MAKING APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION
(LAFCO) TO INITIATE PROCEEDINGS FOR REORGANIZATION OF A 2 ACRE
PORTION OF CERTAIN PROPERTY KNOWN AS NOWAK PARCEL MAP,
ASSESSORS PARCEL MAP NUMBER 019-070-042 PURSUANT TO THE
CORTESE/KNOX LOCAL GOVERNMENT REORGANIZATION ACT OF 1985
WHEREAS, after public review and input, the City Council adopted under Resolution No.
96-178 N.C.S., the Mitigated Negative Declaration for the Nowak Parcel Map; and
WHEREAS, in order to implement the project, it is necessary to annex a portion of certain
property known as Assessor's Parcel Number 019-070-042;
NOW THEREFORE BE IT RESOLVED that pursuant to the Municipal Organization Act
(Government Code 35000 et. seq.) the Petaluma City Council hereby makes application to
the Local Agency Formation Commission of Sonoma County for a proposed
reorganization as follows:
An Annexation of a 2 acre parcel known as Assessor's Parcel Number 019-070-
042 to the corporate boundaries of the City of Petaluma;
Said territory is developed with a single residence and associated outbuildings, and
is comprised of approximately two acres, as described on the Nowak Annexation
Map.
BE IT FURTHER RESOLVED that the reasons for the requested reorganization are:
1. The property is contiguous to the City and is within the adopted Sphere of
Influence and General Plan Urban Limit Line of the City of Petaluma.
2. The City has completed an environmental review process for the area culminated
in the approval of a Mitigated Negative Declaration.
3. The owner of said property has initiated said annexation.
4. By Ordinance No. 2063 NCS, the City of Petaluma has prezoned the affected 2
acre property to R-1 20,000, Single Family Residence Distnct.
5. The annexation is consistent with the objectives and policies of the General Plan,
as documented in the Ordinance to prezone the property and the Resolution
approving the Pre-Tentative Parcel Map for the Nowak project.
6. This annexation will enable several provisions of the General Plan to be achieved,
including: orderly improvement of City infrastructure, preservation of the City's

1 Urban Limit Line, and preservation of County land use including residential and
z agricultural uses.

4 BE IT FURTHER RESOLVED that the requirements of the California Environmental
5 Quality Act (CEQA) and its Guidelines have been satisfied and are thoroughly addressed
6 in the Mitigated Negative Declaration adopted by City Council Resolution
7 No. 97-323 N.C.S., on November 17, 1997 and incorporated herein by reference.

9 The City Clerk is hereby authorized and directed to file a certified copy of this resolution
to with the Executive Officer of the Sonoma County Local Agency Formation Commission.
