The owner stated he will paint the fence and do other things re- quited by the permit. lan Stack 815 Wilson Street - Mr. Stack has complied with all of`the of approval stated in the use permit. A letter has been written to Mr. Stack expressing concern over the cars and trucks being parked across the street and informing him in order to provide the parking area across the street, another use permit must be granted. Mr,,Stack•was advised to contact the Planning Director in order to work out some kind of program for this parking lot. Peery voting no PAGE 3 PETALUMA PLANNING COMMISSION MINUTES - AUGUST 5, 196 PAGE FOUR SONOMA VISTA UNIT ONE FINAL MAP FILE 23 -69 The Planning Commission considered the final map,filed:by Perma = Bilt Enterprises; Inc a, for the Sonoma Vista Subdivision, Unit 41, to be located in the vicinity of Lakeville'Highway, Casa Grande Road, and South McDowell Boulevard. Mr. McGvern read a letter from David A. Young, Director of Public Works, stating the map is substantially the same as the tentative map approved by the Planning Commission of the City of Petaluma on April 15, 1969, but stated that nothing could officially be adopted until the rezoning for this parcel to R -1 -6,000 has be- come official. It was noted that the Council did approve the, zoning application at its meet- ing of August 41, 1969; however, it does not become effective until September. Koenitzer, seconded by Comm. Perry, and passed by all members,'present. VALLEY GREEN The Planning Commission considered the final SUBDIVISION map approval for Valley Green Subdivision, UNITS'.1 & 2 Units #1 & #2,�,filed by Wesley Bailey, located FILE 24 -69 off South McDowell Boulevard. Mr. McGivern read a letter from Assistant Ci;:y Engineer, dated August 5„ 1969, stating that the final maps of the Subdivision are technically cor- rect and the final maps are substantially the same as the tentative maps approved by the Planning Commission on May 6, 1969. However, in view of the'fact that the final maps do not comply with all local ordinances, he could not place his certification upon them. The maps were designed on the basis on an R -1 -6,000 Zone. Since the property has not been rezoned, nothing can be 'officially done until action is completed. It 'was noted that action was taken on the rezoning at the August 4, 1969 Council meeting. Koenitzer, seconded by Comm. Perry, and passed by all mem- bers. MEADOWLARK MEADOW TENTATIVE MAP FILE 25 =69 Mr. McGl vern submitted a letter requesting a con - tinuance f or tentative map approval for Meadow - lark Meadow Subdivision until the next regular meeting of the Petaluma Planning Commission to be he August 19, 1 969. Chairman Stanley noted that this matter had not been before the Commis- son,prior to this date„ whereupon a motion to hold this matter over to t he next meeting was made by Comm. Koenit ;er, ,seconded by Comm. Perry, and agreed upon by 5 affirmative votes. CHERRY VALLEY Ch airman Stanley opened the Public Hearing to ESTATES consider application filed by Cherry Valley REZONING Estates, Inc., to rezone A. P. No. 6 411 - 05 FILE Z10 - 69 from R - 1 - 10,000 Family Residential) to an R -1 -6,000 Zone, located off Schuman Lane. The Staff report, presented_ by Mr. McGlvern, re- viewed the history of rezoning this area and included a legal opinion from the City Attorney regarding the applicability of a new applica- tion filing, all part of the planning Director's written report.) No objections were Voiced from -A the audience. Murray attorney for Cherry° Valley Estates added that the subdivis in- cludes a walkway between lots 8 and 9, dedica- ted to the City, which goes directly to the school. This would eliminate walking on the road and be much safer fo r children.. No fur - ther information was added, and Chairman Stan - ley closed the Public Hearing. Res. Z10 - 69, adopting the proposed amendment to the Zoning Ordinance reclassifying A. P. No. 6- 411 -05 from R -1- 10,000 Zone or District to R -1- 6,000 Zone or District, was introduced by Comm Styles, seconded by Comm. Perry, and �--. passed by all members. PAG 5 PETALUMA PLANNING COMMISSION MINUTES -- AUGUST 5, 1969 PAGE SIX JAMES SCOTT Chairman Stanley opened the Public Hearing to REZONING consider the'applcati®n -filed by James Scott FILE'Z11 -69 to rezone A. P.46-141-2'6, -25 from R -1 -6,000 Zone or Distri:ct.to R -M -1,500 (Multiple) Zone or District located at 651, Central and West Street. Mr. Anderson presented the Staff report, which pointed out the Multiple Residential Zon- ing on the subject property would'-constitute a spot zone in the area of single family develop- ment. In a former agreement between the owner and the City, prepared in 1959, the Public Works Department,requred that, prior to the issuance of any building permit, all public improvements be done as requested by the Director of Public Works in accordance with existing standards. The only improvements constructed by the appli- cant were curbs and gutters. It was further noted. as part of the aforementioned agreement, the City zoned the subject property for multiple residential use subject to an agree - ment that certain improvements would be made by the owner of the property. Since the R -1 -6,000 Zone was imposed and the adoption of the new Zoning Ordinance, no improvements had been made nor multiple residential development accomplished on the site. It was. added that the City Attor- ney's opinion is the agreement is no longer valid. Therefore, the staff recommended that the rezoning to'R -M -1,500 disapproved. Speaking in opposition to. this rezoning were Mrs. Henry Warner, 5:01 Central Street, Irwin Cameron, 62.5 Galland Street,, Go`^don Durkee, 618 Galland Street and Mrs. I, Snell. The streets are too narrow, it would create parking difficultlesi and create a hazard by the additional children brought into the area. Speaking in favor was Mro Scott, the owner, point- ing out that financially he could not develop the property as it is now zoned. After further dis- cussion by Mr. Scott regarding use of the property, Chairman Stanley closed the Public Hearing. Res. Z11 -65, de'n'ying the application for rezoning, was introduced by Comm. CONDIOTTI Chairman Stanley opened the Public Hearing to PREZONING consider an application filed by A. Condiotti FILE Z12-69 to pre-zone areallocated within the Bazzano Annexation, A. P. #136-050-24, -18, and -04 from "A" (Agricultural) County Zoning to R -1- 6,0'00, to become effective upon annexation. Mr. Anderson presented a favorable Staff report, re- commending that�lthe Planning Commission forward a recommendation to the City Council that the subject property be prezoned R-1-6,000, includ- ing the two smaller parcels owned by H. C. -makillop and K.',R. Torliatt. There was no opposition voiced from the audience. Mr. Ron Simpk-i representing Mr. Condiotti, was pre- sent,but had nothing more to add. Chairman Stanley closed the Public Hearing. Res. Z12-69, recommending the adoption of the proposed amendment to the Zoning Ordinance to reclassify A. P. 1 #136-050-24 (area included in the Bazzano Annexation) from "A" Zoning to R -1- 6,000 (Single Family Residential) Zone or Dis- trict to become effective upon annexation to the City of Petaluma, was introduced by Comm. Perry, secondedlby Comm. Brunner, and passed by all members present. GENERAL PLAN Mr,. Stanley opened the discussion on the proposed amendments to the Petaluma Area General Plan. Mr. Anderson briefly covered what was discussed at the Council's StudylSession regarding modifications to the General Plan. Res. 2,0-69, prepared by the City Attorney, which outlines these dhanges, recommending modifications to the General Plan to be forwarded to the City Council, was introduced by Comm, Perry, seconded by Comm. Brunner, and passed unanimously. FURTHER Mr. Stanley suggested a joint study session with DISCUSSIONS the City Council to review the sign ordinance with possible modifications along the freeway. Further discussion followed concerning the exist- ing standards, conditions, and possible changes. Mr. McGivern reported that his staff was working p on a collection.lof information to present to the Commission. A Study Session was set for August 26, 196-9, to study the Sign ordinance. Mr. McGvern answered that as an item for the Pop- ulation Census, as part of the survey to be conducted very shortly, the number of vehicles in the City, etc., was being asked to ascertain some idea of a vehicle count.
