Bond arrived at 8:45 p.m. ABSENT: Comm. Balshaw, , Hood S`t'A.FF: Frank B. Gray,, Senior Planner OCTOBER 2, 7:30 P.M. PETALUMA, APPROVAL OF MINUTES: The,minutes of September 17 & 18, 1973 were 1 approved as submitted. CORRES. CE :' The City Attorney had been consulted as to the appropriateness of amending the Zoning Ordinance to require undergroundng of utilities in commercial and industrial zoning districts. His reply dated September 19, 19.73 was read which stated his opinion that it would. be inappropriate and impractical to attempt such a requirement except possibly to applica- tions for a conditional use. The Commission wished additional research on the matter and Mr. Gray informed ahem he would research publications of the Urban Land Institute and ASPO for other opinions. * * * * The Commissioners were .asked for two volunteers to serve on the. Residential Development Evaluation Board. Comm. Hilligoss volunteered to serve on the board. Comm. Balshaw was selected as the second member with Comm. Waters volunteering to serve if Comm. Balsh aw could not. * 1973 CAL I FO RN.IA €3 Two, Sonoma County referrals were .presented to the Commission for review. 1) Edward A. & Maris J. Woh;land - The staff report was read relating 'to 'the_ request for a variance for reduction from 100 foot frontage to 80 feet to allow a proposed lot split at 215 and 217 Fair Ave. in a County "A" District. I:t was the opinion of the staff that reductions in lot widths and areas in this area would be `an urbanizing influence and therefore should be opposed, After a short d.scus- si.on, Comm. Waters made the motion to write a.letter to 'the County Board of Zoning Adjustments opposing the,requested variance and Comm. Hilligoss seconded the motion. PETALUMA C OCTOBER 2, I Y PLANNING COMMISSION MINUTES 973 AYES 5 NOES 0 ABSENT 2 SITE DESI COMMITTEE FOTOMAT C 2`) Neil MacDonald Buchan The staff report was read relating to the request for a Use Permit to allow an oyster packing plant at 520 Cleveland Lane in a County "A" District. It, was the opinion of the staff that the facilities necessary to make such an operation sanitary and environmentally accep- table would be an urbanizing influence in the area and.should be opposed. After a short dis- cussion, Comm. Mat'tei, made the motion to write a letter to the County Board of Zoning Adjust - ments opposing the request variance and Comm. Hilligoss seconded the motion. AYES 5 NOES' 0' ABSENT 2 REVIEW The Site Design Review Committee report was read PORT - with recommended conditions of approval. It was ORATION: brought out that the applicant wished to use arti- ficial plants but had been.told by the Committee this decision would have to be made by the Plan- ning Commission as a whole. Comm. Bond remarked that he was opposed to large scale artificial plants but had-no opposition to their usage on this particular project; however, he wished it noted that this is an exception to the rule Mr. Gray suggested that since this is a relatively new idea, and one that may arise again, that it might be permtted'fo,'r this project and reviewed after a year. At that time live plants could be required if it was felt that the artificial plants were unsuitable. The question of future utilization of the building for a different purpose was raised. Mr. Carl Stunz, Fotomat Corporation, replied that the manufacturer would retain ownership of the building. Therefore, if the proposed use was discontinued, the building would be removed. Mr. Stunz also remarked that na tural landscaping required watering which was often neglected and resulted in requiring replacement of the plants. He felt that artificial plants were the best solution and showed the Commission a sample of an artificial Juniper. -2- i 11 1. PETALUMA CITY PLANNING COMMISSION .MINUTES OCTOBER 2, .19 7 3 Comm. Hi ligoss made, the moti to concur with the recommendation of the Site Design Review Committee, with the exception of the last condition, which should be changed to read that artificial plants would be permitted but would be subject to .review after one year® If not acceptable after that time, live p.l_ants ,and irrigation would be required. Comm Mattei seconded the motion. AYES 5_ NOES 0 ABSENT 2 ENVIRONMENTAL IMPACT 1. Marvin L. Klebe - Continuation.of consideration QUESTIONNAIRE of a proposal for 4 small single,-family units to EVALUATIONS be placed on a. site together with an existing single- family dwelling and a duplex at 324, and �• 328.-,330 Vallejo Street: The Commission was reminded that the staff report had been presented at the last meeting and the density factor and.land use designation had discussed- at the Study Session regarding modi- fications to the General Plan, the EDP and the Mas ter Plan of Zoning on September 25, 1973. 'Other aspects of the development would be con - s- de re l at the time of site design review. Comm. Waters made the motion to direct the Acting 'Director of .Community Development to prepare and post a Negative Declaration for this project and Comm. Mattei seconded the motion. AYES 5 NOES 0 ABSENT 2 2. Lieb & Quaresma.- Continuation of Public,Hearing to consider the EIQ submitted in conjunction with a rezoning request from R -1 -6,500 District to C -0 District for approximately 13 acres located on the northeast corner of East Washington Street on Ely Boulevard: A short review of the proposed project was given by Mr. Gray. He also read a synopsis of the zo- ning history that had.been presented at the aforementioned Study Session on September 25, 1973. The Publi:c;Hearing was opened and the audience asked for comments. Richard•Lieb, representing the developers, spoke in favor of the project,�emphasizing that he felt more 1. open space could be put into the area with this development than with residential. development. .No other comments were offered from the audience and the Public Hearing was closed. Comm.•Mattei remarked that due to the fact that k the original plan for the property had been changed and that people had ,bought. homes' thinking that the general .area was R -1-6,5,00, that the deli lopment could have an impact on the environment. Comm. Waters made the motion to require the preparation of, an EIR in order to bring the full facts before the Commission to act upon the re;zbnng .request, and .Comm. Mattei• seconded the motion. Lieb & Qua'resma - Proposal for two office buildings to• be constructed at 1 Bodega Avenue in a C -O District: `The staff report was read which indicated no negative- comments received from the reviewing agencies. A short, discussion followed. Comm. Mattei made the motion to direct the Acting Director of Community Development to.pre- p re and post a Negative Declaration and Comm. Bond seconded the motion. AYES 5 NOES 0 ABSEI4T 2 DAVID' D. YOUNG,--Mr. Gray reminded the Commission that all of the basic USE PERMIT information, had been considered during the prior EIQ U "3 -7 3 ! and rezoning hearings regarding the proposed Young- stowne Mob.ilehome Park on North McDowell Blvd. Fie read the staff's "recommended conditions of approval and suggested adding an additional condition which would requirel the project to come back for Site ' Design Review committee and Commission consideration if -4- ETALUMA CITY PLAWNI_NG!. COMMISSION MINUTES OCTOFER 2, 1973 given an allocation. The Public Nearing was opened and Mr. John Stuber of the Murray: - McCormick Environmental Group took the floor representing the applicant. He stated that this project was in conformance with the existing !! zoning, the General Plan, and with the City and County code.s•with no exceptions or variances. Mr. Stuber added that all of the recommended conditions for approvalvere acceptable to the applicant. No other comments_ or questions were - raised from the audience and the Public Bearing was closed. Comm. Mattei referred to the condition of approval which stated that there would be no parking in the streets and wished to know how the applicant could abide by that restriction and where guests would park. Mr. Stuber referred to the plan which showed the areas set aside 'for two parking spaces, within the lots and he added the xe +creation area was adequate for any over- flow. Chairman Popp stated that'the residents must be informed that the "no parking in the street" condition existed and Mr. , Stuber agreed, adding that there was a separate trailer and boat storage "yard. Mr. Stuber was asked what the height of the fence was against the ,freeway and replied that it was a five foot berm and six foot fence on -both the freeway side and towards PG&E. Comm. Comm. Hilligoss made the motion to .approve the Use. Permit -with the twelve re-.commended conditions of approval. Comm. Bond se=conded the motion, however, he added that he objected to the requested usage but realized that if the Commission did not approve the project, the City Council would. AYES 3 NOES 2 ABSENT 2 Comm. Mattei wished to qualify his "No" vote by stating that he had voted against this development five different times and.did not feel that in all conscience he could switch. Chairman Popp informed the applicant that the Use Permit was granted. Plan of Zoning to make them consistent. He added -that an EIR was not necessary because these plans were already established through the public hearing process and the proposed modifications were only changes to make existing plans consistent. The Commissioners agreed to the requested hearing date. The Commissione:rs were.. asked: ..when...they. would ,prefer their annual dinner and November 10, 1973 was decided upon. n It was:. determined. to have the election of officers at the October 1.6, 1,973 meeting of the Planning Commission as the first item on the Agenda. Comm. Hilligoss.remarked about the condition of plants on Lakeville Street and was :told that the Zoning Enforcement Officer would' be requested to review the matter. 1 n Comm. Bond asked why the requirement for landscaping ad- jacent to the ice vending machine on Copeland Street had never been accomplished. Mr. Gray advised him that a number of letters had been written to Mr. Moran' and that he had recently been advised that.if he did not comply within. a certain time frame.that the power would be cut off from this machine. Mr. Gray also advised that the signing did not comply with approved plans. A short dis- cus followed and the Commission was informed that if no. action was taken by Mr. Moran before'the next Planning Commission meeting he would be asked to come in and answer to the Commission. Comm.. Bond questioned the erection of a fence on North Petaluma Blvd. by Mr. Amaral. Hie remarked that at the time Mr. Amaral's: warehouse site design was before the Commission it was stated that the north end of the develop - ment could be utilized for additional ,parking if necessary and now this area had been fenced off. Mr. Gray replied that the original site design 'was approved for the original fenced area and future "expansion around the area, and, therefore the appli- cant I then only needed a fence permit for the further expansion. Ald added that he had noticed a car with a "For Sale" sign parked outside of the fence and would ini- ti,ate action to check out the proper usage of this site J to determine it it was being used for more than a holding area for cars.
