3 RESOLUTION INITIATING PROCEEDINGS
5 MC NEAR LANDING LANDSCAPE MAINTENANCE DISTRICT
6 (Pursuant to the Landscaping and Lighting Act of 1972)
9 The City Council of the City of Petaluma resolves:
l0 1. The City Council proposes to form an assessment district pursuant to the
t t Landscaping and Lighting Act of 1972 (Section 22500 and following, Streets and
t2 Highways Code) for the purpose of the following improvements:
13 The maintenance of all the public landscaping improvements as part of
14 "McNear Landing Subdivision" consisting of plant material, trees,
15 irrigation systems and pathways located in two public areas. One are on
16 Petaluma Boulevard South beginning on-the northern most property line of
t7 the McNear Landing Subdivision behind curb east to the right-of--way line
1s including behind sidewalk, south to the northern entrance of McNear
t9 Circle. This includesthe turf panel at the southern corner of the northern
20 entrance of McNear Circle and includes the area south of the southern
2l entrance of McNear Circle, behind curb to the right-of--way line including
22 behind sidewalk to the southern most property line of McNear Landing
z3 Subdivision. It also includes three medians, one at the northern entrance of
2a McNear Circle and Petaluma Boulevard South, one at the southern
25 entrance of McNear Circle and Petaluma Boulevard South and one in the
z6 center of Petaluma Boulevard South at the intersection of the northern
27 entrance of McNear Circle. The other public area is referred to as "River
2s Walk" which extends along the Petaluma River from the northern property
29 line of the McNear Landing Subdivision, between the Petaluma river west
3o to the right-of--way line, south adjacent to the River Park, south to the
31 southern property line of McNear Landing Subdivision, including both
32 sides of the pathway.

2 2. The proposed assessment district shall be designated McNear Landing
3 Landscape Maintenance District, City of Petaluma, Sonoma County, California, and shall
4 include the land shown on the map designated "Assessment Diagram, McNear Landing
5 Landscape Maintenance District, City of Petaluma, Sonoma County, California" which
6 map is on file with the City Clerk and is hereby approved.

s 3. Tom Hargis, Director of Engineering, is hereby designated engineer for the
9 purpose of these formation proceedings. The City Council hereby directs the engineer to
l0 prepare and file with the City Clerk a report in accordance with Article 4 of Chapter 1 of
11 the Landscape and Lighting Act of 1972.
