January 18, 1972
Regular meeting of the Petaluma City Planning Commission was held on
January 18, 1972, at.7' :30 p..m in the Council.Chambers, City Hall,
Petaluma, California.
PRESENT: Comm. Balshaw, Ce'rini, Daly., Schmelz, Waters

MINUTES FOR DECEMBER 28, '1971, AND JANUARY ,4, 1972
The minutes-for the meeting of December 28, 1971 and January 4,
1972, were approved as submitted.

AMENDMENT TO ZONING ORDINANCE_NO. 622-N..C.S. RESOLUTION NO. 2 -72
Commissioner Waters opened the public hearing to consider amending
Zoning Ordinance No,. 622 N.C.S. incorporate a Planned Unit
Development District and a Planned Community Development District.
Mr. McGivern explained the logic for having the Zoning Ordinance
amended and referred to the amendment draft which was distributed
to the Commissioners. Mr: McGivern ,explained that by including this
amendment in the present Zoning Ordinance at this time, the City
will be able Wallow development during the spring together with
providing City government tools to carry on its business' while the
Environmental Design Plan and the new-supporting Subdivision and
Zoning Ordinances are being brought to a conclusion for adoption.
He stressed that this was only an interim measure to avoid any
technical legal suits that might be caused by the current lengthy
moratorium.
Commissioner Waters referred to an article in the Press Democrat
containing two laws that have to be complied with this year. One
is the open space law to be complied with by July of 1972, and
second requires all city or county ,zoning to conform with adopted
general plans.by July of 1973: Commissioner Waters asked Mr. McGivern
to supply the Commission with copies of the laws mentioned so that
the Commission can review them along with the proposed amendment
draft Mr. McGivern indicated.that he x�vould qet copies of the new
State,legisla . tion and ask the City attorney submit an interpreta-
tion of al 1. the new laws applying to the City.
The Commissioners agreed to adjourn the meeting in order that
they might review these laws and the proposed drafted amendment.

Commissioner Waters adjourned the public hearing until January

PETALUMA PLAZA PROPERTY TIME 'EXTENSION FOR 'C - ZONING. RESOLUTION 3 -72
Mr. Richard.Anderson, Assistant P'lanne'r,, read the staff report,
prepared to respond to the-request filed by.Thomas E. Schaal,
attorney for the Petaluma Plaza Shoppirig Center, to extend the
C -C Zoning for an additional year to 'allow preparation of required
site plans for the proposed construction of ,ari addi.tion,to the
present shopping center on the 10 acre's to the north. M- r.Anderson
suggested that this matter should be,revewed carefully because.
of the lack of detailed planning information,.
Mr. Thomas E Schaal..addressed the CommlIss,ion ,stating the
difficulty of getting tenants selling theproper array of goods,
and negotiating 'with the tenants for leases, and sizes of shops. He
stressed the difficulty in getting tenants to commit themselves
when the future zoning of the area itself is" uncertain. Mr. Schaal
assured the . Commisson that the extension requested is for the
future development 'o'f the remaining ten acres adjoining the plaza
and not for the purpose of sales speculation. He also stated that
the renewal of the plaza's sale or lease option, which expires
January 30, 1972 was contingent upon the approval of the one year
time extension.
After a great deal of discussion and reviewing the procedures and
findings of the reques for the zoning extension of time, the
Commission voted unanimously for the ext of one year of
the 18 month period within which site plans, elevate, and landscaping
were to be submitted and/or approved.- This extension will begin on
the expiration date of the 18 month period, or March 16, 1972, . and
is to run concurrently with the 30 month period within which half of
the floor space is to be constructed on. the ground.
ROTATION SCHEDULE
Mr. McG'vern submitted a rotation schedule prepared at Commissioner
Waters'' request. Commissioner Waters suggested the rotation
schedule be submitted at the followng'meetng.
ADJOURNMENT
There being no further business to come before the Commission, the
meeting was adjourned.
