal. It was explained that the
original guidelines were;. prepared by the
City as interim guidelines and the current
guidelines were those, adopted utilizing
the State's guidelines under_the California
Environmental Quality Act, and .the EIR
submitted did meet the intent of-these
latter requirements..
Mr.. Patrick McGuire, Camille Enterprises,
addressed the .Commission, stating that. the
combin.ing'of, Mr. Forman's allocation with
Camille's alleviates a problem for Mr.
Forman and the City, as Mr. Forman did
have proper accests from his _property and
it was determined best for Camille to take
over the entire site.
The Public Hearing was closed:
Various questions were raised by.the Com-
mission regarding the street layout and
the,adequacy of the draft ETR: The staff
utilized the site plan to show the site
layout and proposed streets. It was
clarified that Mr. Laidlaw was on the
City's list of ;approved Consultants.
Regarding the alternate mitigations,
it was stated that the staff did not
disagree with the conclusions reached,
but the, backup data was not included
in the EIR and it had 'taken a good deal
of checking on their part to research
some of this information,. This lack
of data was due to the fact that the

specific guidelines had not yet been
established and adopted as explained
previously, and was not therefore cons-
der,ed to be an improper presentation.
It was further clar;fie.d that the reference
to water and sewers was not major as it
was a matter of minor extensions to alle-
viate capacity p rob lems'.
Mr. McGuire informed the Commission
that-,he had chosen Mr. Laidlaw from
the City's list of Consultants and that
l Mr. McGivern had given the Consultant
direction as to the EIR preparation
and the areas of importance.
`1'he resolution recommending that the
City Council give the proposed project
environmental approval was read and Comm.
1 Waters made the motion to accept the
f EIR. Comm;. Balshaw seconded the motion.

OTHER BUSINESS
Comm. Balshaw referred to Section 27-
600 of the Zoning Ordinance in which it
states that.only such evidence and plans
as submitted and ruled upon by the Com-
mission may be accepted in an appeal, and
if additional evidence or modifications
in plans are introduced the case shall
be returned to the Commission for a new
ruling. he remarked that Councilman
Daly, the Council representative, has
repeatedly told the Commission that new
information had been made available and
based on this information, the Council
has changed the Planning Commission's
recommendations. Comm. Balshaw also
.referred to Section 27 -800 which states
that if the City Council proposes to amend
the Zoning Ordinance in a form altered
from said amendment as recommended by
.the.Planning Commission., the City Council
shall refer said matter back to the
Planning Commission for report and re-
commendation before adoption. Since this
ruling has not been adhered to, it was
his feeling that it should be called to

t he attention of the Council. Mr Gray
informed the Commission that, since the new
council representative Councilman Mattei,
was not present this, evening, he would
contact him so that he could take this matter
back to the Council.

ments from the public, were offered and

Comm. Waters made the* motion to follow
the staff's recommendation for accep-
tance of the EIQ and that the
Director of Community,_ Development should
be directed to prepare and post a Nega -��
the Declaration reflecting the Commis -
sio_ n's decision. • The motion was seconded

HOUSING ELEMENT The introduction of the update to the
UPDATE:'! Housing Element had been given earlier
in the evening in 'a joint Study Session
of :the City Council and. the Planning
Commission.
In response to an inquiry regarding the
inclusion of .low cost 'housing in the
element, Mr. 8oehlje informed the Com-
mission that the County leased housing
program is: mentioned in the Housing
Element Appendix and other possibili-
ties are talked about in the Housing
Element, but not elaborated in the update.
A long discussion followed regarding
development costs, low cost housing
availability, subsidized housing and var-
ious programs used by other cities.

A. recess was called at 9:25 p.m. and the
meeting resumed at 9:35 p.m.
Mr. Boehlje presented a brief summary
of the update material recommended for
u
the Housing Element. and the Public "gearing
was opened.
Mr. Patrick McGuire,, Camille Enterprises,
addressed -the Commission and stated he
felt the evaluation process of the
allocations should be speeded up. Mr.
Gray informed him' that item came under
the Residential Development Contrcl Sys-
tem policies being considered by the City
Council. Mr. McGuire remarked that
the 100 unit limitation to each developer
is extremely detrimental in planning a
project as the project itself determines
the number. ; e also informed the Commis -
sion that it is very expensive to build
on the West side of town because of the
hills and if the City wished equal dis-
tribution of population,, they should
give special' encouragement for development
there. It-was Mr. McGui'res contention
that until new standards are applied
by the municipalities and new techniques
in home building are conceived, - that
low cost housing will never come to pass
because 'of the constantly increasing
costs for building materials.
Comm. Dilaters made the motion that the
Public hearing be continued until the
update could be studied further by the
Commission, and added he would like to
see Mr. Robert's 'comments.
Comm. Bond seconded the motion.

A brief discussion followed on the re-
furbishing of housing presently consi-
dered substandard and the FACT! Program.
The staff informed the Commission this
factor Gould be explored further.

that side. The staff stated they would
check to see what could be done to im-
prove the situation.
Mr. Gray informed the .Commission that ' the
matter of the trailers on Lindberg Lane
had been checked by the Building Inspec-
tor and no code: violation existed.
Comm. Hood commented that site design
approval had. not been. granted and it was
determined to Check on this aspect.
Comm. Balshaw stated that in taitking with
an individual from the Division of
Highways, they were concerned that any
- .additional fill might result in flooding
Of their property on.Payran Street.
Mr. Gray stated he would -check on the matte
