Regular Meeting of Commission was held
on November 4, 1969, at 7:30 o'clock p.m. in the Council Chambers,
City Hall, Petaluma, California.
PRESENT: Comm. Brunner.,.Koenitzer, Perry and Stanley,
ABSENT: None..
STAFF: Wm. C. McGivern, Director of..Planning
Andy Anderson, Assistant Planning Director
APPROVAL OF' MINUTES
The minutes for the meeting of October 21., 1969 were approved
as submitted.
THACKER USE The Commission reviewed the use permit granted to
PERMIT REVIEW Mary.C..Thacker on.October..22,_1968 to allow 24
FILE: U23 =68 hour home care. for .four adult::women. (mentally retarded)
at 404 Sheldon Street in-an R -1- 6,000.. The staff re-
ported.the subject property has been remodeled for the
use,-and furthermore:, .no _complaints have: been received
from the..neighbors. and the operation.-seems to fit into
the.neighborhood.very wel1..:.In: :view of these findings,
the Commission agreed no action was necessary to
discontinue the_use'.:permit and complimented Mrs. Thacker
for upgrading the site.
CHERRY- MAGNOLIA Continuation of the public hearing to consider the
STORM DRAIN alignment and proposed rights= of- way..for..the Cherry -
FILE: 33 -69 Magnolia Storm Drain project, submitted by the
Sonoma.County Flood Control.and:Water "nnservation
District,, was held at.this time. Mr.. Car1.:R. Jackson,
..Assistant. Chief Engineer for. the County,. gave' a progress
.report. on what. has .transpired between..the .District and
Mr. & Mrs. Paul. Zell, _.who .voi:ced opposition to the pro-
posed route .of the .Storm.. Drain..alignment .over their
property. Mr.. Jackson. stated .that in a .meeting with Mr.
Zell two weeks ago,-.Mr. Zell proposed.another alignment,
the.same.as the original.alignment: :proposed by the
District.2 4/2 years ago. However, since their meeting
with.Mr. Zell, he now.proposes still,.another alignment,
as, indicated in a letter addressed.to..the District. Mr
Jackson .recommended that .the..Commission pass a- resoluti-r::

additional .statement to .read -,.. "or an .alternate plan
mutually..agr.eed upon by.the District.& Mr. & Mrs. Paul
Zell." Mr. Jac kson :..cautioned,the_project could possibly
be dropped_.if.. further ..delays..are...encountered. If this
were:, the case,...Mr.. Ze :l .would_..still..have a parcel of
land with a he.would have to solve
himself. Mr..Phil.Joerger., Councilman, spoke strongly
advising the Commission..to.:endorse_..the alignment as
presented. It. was his'.,opinion:,..that ample time was given
to file "complaints.. Mr.: Joerger:stated - this effort was
the* result of'approximately_.:3 years of work on the project.
He further.stated Mr. & Mrs....Zell had signed the contract
and the County had acted on,it_.in good faith.
Mr. Boitano, who had ..expressed .concern.. over possibly=:
damage to _his;_ building .located at.. 1 .Bridge Street, said
he .had.:d scussed._the ,matter with Jackson''prior to the
meeting - and:was'satisfied the,District will take ample
precautons*to building.. A.motion, approving
the Sonoma County Flood Control-and-Water Conservation
District Storm Drain..Coriduit right -of - way map for Cherry -
Street and Avenue, ._or an..,alternative plan mutually
agreed.-upon introduced-by Commissioner Koenitzer,
' seconded by Commissioner_Perry.`and.passed unanimously.
MONARCH PACIFIC The Commission: reviewed..the.- final:map_,of Monarch Pacific
FINAL MAP #6 filed by. Atlantic_ &..Pacific Builders, located westerly
FILE: 38 -69 of McDowell Blvd.,.southeasterly..of Baywood Drive & easterly
of St. Francis "Drive:.. Mr..McGivern.read a favorable report
received from the Director..o >f. and City
Engineer. A motion.,.approving..the final map of Monarch
Pacific #6, was - introduced by Commissioner Perry, seconded
by- Commissioner, Koenitzer, and passed unanimously.

to present- plans for .a.proposed planned unit development
for the. Millme aster,. property located on North McDowell
Boulevard. Mr. Robert W..Hayes ,Planning Consultant re-
presenting Young America Homes, had.:appeared before the
Council on.,November 3, 1969, wth'.the'subject proposal of
a planned - community.development combining single family
homes with multiple structures-on a100 acre parcel. The
development: would. require. :mod- ific.2ition of our existing
Zoning Ordinance.relative'.to. :planned unit development. Mr.
McGivern noted that..such a proposal require a
comprehensive study and,questioned its priority among the
items currently.under study At this. -time he reviewed
some of the,items on the,priorityrlist for study during
the 1969 -70 fiscal year,. Besides-: - revision. of the Zoning
Ordinance - other items::.under..study :include revision of the
subdivision ordnance,.adopton..of a Housing Element
as required by.State hillside. City's

After due c.onsideration.the- Planning Commission had a
split vote..and. therefore could-not any-definite
conclusion. The staff will forward a'oletter noting
the voting., along with the staff report, to the Board of
Zoning Adjustments.
