HomeMy WebLinkAboutResolution 97-268 10/06/1997 rv Resolution No. 97-26s N.C.S. 1 2 of the City of Petaluma, California 3 APPROVING THE PLANNED UNIT DEVELOPMENT PLAN FOR STONERIDGE a SUBDIVISION LOCATED ON 11.66 ACRES IN THE SUNNYSLOPE ASSESSMENT 5 DISTRICT AND ANNEXATION AREA; AP NO'S 019 203-001 AND 002 6 ~ WHEREAS, by Ordinance No. 2060 NCS ,Assessor Parcel Numbers 019-203-001, 8 002 comprising 11.66 acres, have been rezoned to PUD (Planned Unit Development);and 9 to WHEREAS, by action taken on August 26, 1997, the Planning commission considered t t and forwarded a recommendation to the City Council on the unit development .plan for t2 Stoneridge Subdivision, to allow development of 19 custom home detached single-family t3 lots; and 14 15 WHEREAS, the City Council finds that the requirements of the California Environmental 16 Quality Act (CEQA) have been satisfied through the preparation of an Initial Study and t~ adoption of Resolution No. 256 N.C.S., approving a Mitigated Negative Declaration 18 to address the specific impacts of the Stoneridge Subdivision development; 19 20 NOW THEREFORE, BE IT RESOLVED that the City Council hereby adopts the 21 following findings: 22 23 Findines for Approval of the PUD Development Plan and Standards 24 25 1. The proposed Stone Ridge project is proposed on property which has a suitable 26 relationship to one or more thoroughfares (Sunnyslope Road), and said 27 thoroughfare, togetherwith new public street and private driveway improvements 28 herein required, are adequate to carry any additional traffic generated by the 29 development. 30 31 2. The plan for the proposed Stone Ridge development presents a unified and 32 organized arrangement of buildings and service facilities which are appropriate in 33 relation to adjacent or nearby properties, and adequate public and pnvate area 3a landscaping and screening is included to ensure compatibility with surrounding 35 uses. 36 37 3. The natural and scenic qualities of the Stone Ridge site are protected, including the 38 Kelly Creek corridor; existing significant vegetation, the natural hillside 39 topography, riilgeline views, and low-density residential character of the 4o Sunnyslope area, with adequate public and private spaces designated on the PUD at Development Plan. az 43 4. The development of the Stone Ridge property in the manner proposed by the 44 applicants, and as conditioned, will not be detrimental to the public welfare, wdl be a5 in the .best interests of the City, and will be in keeping with the general intent and a6 spirit of the zoning regulations of the City of Petaluma, with the Petaluma General a~ Plan, with the Sunnyslope Assessment District and Annexation Area PUD Zoning, 48 and with other applicable plans adopted by the City. a9 1 R~ot„t;o„xo_ 97-268 x:cs. Dedications, and other Exactions 2 3 Pursuant to Section 66020 of the California Government Code, the applicant/developer 4 has the statutory right to protest development fees, dedication and reservation 5 requirements, and other exactions included in this project approval as follows (calculations 6 based upon 201ots): 7 8 - Community Facilities fees in the estimated amount of $805.00/unit 9 - Storm Drainage Impact fees in the estimated amount of $6,600.00 (total) to - Park and Recreation Land Improvement fees in the estimated amount of 1I $3,894.00/unit 12 - Traffic Mitigation fees in the estimated amount of $3,007.00/lot 13 - In-Lieu for Provision of Low Income Housing contribution in the estimated 14 amount of $2,400.00/lot IS 16 BE IT FURTHER RESOLVED that the Stoneridge Subdivision PUD Development Plan 17 as referred by the Planning Commission and presented at the September 15, 1997 and 18 October 6 , 1997 meetings of this Council is hereby approved pursuant to Section 19A- 19 504 of Zoning Ordinance No. 1072 N.C.S., as amended subject to the following notice 2n and conditions: 21 22 Conditions Tor PUD Approval 23 2a 1. All mitigation measures adopted in conjunction with approval of the Mitigated 25 Negative Declaration for the Stone Ridge project are incorporated herein by 26 reference as conditions of project approval. 27 2s 2. All conditions of the Tentative Subdivision Map approved for the Stone .Ridge z9 project are incorporated herein by reference, and shall be enforced as applicable 30 with the PUD Development Plan. 31 32 3. All requirements of the Planning Department shall be met including: 33 34 a. The PUD Development Standards shall be amended to include the 35 following provisions and all text amendments required under the adopted 36 mitigation measures for the project, with the final content -and composition of the 37 document subject to SPARC approval prior to Final Map application: 38 39 1. The title of the document shall be amended to reflect "PUD 40 Development Standards for the Stone Ridge Subdivision." References to 41 "guidelines" within the document shall be modified accordingly. 42 a3 2. The document shall be modified to incorporate permitted uses 44 consistent with the R-1 20,000 Zoning District, provisions for ,accessory as uses, and a reference to other governing documents including the City 46 Council Resolutions approving the Mitigated Negative Declaration, PUD 47 Development Plan and Standards, and the Tentative Subdivision Map, as as well as all SPARC approvals for the project. 49 50 3. The last sentence in Section I p. 1 pertaining to conflict in 51 regulations shall be deleted. A statement. shall be incorporated specifying 2 Reso. 97-268 NCS Page 2 of 4 I "uses not specified herein shall be subject to determination by the City of 2 Petaluma Planning Director as applicable to the R-1, 20,000 Zoning 3 District." 4 5 4. Section II shall be amended to reflect applicability of administrative 6 SPARC review for all lots identified under the adopted mitigation 7 measures. 8 9 5. Section IIIa. shall be amended to reflect underfloor height to restrictions pursuant to adopted mitigation measures, and all other adopted 11 conditions/mitigations pertaining to grading of the site. 12 13 6. Section IIIb. shall be amended to reflect consistency with tree 14 protection measures identified in the arborist report for the project and 15 ,adopted mitigation measures. 16 17 7. Section IIIh. shall be amended to incorporate reference to City I8 noise ordinance regulations. 19 20 8. Section IIIn. shall be amended to read "Rear entry garages shall be 21 encouraged where possible, particularly on flag lots and on lots adjacent to 22 flag lots." 23 2a 9. Section IVa. shall be amended to require submittal of landscape 25 and ircigation plans for all lots in conjunction with administrative 26 SPARC/building permit review as appropriate. 27 28 10. Section ] Vd. shall be deleted. 29 30 11. Sections IVe. and IVi. shall be amended to reflect consistency with 31 adopted mitigation measures pertaining to tree removal. 32 33 12. Sections IVf. and IVg. shall be amended to reflect consistency with 34 adopted mitigation measures pertaining to installation and maintenance of 35 public area landscaping. 36 37 13. Section IVh. shall be amended to delete the sentence "Irrigation 38 shall cover a maximum of 20% of the area under existing trees and 39 drip systems are encouraged." ao 41 14. Section Va. shall be amended to specify that fencing shall be az installed per City -approved plans and that lattice or trellising 43 may be installed to provide additional screening to a maximum as total height of 7.5'. A fence detail shall be incorporated for a5 reference. 46 a7 15. Section VI. shall be modified to incorporate criteria for 48 administrative SPARC/building permit review pursuant to adopted 49 mitigation measures. 50 51 16. Section VIL. shall be amended to permit accessory dwellings on all 52 lots as a conditional use, pursuant to applicable Zoning Ordinance 3 Reso. 97-268 NCS Page 3 of 4 I provisions, and to permit garage conversions subjectto replacement of 2 required off-street parking. 3 a b. The PUD Development Plan shall be amended prior to SPARC approval 5 to reflect the following: 6 7 1. All conditions of the Tentative Map applicable to the Development 8 Plan shall be consistently reflected. 9 to 2. Lot configurations, private driveway design and building t I envelopes shall be modified as necessary to meet mitigation t2 measures pertaining to Fire access requirements 13 la 3. The boundaries of the open space easement required on Lot 1 shall 15 be reflected on the PUD Plan as specified in the adopted mitigation 16 measures. l7 18 4. Landscape plans shall be amended to incorporate street frontage 19 landscaping for all right-of--way areas, and all mitigation plantings 20 proposed within the open space easement. Plans shall be subject to 21 SPARC approval in conjunction with review of the PLTD 22 development Plan. 23 2a 5. Setbacks for existing structures to be retained shall be specified on 25 the P[JD Development Plan, and a reference to applicability ofR-1 26 20,000 Zoning District provisions shall be incorporated for all lots 27 where specific building envelopes are not proposed/required. 28 29 c. All proposed building envelopes shall be subject to SPARC review and 3v approval in conjunction with review of the P[JD Development Plan and 31 Standards and s~/rall generally reflect the modified building envelope plan 32 recommended by the Planning Commission at their August 26, 1997 33 meeting.. 34 35 d. Except for Lnts 77 aric(IS, al/side rnrd rear yard fencing shall be open 36 wire (genernlly he}pond the building em~elope) with emphasis on 37 retaining open i~ieirs; design and finest location shall be subject to review 38 and approval of SPARC. 39 a0 e. Houses on Lots 1 rnrd 4 shall be oriented to front onto Sunnyslope Road. 4l Under the power and autbority conferred upon this Council by the Charter of said City.
