Authorizing the City Manager to Execute All Documents Necessary to Complete
the Purchase
RECOMMENDATION
It is recommended that the City Council adopt the attached Resolution Authorizing the Purchase
of Fifty-four Sig Sauer M400 Rifles and other Associated Equipment in an Amount Not to
Exceed $79,439.76 and Authorizing the City Manager to Execute all Documents Necessary to
Complete the Purchase.
BACKGROUND
The proposed action is for the replacement and addition to existing Police Department Patrol
Rifles. Currently the Police Department has eight patrol rifles that were purchased over fifteen
years ago. In addition, the Police Department also has an additional eight patrol rifles acquired
through the Law Enforcement Support Office (LESO) 1033 Program. These rifles were military
surplus and over twenty-five years old when they were acquired, both of which require
replacement.
Currently the Police Department is funded for sixty-six sworn personnel. The Patrol Division has
forty-nine of these positions assigned to uniformed patrol. The Patrol Division is comprised of
two patrol lieutenants, six sergeants and forty-one officers. In addition, the Investigations Team
has one sergeant and five detectives. The Traffic Team also has one sergeant and six officers
assigned to uniformed traffic safety duties. There are also four other sworn positions assigned to
Administration, including two lieutenants, the Deputy Chief, and the Police Chief.
In 2019 the Police Department submitted a Grant Application to the Edward Byrne Memorial
Justice Assistance Grant Program and in September was awarded $15,857.00. This amount will
allow the Police Department to purchase ten replacement patrol rifles. The purchase of these
fifty-four rifles, in addition to the ten purchased through the Edward Byrne Grant, will allow the
Police Department to equip each patrol officer, sergeant, detective, traffic officer and all sworn
members of administration with a personally assigned dependable patrol rifle that has become
standard issued equipment in law enforcement.
Patrol rifles have been steadily increasing in their deployment among police agencies throughout
the country. The Petaluma Police Department has had patrol rifles in the Patrol Division since
1999. In 1999, public outreach was performed to make the community aware of equipping patrol
officers with rifles and the importance of this safety equipment. Since the implementation of
rifles at the Police Department, a Patrol Rifle Policy has been adopted and continuously updated
to reflect the latest in Federal and State Law, in addition to best practices for training and
deployment. This also includes the appropriate situations in which the rifles may be deployed
and the proper way the rifle is to be transported and stored in a patrol vehicle. The Petaluma
Police Department has rifle instructors certified by the Peace Officers Standards and Training
(P.O.S.T.). Additionally, in 2018 the Police Department became certified with P.O.S.T with
providing a Certified Patrol Rifle Course, enabling the Police Department to train each of its
officers in the proper use and deployment of patrol rifles without the need to send officers to
other locations for this training. This also includes ongoing training for officers who have
become P.O.S.T. certified in the proper use and deployment of patrol rifles.
When the Police Department began authorizing patrol rifles in 1999, sworn personnel purchased
their own rifles. Except for the sixteen Police Department owned patrol rifles, most sworn
personnel are still purchasing and carrying their own rifles to ensure they are able to carry a vital
piece of equipment while on -duty. With patrol rifles becoming standard operating equipment for
law enforcement, this equipment needs to be departmentally issued to sworn personnel. The
purchase of these patrol rifles will not only provide our sworn personnel with required equipment
but will also ensure the standardization of the patrol rifles deployed within the City of Petaluma.
While there has been debate on the militarization of municipal police departments and concern
over equipment issued to its personnel, law enforcement in the United States has increasingly
responded to incidents involving citizens armed with equally powerful rifles. While Petaluma
Police Department officers are equipped with department handguns it is important to understand
that handguns of all calibers are simply a defensive weapon and not suitable as an offensive
weapon when facing an adversary carrying a similar firearm or rifle.
It is imperative that police officers be equipped with rifles that not only will provide them with
the ability to defend themselves but also stop threats to the community it serves. These threats
are increasingly occurring at businesses, schools and large community gatherings. In addition to
several large businesses in City, we have three high schools, three alternative high schools,
fourteen junior high and elementary schools, and we are host to numerous community events.
Three of these events include the Butter and Egg Day Parade, Veterans Day Parade, and Cruisin
the Boulevard Car Show. These events annually draw crowds in excess of 100,000 people
collectively. Large event gatherings such as these have become increasingly targeted with
violence necessitating the need for properly equipping police personnel with appropriate
equipment such as patrol rifles to protect the community.
DISCUSSION
The rifles currently owned by the Police Department are at a minimum fifteen years old. They
are used routinely for department training and have conservatively had over 10,000 rounds of
ammunition fired through them. The prior military surplus rifles, procured through the 1033
Program, have had significantly more use. All of the rifles are beyond their useful life based on
their age and the number of rounds fired through them and should be replaced.
The cost of the patrol rifles and the needed accessories warranted a formal Request for Proposal
(RFP) public bid, in accordance with the City of Petaluma Municipal Code Chapter 4.04. The
Petaluma Police Department released the RFP on February 18, 2020 and it closed on March 10,
2020. The lowest bid was from Proforce Police Products in the amount of $79,439.76. Adamson
Police Products bid was $82,047.48, and LC Action was $94,909.88. Please refer to the attached
quotes for details of the price of the Sig Sauer M400 Rifles and associated equipment.
FINANCIAL IMPACTS
The total cost for the fifty-four Sig Sauer M400 Rifles is $79,439.76 including taxes and fees.
Sufficient budget exists within the FY 20 Police Department cost center to cover this purchase.
The Police Department originally was going to seek funding for sixty-four rifles. Through
researching available grant funding, the Police Department was able to obtain ten of the sixty-
four rifles through grant funding from the Fiscal Year 2019 Edward Byrne Memorial Justice
Assistant Program. This grant funded $15,416.86 for ten Sig Sauer M400 Rifles and associated
equipment.

WHEREAS, the City of Petaluma Police Department has identified a need to replace existing
patrol rifles and purchase additional rifles and proposes to purchase Fifty-four Sig Sauer M400
Rifles; and
WHEREAS, the City of Petaluma Police Department desires to purchase fifty-four Sig Sauer
M400 Rifles and associated equipment to enhance the safety of its officers and the community
they serve; and
WHEREAS, the Petaluma Police Department has standardized Patrol Rifles to maximize
operability, reliability, and cost in training; and
WHEREAS, the Sig Sauer M400 Rifle has been selected as the rifle best suited for the needs of
the Petaluma Police Department; and
WHEREAS, the Petaluma Police Department obtained the quotes through a formal RFP process
in accordance with the City of Petaluma Municipal Code 4.04; and
NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL HEREBY:
(1) Approves the purchase of Fifty-four Sig Sauer M400 Rifles and associated equipment in
an amount not to exceed $79,439.76; and
(2) Authorizes the City Manager, or his designee, to execute any necessary agreements and
documents to complete the purchase of the vehicles and related equipment.

PART 1- INTRODUCTION
The City of Petaluma ("the City") is seeking through this Request for Proposals (RFP)
bids for The Petaluma Police Department Patrol Rifles and Accessories
Procurement.
The overall objective of this RFP is to find a highly qualified and licensed vendor to
provide a complete proposal for all specific equipment set forth in this RFP.
This bid provides for the procurement of Fifty -Four (54) Patrol Rifles (AR -95 style) along
with several standard rifle accessories. Full details are provided in Part 6 of this RFP.
The awarded vendor will be required to enter into a contract with the City of Petaluma.
The insurance requirements are listed at the end of this RFP labeled Exhibit B.
PART 2 -BACKGROUND
Currently the Police Department is funded for 72 sworn personnel. 44 of these positions
are assigned to patrol. There are 2 patrol lieutenants, 6 sergeants and 36 officers
assigned to patrol. In addition, the Investigations Unit has 1 sergeant and 5 detectives.
The Traffic Unit also has 1 sergeant and 5 officers assigned to it. There are currently 2
School Resource Officers assigned to Petaluma High Schools.
The objective is for the replacement and addition to existing Petaluma Police
Department Patrol Rifles. Currently the Police Department has 8 patrol rifles that were
purchased over 15 years ago. In addition, the Police Department also has 8 patrol rifles
acquired through the Law Enforcement Support Office (LESO) 1033 Program. These
rifles were military surplus and over 25 years old. Both the purchased rifles and rifles
acquired through the 1033 Program are antiquated and need replacement.

PART 3 -RFP SCHEDULE AND PROCESS
Request for Proposal Published: Tuesday February 18, 2020
Questions may be asked via email by sending them to Police Department Management
Analyst Kate McCoy at: kmccov(a-)citvofpetaluma.orq. All questions are due March 4,
2020, no later than 4 pm. All questions are to be asked via email, phone queries will
not receive a response.
All proposals must be sealed, and clearly labeled "Public Bid" and are due Tuesday,
March 10, 2020 by 3:OOpm. All sealed bids will be publicly opened at City Hall at that
time. Complete paper copies of the proposal are required and will be delivered to:

Fax submissions will not be accepted.
Any proposal not delivered by 3:OOpm on Tuesday, March 10, 2020 will be disqualified.
A team has been selected by the Chief of Police to evaluate the proposals submitted.
Proposals will be evaluated by the designated evaluation team.
All proposals will be public records upon conclusion of the evaluation process at the
point in time when the Chief of Police is prepared to recommend award of a contract by
the City Manager.
PART 4 -DEFINITIONS

City- is defined as the City of Petaluma, a municipal government.
Vendor- is defined as an entity that meets the requirements listed under minimum
qualifications.
Bidder- is defined as the entity responding and applying for this solicitation.
PART 5 -PREPARATION AND REQUIREMENTS OF BIDS
The intent of the City is to seek a Vendor to provide a complete proposal for the listed
equipment in the appropriate quantities. The Petaluma Police Department requires the
equipment meet ALL the specifications listed in Part 6 of this RFP. The Petaluma Police
Department requires the bidder to fill out the attached price sheet.
Bidders are expected to examine specifications and instructions. Failure to do so will be
at the bidder's risk.
Bids that are incomplete or do not meet the City of Petaluma's specifications may be
rejected.
Responsible Bidder: The contract will be awarded to the responsible bidder whose
proposal is determined to be most advantageous to the City, based on the evaluation
criteria set forth in the RFP.
Cancellation: The RFP may be cancelled by the City of Petaluma at any time for any
reason. Any proposal received may be rejected in whole or in part when in the best
interest of the City of Petaluma.
Receipt of Proposal: It is solely the responsibility of the bidder to assure the timely
receipt of its proposal at the location indicated in the bid announcement. Late proposals
will not be accepted.
Vendor's Representations: Each vendor/bidder, by submitting a proposal, represents
that they have read and understood the RFP documents and has submitted their
proposal in accordance therewith; and that the proposal has been submitted by a duly
authorized representative of that vendor.

It is required that only new, high-quality, industrial grade, rigorously proven equipment is
provided for all aspects of this project. No end of life, repaired, rehabilitated,
refurbished or other inferior equipment will be accepted.

PART 7 -MINIMUM VENDOR QUALIFICATIONS
Bidders/Vendors must meet the following minimum qualification in order to be
considered responsive and assessed in the evaluation process. Any submitted proposal
that does not demonstrate that the Vendor meets these minimum qualifications, may be
considered non-responsive and will not be evaluated nor eligible for award.
Bidders/Vendors are required to have the necessary federal licensing in order to sell or
manufacture NFA restricted firearms.
The City of Petaluma requires the awarded vendor to enter into a contract with the City
of Petaluma.
PART 8- SELECTION PROCESS
An evaluation committee will be selected by the Chief of Police. After the bids are
evaluated, the top-rated bidders may be invited to make a presentation, if deemed
necessary.
The evaluation and award of this bid shall be based on a combination of factors
including but not limited to the following: price, completeness of proposal, i.e., the

degree to which it responds to all requirements and request for information contained
herein, vendor's demonstrated capabilities and qualification, compliance with the City of
Petaluma's specifications and any other factors considered to be in the City's best
interest.

with procurement specifications, free of damage, and properly invoiced.
