DIRECTOR'S REPORT: An ordinance.was adopted by the City Council on
March 3, `1'980 to amend t Zoning `Ordinance to
! permit;laborat and research facilities in
a C -H., Highway Commercial Zone.
A legal-opinion was given by the City Attorney
on the J'ohn,Kosewic.Use Permit /Variance ;for a
second dwelling ,unit .at 8,26 D, Stre,et,. A decision
decided by the Supreme.. Court on_ July 9,19'79'
requires that individual notice be: given to affected
property owners ,within a reasonable.distance of a ,
proposed Use Permit location. The usual,standards
would ,be either posting the neighborhood "an question
or mailing notice to persons. within a 300 -foot• radius
of. the site:. Notice, by ,publication . would -ftbt.-be
adequate eider- 'the appl- ±cable principles. Because
of a failure ;to give, notice_ as ; required by :the U.S.
