HomeMy WebLinkAboutResolution 97-333 12/15/1997Resolution No. s7-sss N.C.S. of the City of Petaluma, California a s 6 APPROVING THE APPLICATION AND ASSURANCES FOR GRANT FUNDS 7 UNDER THE COAS'CAL s CONSERVANCY ACCESS PROGRAM FOR THE 9 LYNCH CREEK PEDESTRIAN TRAIL, BRIDGE AND FREEWAY o UNDERCROSSING 12 13 WI-IERGAS, the Legislature has established the State Coastal Conservancy (pursuant to 14 Public Resources Code 3 1 00 0-3 1 4000) a~?d authorized it to awed grants to local public 15 agencies and nonprofit organizations for Uie acquisition and development of coastal I6 accessways; and 17 Is WH1/REAS, the grants are awarded pursuant to guidelines established by the Coastal 19 Conservancy for determination of project eligibility for funds; and 20 2I WI-IERL;aS, the procedures established by the Coastal Conservancy require the applicant 22 to certify by resolution approval of the application and listed assurances prior to 23 submission of this application to the State; acid 2a 25 NOW, THE12f,FORE, be it resolved that the City Council of the City of Pctahtuia hereby: 26 27 I. Approves the filing oP an application for funding under the State Coastal 28 Conservancys Access Program; and 29 30 2. Agrees to the attached List of Assurances; 31 32 3. I~las or will have sufficient funds to operate and maintain the funded project(s). 33 34 4. Agrees to provide any fiords needed beyond the grant requested to complete the 35 project(s) funded under this program through the allocation of uncommitted 36 funds. 37 x~omuaaxo. 97-333 x.as. Page 2 of 2 List ®f Assa~rances 'The applicant hereby 'assures' and certifies ,that it will .comply with .State Coastal Conservancy regulations, policies, guidelines, and requirements as they relate to the accepfance and use of Conservancy funds for this project. Also the applicant gives+.assurance and certifies' with respect to the grant that: It possesses legal authority to apply .for the grant;. and to firiance and construct the proposed facilities; that: where appropriate, a resolution; motion, or similar action. has been duly adopted or passed as an official act of ttte applicant's governing body, authorizing the filing of the application, and authorizing the person identified as the official representative of•the applicant to act in connection with the application and to provide such additional iriformation',as may be required. 2. It will have sufficient funds available t_o meet. its own sfiare of the .cost for' projects. Sufficient funds will be available when the project' is completed to assure the effective. operation and maintenancebftfie•facility for the purposes constructed. 3. It holds sufficient title or interest in he property to enable it to undertake lawful. developinent and constivction of the project. Except in the case where the Grantee is acquiring ati interest "fn the property as-apart-.of the project development, such title documentation shall be reviewed by the Executive Officer ofthe Conservancy. t 4. It will not dispose of.oY'ericumber its title.or other interest in-the site and facilities, except as permitted by the Conserdancy. 5. It will give the Conservancy; tluough any authorized. representative, access to and the right to examihe all records, books; papers, or documents related to the grant. 6. It will cause work on the project to be commenced within a reasonable time afrer receipt of notification from tfie Conservancy that funds have, been approved, and, the project will be carved to completion with reasonable diligence. 7. It will, where appropriate, comply with the requirements of~the State Government Code 7260.et~ which pio0ides for equitable;treatmentand relocation assistance for persons displaced by eminent;domain. 8. It'will, where appropriate, comply with'the requirements of the California Environmental Quality Act.. 9: It will comply with all requirements ,imposed by the Conservancy concerning special provisions;of law, an`program requirements. resoassu /jb67
