Gray, Acting Director of Community Development APPROVAL OF'MINUTES: The,min'utes of November 20,.1973 were approved as • s ubm i t to d e - • CORRESPONDENCE: I Members of the Commission were advised of a work - shop /seminar on environmental management entitled Land Use - The Key to the Environment" to be held December 7, 1973 at the Flamingo Hotel in Santa Rosa® The programs were made available to inter - ested Commissioners and they were told to inform the Community Development Department if they wished to' attend. A short diseussion after which Comm. Waters made'the motion to send a letter opposing the requested variance to the Sonoma County Board of Zoning - Adjustments. Comm. Popp the motion. AYES 6 NOES 0 ABSENT 1 2) Ed Kozenko ­Use permit application for con - struction of -a garage and warehouse for ! storage of contractor's equipment at 2420 - Eastman Lanes The staff report ':was read which recommended - opposition to the.requested use permit since the proposed.garage could tend to.e.stablish a permanent commercial use in an agricultural • area. Discussion followed on the advantages of providing a storage area so that the pre- sent open storage of equipment could be put out,of sight versus the urbanizing influence in a rural area. Peta-luma di ty Planning December 1973 Commis'sion Minutes, Comm, Mattei made a motion to write a letter to the Sonoma County Board of Zoning Adjust- - ments - to recommend allowing the usage subject to annual review, and to also express the con - cern of the Commission regarding the urbani- zing Comm,. Popp seconded the -motion, AYES 3 NOES 2 ABSTAIN I ABSENT 1 The motion was ' defeated., Discussion followed after which the staff was instructed to forward a letter expressing the divided feelings of the Commission and the concern of preserving agricultural areas. BUSINESS: 1. Repo , rt on M & M Ice Vending Machine Company, Permit ermit U1 -73 revocation: Mr. Gray advised the Commission that Mr. Moran had met the of the Site Design Review, Committee-. The City Engineer had inspected the street improvements and had said it was sufficient. The landscaping had been in, the box had been painted, and the wooden sign put on it. Mr. Gray further advised the Commission they would have the opportunity to review the Use Permit again next April to see h.Qw the landscaping is being maintained, since the Use Permit is subject to annual review. He requested no further action until the annual review, and the Commission concurred. 2. Report on status of removal of signs at the rear of the Petaluma Plaza Shopping Center buildings: Mr. Gray advised the Commission that he had been in contact with the manager of the Petaluma Plaza and some of the tenants. These discussions had revealed that in order to repaint the signs there has to be a certain number of dry days as the concrete has to be dry to apply the paint. In addition, the temperature has to be 6"5' or over for the paint. adhere to the concrete. Mr. Gray informed the Commission that the tenants of the Petaluma Plaza have stated they would either paint over the signs at the first opportunity, with the possibility of it not covering or of it peeling off, but would -2- Petaluma City Planning Commission Minutes,. He ,added that the staff would prefer to have the job done properly, and ;he therefore recommended that the situation be corrected at the first opportunity, allowing proper weather conditions, Mr. dim Zurcher, of the Cinderella Boutique, addressed the Commission and stated they realized they were in violation of the Zoning Ordinance and would do either of the two :methods mentioned.by Mr.. Gray according to the wishes of the Commission. Fie added that -the ;painting would - be done at the'first - opportunity that the weather permitted. Mr. Zurcher informed the Board that he was the frost one to have the sign painted on the rear of. his building and Mr. Lewis Barber, who Painted the signs, and himself had referred - to the. old Zoning Ordinance in error and - determined that the - painting could be done. The contention of the Commission was that I Mr. Barber, being a,prcfessional who has ' operated in the City, for quite some time, should have been fully aware of the require- ments of the City •end therefore this type of action should not be conr3oned. Comm. Waters made the motion to tolerate the existence of the si.gns they could be removed and painted over properly in a reasonable time, and Comm. Be.11ovich seconded the 'motion. l .AYES 6 NOES 0 ABSENT 1 - Comm.; Balshaw asked i.f it could be documented that Mr. Lewis had been in the wrong in painting the signs. Mr. Gray replied that the-City Attorney hail ' advis'ed him- that the city Is legal respbnsibiility is with the owners-of the Petaluma Plaza and not with Mr. Barber directly, but since Mr. Barber has a business license with the City, a, copy of these minutes could be placed in his file for documentation. i 3. Report on Shell Oil Company's revolving.sign Street: on s Mr'.. 'Gray advised the Commission. he had been in contact with Mr. Stein of Shell Oil Company -3- Petaluma City Planning Commission Minutes, `December 4 ; , 1973 j. • And that Mr. Steln had turned off the rotating sign until the matter is resolved. Mr. Gray informed the Commission that the site design had been approved with a 12' x 12' sign which was allowed under the old zoning ordinance. When Mr. McGivern saw the sign on the site before it was erected he objected to its size, since the new zoning ordinance called for a maximum sign area of 1.00 sq.ft. According to Mr. Stein, Mr. McGivern had agreed that rather than put, up the 144 sq. ft. sign he would accept the type of sign that all of the other Shell Oil servi.de stations in Petaluma had, which is a 8' x :8' revolving sign. Mr. Gray stated he has contacted) Mr. McGivern -and he stated that he had not made this agreement® There is no documentation possessed by either Shell or the,City to say for certain what happened. Mr. Gray advised the Commission that they could either allow the sign to exist - until the year 1976, when all rotating signs in Petaluma must be made stationary, or make Shell Oil abide the conditions of the site design. It was suggested that a letter be written to Mr. Stein of Shell Oil Company saying that, ..inasmuch as Shell is a member of the community, it would be appreciated if the sign would not rotate, and that after January 17, 1976 it would be imperative that the sign not rotate. Comm. Balshaw made the motion to write this suggested "Letter-and Comm. Popp seconded the motion, AYES 6 NOES 0 ABSENT 1 ECOLOGIC RESOURCES : Mr. Gray advised the Commission that they were ELEMENT OFITHE requested to set a Public Hearing for December GENERAL PLAN: 18, .1973 to consider the Ebologic Resources Element of the General ' Plan and the City Council wo uld have their Public Hearing on January 7, He further advised the Commission that .. ,according to State law no building permits will be .. allowed after January 1, 1974 until this element has been approved. 'Mr. Gray gave a brief oral .introduction regarding the criteria to be covered in the new Ecologic Resources Element of the General Plan, The Commission agreed to set the Public Hearing for December 18, 1973. -4- Petal,*uma City Planning Commission Minutes, 1973 _D'ecemb'er OTHER BUSINESS: The ARCO sign located in the triangle on Lake- - ville H was briefly discussed. Mr. Gray advised the Commission that the Atlantic Richfield personnel had contacted him,and discussed a com- plete revision of their exis-ting service station; however, the EPA had recently stated that there would be no additions to,existing service stations and no new stations can be built. The company still intends to move 'the: sIqn from the triangle and lower it 8 feet, put in landscaping and additional paving around the existing service station. Cont"n. Mattei asked Mr. Gray if there was to be a toint study session regarding the proposed Sonoma County General Plan, as he felt it was quite important. Mr. Gray replied that he had not been able to get a copy of the plan himself as yet, but would request copies for the Commissioners and forward them in the next mailout. Comm. Mattei informed the Commission that December 1.1, 197-3 at 7:30 p.m. had.been.set to comply with the State ruling f disclosure of ss,sets. for the City Manager, the Planning Director, City Council and the Planning Commission to deter- mine if a conflict of interests exists The City Attorney will be present to brief everyone. Mr. Gray informed - the Commission that a meeting was being arranged for January 9, 1974 for the eight cities in Sonoma County to have ABAG present to inform them what their growth al- terhatives would mean to each of the individual eight cities in Sonoma County. All Planning -. Commissioners and City Qouhtil members would be asked to attend. Comm. Balshaw asked the status of the Bikeways Committee and Mr. Gray advised that the City was waiting for a draft report from Lampman & Associates, -5- s. r. Balshaw asked when the stud session re- garding the input for EIR's was to be held and Mr, Gray replied that he thought it advisable to wait until after the holidays and the Ecologic Resources Element completion, ADJOURNMENT: There being no fu' then business the meeting adjourned at 8 pm.
