RESOLUTION OF THE CITY OF PETALUMA CITY COUNCIL APPROVING A
ONE-YEAR TIME EXTENSION FOR THE PINNACLE RIDGE TENTATIVE
SUBDIVISION MAP, A 11 -LOT SINGLE-FAMILY RESIDENTIAL SUBDIVISION
LOCATED AT 2762 I STREET
PROJECT FILE NO. 05-ZOA-0029-CR & PLET-19-0004
WHEREAS, Pinnacle Development Number 21 L.P. applied to subdivide a 16.36 acre
parcel at 2762 I Street into an 11 -unit single-family subdivision that includes the creation of a
6.32 -acre Urban Separator parcel to be dedicated to the City of Petaluma ("the Project"), and to
amend the Planned Unit District ("PUD") zoning designation of the site from Westridge Units 4
& 5 to the Pinnacle Ridge PUD; and
WHEREAS, on December 8, 2008, in compliance with the California Environmental
Quality Act ("CEQA"), 14 California Code of Regulations Sections 15000 et seq. ("CEQA
Guidelines") and the City of Petaluma Environmental Guidelines, the City Council adopted
Resolution No. 2008-224, N.C.S., approving a Mitigated Negative Declaration of environmental
effect for the Project; and
WHEREAS, on December 8, 2008 the City Council adopted Ordinance No. 2319
N.C.S., amending the Planned Unit District ("PUD") zoning designation, including the unit
development plan and development standards for the Pinnacle Ridge Subdivision project, and
Resolution No. 2008-225, N.C.S., approving the Pinnacle Ridge Tentative Subdivision Map for
an 11 -lot single-family subdivision that includes the creation of a 6.32 -acre Urban Separator
parcel to be dedicated to the City, all of which became effective on April 2, 2009, thirty (30)
days after the March 2, 2009 Ordinance adoption date; and
WHEREAS, the Pinnacle Ridge Tentative Subdivision Map, pursuant to the Petaluma
Subdivision Ordinance, Petaluma Municipal Code Title 20, Section 20.24.010, has an initial life
of two years to April 2, 2011; and
WHEREAS, the Pinnacle Ridge Tentative Subdivision Map, pursuant to the California
Government Code sections 66452.21 — 24, qualified for three recession -related Automatic State
Extensions, which extended the expiration of the Pinnacle Ridge Tentative Subdivision Map to
April 2, 2017; and
WHEREAS, in 2014, Pinnacle Development Number 21 L.P. filed for a Final
Subdivision Map (FSM) application, which, as the cost of public improvements outside the
property boundaries was calculated to exceed $236,790, pursuant to California Government
Code 66452.6(a)l, automatically extended the TSM for three additional years to April 2, 2020;
and
WHEREAS, on August 22, 2019, Steve Lafranchi, representing current property owner
Kent Spellman, applied for a time extension of the Pinnacle Ridge Tentative Subdivision Map,
pursuant to the California Subdivision Map Act, Government Code Section 66452.6(e); and
WHEREAS, submittal of the requested time extension automatically extended the TSM
to June 2, 2020 while the extension was being considered by the City Council; and

WHEREAS, Government Code Section 66452.6(e) provides that the local jurisdiction
may approve TSM extension up to six years; and
WHEREAS, the automatic extensions provided by the State of California do not reduce
extensions that may be considered by the local jurisdiction as outlined in Government Code
Section 66452.6(e); and
WHEREAS, the City Council has discretion to approve Tentative Subdivision Maps
pursuant to the City of Petaluma Subdivision Ordinance and therefore has discretion to approve
extensions consistent with Government Code Section 66452.6(e); and
WHEREAS, the City Council considered the time extension request at a duly noticed
public meeting on May 18, 2020 and including the associated staff report; and
WHEREAS, the City Council found no new evidence indicating that the development of
the project as conditioned would place the residents of the subdivision or the community or both
in a condition dangerous to their health and safety so as to require additional or modified
Tentative Subdivision Map conditions; and
WHEREAS, the City Council found no significant change to existing land use
regulations for the project site since the original TSM was approved or to necessitate changes to
the TSM conditions fiom those originally approved with the project; and
WHEREAS, appropriate environmental analysis was completed and Resolution No.
2008-224 N.C.S. was approved by the City Council with the original TSM approving a project
level Mitigated Negative Declaration, no changes are proposed to the project from what was
approved, and therefore no additional environmental review is required.
NOW, THEREFORE, BE IT RESOLVED by the Petaluma City Council as follows:
1. A one-year time extension for the Pinnacle Ridge Subdivision is approved based on
the above recitals and with a new expiration date of April 2, 2021; and
2. All findings, conditions, and mitigation measures of the original project approval,
including those adopted by Resolution Nos. 2008-224 N.C.S. and 2008-225 N.C.S.
shall continue to apply to the project.
