Regular meeting of the Petaluma C- ity'Planning Commission was held
on October 7,. 1969 at 7x3.0 o'clock p.m. in the Council Chambers,
City Hall, Petaluma, California

APPR OF MINUTES - The minutes' for the meeting of September 16th
and 23rd, 1969, were approved as submitted.
GUIDELINES The Planning Commiss reviewed the resolu-

Commission on September 23, 1969, to formu-
late'thesoe recommendations. A motion, approv-
ing the guidelines, deleting Item No. 8, was
introduced by Comm. Koenitzer, seconded by
_ Comm. Perry, and passed unanimously. (Item
No. 8, referring to mobilehome parks being
•� located within a one - mile radius of a shop-
ping center, is covered adequately elsewhere
in the resolution)..

ning Commission, but no action was taken
because the applicant was unable to attend.
The applicant was present at this meeting
and indicated no opposition to the condi-
tions outlined in the staff report. A
motion, approving -site design with the con-
ditions recommended in the staff report,
was introduced by Comm. Brunner, seconded
by Comm: Koenitzer, and passed unanimously.

CASA GRANDE #5 Ron Simpkins, representing Art Condiotti,
TENTATIVE MAP developer for Casa Grande Subdivision, Unit
FILE: 31 -69 #5, requested the Planning Commission to
continue the consideration of the tentative
map until their next regular meeting of Oct-
ober 21, 1969. The Planning Commission
agreed to continue the matter as requested
by the developer's engineer.

Chairman Stanley opened the public hearing

to consider precise plan lines for East

Washington Street from Baylis Street to
and 35 -69
Hopper Street. Mr. McGive'rn outlined the
limits of the proposed plan lines and fur -
ther pointed out to the Commission the pre -
cise plan lines are needed in order to pro-
vide specific guidelines (and building set-
back lines) for future development along
East Washington Street, even though actual
construction and widening of the street may
not take place for several years. Mr. Ben
C. Albritton, a member of the engineering
firm, Hoffman & Albritton, who prepared the
proposed plan lines report, stated that of
the f'ive'(5) plans submitted, they recommended
Plan A2�1 because it does the least destruc-
tion to existing structures. The City Engi-
neer agreed to the engineer's recommended
plan. On Phase #`1 of the plan line, East
Washington Street from Baylis Street to
Copeland Street, the firm recommends a 69-
foot street from curb to curb with all wid-
ening being done on the southerly side with
no parking, from.Cop.eland Street to Hopper
Street, they recommend a 79 -foot street from
curb to curb with parking on each side.
Essentially this plan indicates the rights -
of -way will be acqu- red.from the southerly
side of the street except for the linking
of the curb around the turn (the Yosemite
Hotel site). Mr. Albritton answered several
questions asked by property owners regarding
their particular parcel. Chairman Stanley
closed the public hearing for this portion
of the proposed plan lines.
Chairman Stanley opened the public hearing
on the proposed plan lines from Hopper St.
to U.S. 101 Freeway. Replying to a ques-
tion from the audience, why would parking
be allowed along Washington Street, Mr.
Albritton stated parking isolates the vehi-
cular traffic from the pedestrians on the
sidewalk and would also take care of future
widening of the street. The City Engineer
said the FaustmaT Traffic Report made by
the traffic engineer from Sacramento, under
contract by the City, recommended four (4)
lanes on East Washington Street if the
Caulfield- Lakeville route.is also constructed;
if'not, 6 lanes were recommended. Mr. Young

Opposition to the plan lines was voiced by
John Regan and Ernest Curtis. Walter Min -
ogue requested to see the lines show-
ing the rights --of -way taken from the north -
side of.the street since he has interest
.in Carl's Market. At this point, Mr. Al-
britton explained each plan. The complete
report is on file with the Department of
Public Works. Mr. Young stated that con-
struction cost for all 5 plans were very
similar. Mr. Albritton said the following
information was presented to the City Coun-
cil with regard to the project: (1) Esti-
mated construction cost; (2) Total square
footage of new right -of-way required; (3)
Number of individual parcels of land affected;
and (4) Number of individual buildings
affected..
Continuation of the public hearing for the

portion between - Hopper and the U.S. 101
Freeway will be continued on October 21,
1969.
WASHINGTON
Chairman Stanley opened the public hearing

to consider the proposed alignment and rights -

of -way for the Washington Creek Storm Drain
as submitted by Sonoma County Flood Control
District. Mr. McGivern staffed that although
the work will be done by tYe County, plan
lines must be approved by the City because
the land involved is located within the City
Limits. Messrs. Sven Karrman and Rod Schuler,
of the Sonoma County Flood Control District
staff; were present and outlined the project.
The Washington Creek widening and rehabilita-
tion will take place between McDowell Boule-
vard and Maria Drive. Three property owners
residing on San Carlos Drive, namely, Warren
Brown, Dominick Klein and Niels Petersen,
objected to the project because it was not
extended to include work along the area where
they reside.' John King interjected that the
City should consider what effect these align-
ments have on future development of East

was introduced by Comm. Koenitzer, seconded
by Comm. Reed, and passed unanimously.
CHERRY - MAGNOLIA Chairman Stanley opened the public hearing
STORM DRAIN to consider the-alignment and proposed rights -
FILE: 33 -69 of -way for the Cherry - Magnolia Storm Drain
project as submitted by the Sonoma County
Flood Control District. Hal Wood, Assistant
City Engineer, explained the project would
take care of,the flooding created in the
Cherry - Magnolia - Lasher Hatchery - Petaluma
Boulevard area. Opposition to the proposed
route of the 84 -inch conduit was voiced by
Paul Zell and Mr. Boitano. Mrs.. Page also
asked several questions. Both Mr. Karrman
and Mr. Schuler said they were not familiar
enough with the project to determine why the
proposed route was selected. A motion to
continue the meeting until October 21, 1969,
was introduced by Comm. Perry, seconded by
Comm- Reed, and passed by all members pre-
sent. Mr. Stanley suggested.to the Flood
Control representative to contact the pro -
perty owners with the proposed
alignment to answer their questions.
NORMAN 'ROLLINS The Commission reviewed the variance appli-
VARIANCE cation filed by Norman Rollins to allow two

than 6,000 square feet and both lots less
than 100 feet in depth. The proposed lot
split is for property located at 100 - 8th
Street. A favorable staff report was pre-
sented, indicating that the request meets
the necessary criteria to justify a variance.
A motion, approving the variance, was intro-
duced by Comm. Koenitzer, seconded by Comm.
Perry and passed unanimously with the condi-
tions outlined in the staff report and with
the added condition that the creation of the
two lots be allowed only upon the removal or
demolition o'if all existing improvements.

• ZONING ORDINANCE Chairman Stanley opened the public hearing
AMENDMENTS to consider the following proposed amend -
FILE: 36 -69 ments to thelZoning Ordinance:
(1) Amend Section 7- 301(a) - Remove the
requirement. that certain uses which are
otherwise permitted in the M -L District
be located not less than 1,000 feet from
an "R" or "P - M" District, and
(2) Delete Section 6- 304(b) in its entirety
and the uses therein be included
in the list of conditional uses for the C -S
(Service Commercial) Zone.
Mr. McGivern'stated that the residential
district areas within 1,000 feet of an M -L
Zone are adequately protected against ob-
jectionable or annoying conditions by the
standards and requirements in other sections
of the Zoning Ordinance. A comprehensive .
staff report,is part of the permanent record.
There were no objections voiced to the pro-
posed amendments. Chairman Stanley closed
the public hearing -. After due consideration,
Resolution 26 -69, recommending the proposed
amendments to the City Council, was intro-
duced by Comm. Koenitzer, seconded by Comm.
Perry, and passed unanimously.
FILE: -37 -69 (3) Amend Section 7-3,02(b) to provide for
the meat processing of fowl and poultry in
the M -G (General Industrial) Zone as a per-
mitted use -. Mr. McGivern presented the
staff report,I. He stated that no where in
the Zoning Ordinance is there a provision
for this specific type of use. As a per -
mitted use in the General Industrial Dis-
trict, poultry processing would be subject
to the performance standards required for
all industrial uses. In addition, the use
would be allowed as a conditional use in
the M -L District. Comm. Koenitzer ques-
tioned why the Planning Commission was ini-
tiating this'use rather than the applicant
who is proposing this type of use (referring
to the proposed Petaluma Poultry Processing
Company to be located in an M -L Zone). Mr.
McGivern stated the matter to consider is

FILE: 37 -69 whether or not the introduction of this speci-
(continued) fic use is in good keeping with the intent and
purpose of the Zoning Ordinance regardless of
who initiates it.
After much discussion by the Planning Commis-
sion, Resolution 37- 69,.recommendng to the
City Council to add meat processing of fowl
and poultrylas a permitted use in the M -G
Zone, was introduced by Comm. Brunner, second-
ed by COMM. 'Reed, and passed by the following
vote: AYES! Comm. Brunner, Perry, Reed,
Stanley. NOES: Comm. Koenitzer. Comm.
Koenitzer qualified his "NO" vote by saying
he'o'didn't feel had all the facts to qualify
a' "YES" vote at this point.
SARTORI ESTATE Chairman Stanley opened the public hearing to
REZONING consider an,application filed by William Fos -
FILE Z14 -69 ter, agent for Sartori Estate, to rezone a
portion of Assessor's Parcel No. 5- 040 -05
from an "A "'(Agricultural) Zone or District
town M - L (Limited Industrial) District. The
site is located at the southwesterly intersec-
tion of Lakeville Highway and Frates Road,
comprising approximately 85 acres. A brief
report was p�resented.by Mr. Anderson, Assis-
tant Planning Director. No opposition was
voiced. After reviewing all the available
facts, Resolution Z14 -69, recommending the
rezoning tolithe City Council, was intro-
duced Comm. Perry, seconded by Comm. Reed,
and passed unanimously.

Chairman Stanley opened the public hearing to

construction of a poultry processing plant,
etc., in a proposed Limited Industrial Zone
or District,' 2700 Lakeville Highway. A fav-
orable report was presented by: the staff,
recommendingi approval of the.use permit, sub-
ject to four conditions of approval. Mr.
McDevitt, representing the applicant, was
present and lstated that, at the suggestion
of the City ,Engineer, their firm had hired
a sewage disposal firm to find out what affect
the loads rejsulting from the proposed operation

He further stated no opposition to the con-
ditions of approval in the staff report.
No protests were noised. Resolution U25 -69,
recommending of the use permit, sub -
ject to the conditions outlined in the staff
report and with the added condition that the
use permit becomes valid upon the effective
date of the M -L Zoning for that area, was
introduced by Comm. Perry, seconded by Comm.
Koeritzer, and passed unanimously.

seconded by Comm. Perry, and passed unani-
mously.
VAN BEBBER, MILLER, Chairman Stanley opened the public hearing to
BATTAGLIA REZONING consider the1application filed by George E.
FILE: Z15 -69 Van Bebber, Craig A. Miller and P.M. Battaglia
to rezone four parcels of land from a Service
Commercial Zone to a Limited Industrial Zone
and three parcels of land from a Highway Com-
mercial Zone to a Limited Industrial Zone.
The area is located north and east of First
and Second Streets, having frontage on both
Petaluma Boulevard South and the Petaluma
River. The staff report stated that although
the General Plan indicates office and retail
commercial uses as the desirable form of ulti-
mate development for that area, the present
use pattern involves many existing industrial
uses which are operating successfully and have
plans for expansion. In view of the fact that
the uses which existed in this area when the
General Plan' formulated did not decline
as anticipated, a re- evaluation of the land
use pattern is appropriate for the subject
area.
Mr. Walter Strayer, 700 Petaluma Boulevard
South, adjacent to the Van Bebber property,
did not object to the rezoning but requested
that Mr. VanlBebber construct a fence across

Mr. Traversi, representing the applicants,
responded that said nuisance is essentially
a policing prloblem and his clients were
equally interested in eliminating this sit-
uation, because it creates a hazard to their
property. After due consideration, Resolu-
tion Z15 -69, 'Irecommending the rezoning to
the City Council, was introduced by Comm.
Perry, seconded by Comm. Reed, and passed
unanimously.
ELECTION OF Paul R. Stanley and Robert Koen.itzer were
OFFICERS unanimously r,e- elected as Chairman and Vice -
Chairman of the Planning Commission.
FURTHER The Commission discussed the matter of making
DISCUSSION recommendations on Sonoma County Referrals
when notices 'of said applications are not re-
ceived in time to research them. The Commission
agreed that such referrals should be held over
until the next meeting to allow for proper
consideration) and that the County should be
notified of the delay.
ADJOURNMENT There being no further business to come before
the Commission, the meeting was adjourned.
