QANTAS DEVELOPMENT 1, Public Hearing to consider the rezoning application
CORPORATION - PUD submitted by Qantas Development Corporation to
REZONING Z9 -76 & rezone approximately23.6 acres located on North
PARK PLACE SUBDIVISION McDowell Blvd.. from a Planned Community District -to
a Planned Unit District to construct the first phase
of the Park Place Subdivision.
2. Consideration of the Tentative Map for Unit 1 of
the Park Place for the construction of
100 single - family units.

CORRESPONDENCE: A letter was received from Sandra Way of 904 "I" Street express-
ing concern about the negative decision of the Planning Commis-
sion on the application of Thomas Sipes for a Use Permit to
operate a pre- school program on Cherry Street.
GRANT E. WARTENA - The proposal to convert a portion of an existing commercial

USE PERMIT U9 -76/ Grocery to include on -sale purchase of beer and wine, and the
SITE DESIGN REVIEW: remodeling of the exterior of the entire commercial building
located at 609 -617 East Washington Street was briefly reviewed.
The Public Hearing was opened to consider the Environmental
Impact Questionnaire. No comments were offered from the audience
and the Public Hearing was closed.
Comm. Popp moved to direct the Planning Director to prepare and
post a.Negative Declaration for the project. The motion was
seconded by Comm. Wright.

The Public Hearing was opened to consider the Use Permit. No
continents were offered from the audience and the Public Hearing
was closed.
Comm. Popp moved to grant the Use Permit to allow for on -sale
purchase of beer and wine in the delicatessen. The motion was
seconded by Comm. Head.

Comm. Waters moved to approve the site design for the proposed
project wi.th.conditions of approval as recommended by the staff
and concurred with by the Architectural & Site Design Review Com-
mittee. The motion was seconded by Comm. Wright.

QANTAS DEVELOPMENT The rezoning application submitted. by Qantas Development Corr
C0RP. PUD REZONING poration to rezone approximately 1.6 acres located on North
Z9 -76 /.SITE DESIGN McDowell Blvd,- from a Planned Community- District to a Planned
REVIEW /PARK PLACE Unit District for Phase I construction of the Park Place Subdi
SUBDIVISION'UNIT 1 vision was briefly reviewed.
TENTATIVE, MAP:
The Public Hearing was opened to.consider the proposed Planned
Unit District rezoning',. No comments were offered from the
audience and the Public.Hearing was closed.
Mr. Radial read the eight conditions of approval.for the PUD
rezoning as recommended by the staff. A discussion relating to
item #8 followed. This condition stipulated that a 5 -foot main -
tenance easement will,be required along and parallel to the zero
sideyard homes and extending on, the abutting property to allow
for ' owners to maintain their homes. Mr. Rachal stated
that as a condition of approval, the type of planting to be used
in this 5 -foot easement should possibly be specified. Comm.
Waters stated there were no windows on the.zero lot'lne wall
abutting this easement and property own'ers,c'ould. not be restricted
from planting= -for instance, shrubs in this area. Mr. Jon Joslyn,
of Qantas Development Corporation, added that lawns would be
planted right up to the walls and gages and adequate access would
be provided for these zero sideyard units.
Mr. Joslyn requested that a. variance be granted to provide that
16 -foot driveways be allowed throughout all of the various
zero sideyard homes. Comm. Waters stated that 16- -foot driveways '
were in violation of the Zoning Ordinance. Mr. Rachal stated
that the, staff was aware of the 20-foot' driveway -- requiremen : of
the Zoning Ordinance, but added that under the PUD' provisions of
the Ordinance,,_ the staff felt that 16 -foo;t driveways could be
permitted f:o .lots 'around the curvature ° of the cul -de =sacs 'where
frontages are 40 -feet, or less. This would' involve a total of 35
tots. Mr.. Rachial sand, to avoid having these curvilinear frontages
look like a -mass of concrete. A general discussion of the Com-
mission members followed. and the c.orlcensus,' of' opinion was to
allow all zero sideyard'homes with 16-fout driveways since the
remaining lots, with 20 -f,00t driveways, would also look like a
mass of concrete.
Mr. Radial :read the specific findings to be .made by the Planning
Commission, (Exhibit "B ") for the..approval of the PUD rezoning.
Mr,. Joslyn objected to Condition #1 of the City Engineer's recom-
mendation'whch s,pecif ied that Maria Drive constructed ;from
Lucchesi Park across Lynch Creek to:,a connection with the pro -
posed arterial (Sequoia A or the collector: street (Lassen
Street) extended from.Park Place Subdivision during Phase I. He
additionally requested that this condition be stricken from the
PUD Rezoning requirements Mr. Hall explained that the City
Engineer's recommendation was concerning a•re,quirement of the
Tentative Map, not the',PUD Rezoning. Mr. Rachal stated that for
the '' n requirement the proposed thoroughfares must be
compatibleand for the entire project and therefore.

about the traffic mitigation measures of the E.I.R., particularly
in relationship t'o the 'extension of Maria Street. He stated that
the City Engineer was, evidently attempting to alleviate these
traffic problems and prow "id`e for pedestrian access in the early
stages of the subdivision Process. Comm. Wright stated that the
traffic generated from'thist subdivision would utilize McDowell
Blvd. and not Maria Drive during the first phase of the devel-
opment.
Comm. Head moved to recommend approval of the requested PUD
rezoning to the City Council according to the specific findings
as stated in Exhibit "B ",' with the exclusion of item #1 of the
City Engineer's recommendation relative to the construction of
Maria Drive, and'that PUD condition of approval (item #4) in
the staff report be changed to -allow for 16 -foot driveways for
all zero sideyard homes. The motion -was seconded by Comm.
Waters.

The site design considerations for the Planned Unit Development
were discussed. Comm. Head moved to approve the site design for
the Planning Unit Development with conditions of approval as
modified by the staff and concurred with by the Architectural &
Site Design Review Committee. The motion was seconded by Comm.
Waters.

The recommended conditions of-approval as discussed by the Plan-
ning staff and the City Engineer for Phase I of the Tentative Map
regarding Park Place Subdivision were read by Mr. Rachal..
Mr. Joslyn stated that conditions #1 and #2 of the City Engineer's
recommendations were not reasonable requirements of the proposed
subdivision. He further stated that if the proposed hospital
plans are approved, then the bcye`le Paths would be more feasi-
ble. Comm. Wright stated that since McDowell Blvd. was a narrow
road, some means of a pedestrian walkway should be provided for
the first phase of development.
Comm. Wright moved to recommend approval of the Tentative Map for
Phase I of the Park Place Subdivision to the City Council with
the following changes to the conditions of approval as recom-
mended by the Planning staff and City Engineer:
1. Delete recommendation #1 of the City Engineer's .report.

2. Suspend item #2 of the City Eng- ineer's.report with the pro -
vision that upon completion of Phase. I, if a firm determi-
nation is not made concerning the proposed hospital relo-
cation adjacent to this property, the developer will be
required to'construct pedestrian pathways as specified in
item #2 of the City Engineer's Report.

3. Modify 'condit_io #3.of the Planning staff report reflecting a
10 -foot minimum sideyard fence setback (instead of 15 feet)
to provide adequate sight distance for certain quadraplot
lots which border-- the proposed afterial and collector streets-
4. Delete condition. #8. of the Planning staff report.
The motion was seconded by Comm: Waters.
