Brunner, Koenitzer, Perry, Styles, Stanley. ABSENT: None. APPROVAL OF MINUTES - The minutes for the meeting of July 1, 1969 were approved as submitted. STAFF: Andy Anderson, Assistant�Planning Director. Hal Wood, Assistant City Engineer. Chairman Stanley welcomed Robert Brunner as a member of the Plan- ning Commission. CORRESPONDENCE Mr. Anderson read a letter fromiWilliam Foster of Bundesen Realty, registering a complaint regarding the general appearance of the Lei- sure Lake Mobilehome Park and that�several local subdividers are using their sales offices, located in model homes, to conduct gen- eral real estate brokerage offices. Mr. Alan Borgia, Assistant Manager of Leisure Lake Park, read a reply from Mr. Oeorge'des disclaiming the accusation. Chairman Stanley =- requested that Mr. Geor.gedes' send a formal letter to the Commission for the records and directed the staff to send a copy of it to Mr. Foster. Chairman Stanley further stated that Mr. Foster's complaint rela- tive to business being conducted in,isubdivision offices would have to be more specific before the Commission could act on it. Planning Commission Minutes July 15 1969 by Mr. Anderson, stated that the subject property was annexed•to the City as a portion of the Nella No. 2 Annexation and recommended that the rezoning also include 4 other properties which were annexed at the same time. Col. Waters,:,. President of the East Petaluma Civic Association "stated that they did.not wish to�ob to the rezoning, but that they did object,to the sign which advertises homes selling for $17,460 because they believed it would turn the area into a shack village. Mr. Ron Simp- kins, Engineer for the developers of Valley Green Subdivision to be located within the area under consideration for rezoning, spoke on behalf of the request. Chairman Stanley closed the public hear- ing. Res. Z8 -69, approving the entire area speci- fied in the staff report, was introduced by Comm. Styles, seconded by Comm. Perry and passed unani- mously. REZONING Inc. to rezone a portion of A.P. 5 - 040 - (loca- FILE Z9 =69 tion of Sonoma Vista Subdivision, Unit One) from an "A" (Agricultural) Zone to an R - 1 - 6,000 Zone or District. A' staff report was pre- sented by Mr. Anderson. No opposition was voiced and Chairman Stanley closed the public hearing. Res. Z9 -69 approving the subject rezoning was in- troduced by Comm. Koenitzer, seconded by Comm. Perry and passed unanimously. FINAL MAPS FOR At this time, Mr. Anderson read correspondence SONOMA VISTA #1 & from MacKay & Somps, the City Engineer, and the VALLEY GREEN #1 City Attorney, relative to action on final maps for the subjectisubdivisions. Both subdivisions are located within the area which was considered for rezoning by!the Commission this date. Mr. Ron Simpkins, Engineer for both developers, re- quested that the final maps be reviewed by the '` Planning Commission at their meeting of August 5, 1969 (provided that the City Council approves the rezonings at their meeting on August 4th, 1969) although the final maps would not be signed by the Chairman until the rezonings become effective (approximately Sept. 3, 1969). The request was 'granted. -2- h Planning Commission Minutes July 15,,. 1969' RON HARDY The Commission considered the variance request VARIANCE (and site design for a proposed four (4) unit V12-69 & apartment building) filed by Ron Hardy to allow SITE DESIGN a reduction in required sideyard from eight (8) FILE 5.132 feet to six (6)'feet for a stairway and landing for the second floor entrances and an attached carport and - to allow the subject multiple resi- dential site toibe de eloped with no usable open space as defined by the Zoning Ordinance, but with private balconies or patios for each unit and an open area adjacent to the rear entrances of the ground floor units, as shown on Exhibit "A ". 9he build ng will be located at 418 Ken- tucky Street in °an R -M -1500 Zone or District. A favorable staff report was presented by Mr. Anderson. Mr. Lewis Evans, residing at 422 Kentucky Street, voiced opposition to granting the variance to,allow the required sideyard from 8 feet to 6 feet for the stairway and landing. (Mr. Anderson pointed out that if the stairway and landing were oriented toward the back, the building could be located as close as five (5) feet to the property line .) Mr. Rebizzo, 410 Kentucky Street, also spoke in opposition to the requested variance, It was . his opinion that it should be possible to de- sign a 4 unit building on the parcel without requiring any variances since, according to the area requirements of the Zoning Ordinance, the site is large enough to accommodate a 5 unit building. Mr. Ron Hardy, applicant, stated that it would be possible to redesign the apart- ment structure to meet the requirements of the Zoning Ordinance, but it would result in con - structing a 3 -story building, without carports, and with off- street parking in front of the building behind the front setback"area. It was his opinion ;that the present pl`'ans were more desirable for everyone concerned. After further discussion, a motion approving the requested var- iances, was introduced by Comm. Brunner, seconded by Comm. Styles and passed by the following vote: Ayes: Brunner, Styles, Stanley. Noes: Perry, Koenitzer. A motion, approving site design as shown on Exhibit "A ", and with the conditions%outli.ned in the staff report, was introduced by Comm. Koenitzer, seconded by Comm. Perry and passed by all members present, (Mr. Hardy voiced no opposition to req- iii -3- ` Planning °Commission Minutes July 15,: 1 -969 BRAZTLL PARCEL Chairman Stanley stated than an appeal had been Y MAP APPEAL filed by Mr. Joseph Brazill regarding the re- quirements set forth by the Subdivision Commit - tee as a condition of approval for the parcel map .filed by him for property located on Schu- man Lane. Mr. Stanley was of the opinion that the Commission should deny the appeal (since these were requirements imposed by the City En- gineer because of City Council policy) so that Mr. Brazill could go directly to the City Coun- cil with his objections. However, Mr. R. Brazill, Civil Engineer representing the applicant (father) requested to voice his objections since he felt it was definitely a matter of planning. Mr. Brazill stated that the requirement to install public improvements along the front of the sub- ject property would depreciate it. He did not feel there would be any assurance that the City would improve the rest of Schuman Lane, or, if they do, that it could be done within a reason- able length of time and without imposing an un- warranted burden on property owners. The appli- cant stated he was in receipt of a petition signed by the people in the area stating that they are not in favor of any street improvements on the south side of Schuman Lane because they wish -to . _retain the rural character of the area. Dr. O'Shea, 855 Schuman Lane,also spoke in opposition to street improvements along Schuman Lane., Hal Wood, Assistant City Engineer, stated that other developers in the area are being required to in- stall said improvements and that Schuman Lane is a public street, used by the public travelling from Paula Lane and E.1m,Drive and must be safe. After further consideration, a motion,upholding the Subdivision Committee's requirements and denying the appeal, was. made by Comm. Perry, seconded by Comm. Koentzer and passed by the following vote: Ayes: Brunner, Koenitzer, Perry. Noes: Styles, Stanley. SERVICE ;STATION Chairman Stanley sett. August 19th as the date for AMENDMENT the public hearing to consider amending the Ser- vice Station Ordinance to provide for exceptions regarding the spacing of service stations at Freeway Interchanges. -4- f Planning Commission Minutes July 15, 1969 GENERAL The continued public hearing to consider updating PLAN REVIEW the Petaluma Area General Plan was held at this FILE 20 -69 time. Mr. Norman Van Bebber, representing'a special study committee, made up'of five directors from the Greater- Petaluma Area Chamber of Commerce,, presented the Committee's findings. (A copy of said findings in on file with the Planning'Depart- ment). Mr. Ron Simpkins, 175 Pepper Lane, also presented recommendations for changes to the eral Plan. The following recommendations were made: 1. Balanced growth for the City which would necessitate providing utilities to areas on the.west side not served now. 2. Airport site location - the necessity for a further study regarding a municipal air- port if airport facilities are to be pro - tected from encroachment of residential development, 3. Necessity for Storm Drain Master Plan.. 4. Investigate derelict hands for possible parks apd open space. 5. Traffic route review. (The Chamber was of the opinion that the Corona Road - Skillman Lane bypass affords the best alignment for coast: - traffic.) 6. Mr. Simpkins believed precise plan lines should be considered for the Petaluma -Napa Expressway, with early contact and coordi- nation between the'City and the Division of Highways. 7. Establishment of transitional zones to allow for new development while at the same time protecting old established uses. Following a'lengthy discussion by the Commission, Mr. Simpkins and Mr. Van Bebber, Chairman Stanley closed the public hearing. Comm. Styles and Chairman Stanley were both of the opinion that the changes recommended by the staff did not war- rant any revision to the General Plan because the changes set forth involved precising the Plan. A study session to review all recommendations was set for August 29, 1969. -5- r =, Planning Commission Minutes July 15, 1969 ADJOURNMENT There being no further business to come before the Commission, the meeting was adjourned.
