APPROVAL OF The minutes of the meeting of April MINUTES 4, 1972 were approved as written. The minutes of the meeting of April 10, 1972 were approved as written. SITE DESIGN Chairman Balshaw reported the Site REVIEW COMMITTEE Design Revlew recommended approval of"the Lee J. Cox Variance at 338 Keller Street, Petaluma in accordance with the staff recommen- dation ('File #2.156) The Committee recommended approval of the Gerald G llespie, Variance, 741 Pine Avenue, Petaluma with the con - dition that the applicant obtain building permits. The Committee re- quested the staff obtain the name of the 'Contr actor notify him of his obligation to. obtain building permit. (File #3.151) The Committee referred the Cherry Hil.l,. Apartments Site Design to the Fall Planning Commission for consideration. The Committee recommended approval of the Traversi.Site Design, located at 35 Fifth Street, Petaluma. _ 2 = Petaluma City Planning :Commission; Minutes June 6, 1972 A motion was ,introduce:d'by Comm. The motion was passed unanimously by all members present The Cherry Hill _Apartment Site Design was deferred to the end of the meeting. :CORRESPONDENCE: Mr. McGvern reported on the letters inviting the_Southern Sonoma County City Councils and Planning Commissions to a presentation by Larry Andrews, LAFCO Executive Officer, June 13, 1972 were mailed to the various cities. Daly brought before the Comm - ions attention Resolution No. 6 N.C.'S. adopted by the Council Apri 17, 1972, ., Section No. 10 stating "Except as to projects submitted and approved the P lanning Commission shall,not rezone or prezone any land to any residential use unless the Council 'shall by resolution rescind ithis subsection:." 'Comm. Daly re- ported the Council has not rescinded this subsection. A motion was - introduced by Comm. Dal' seconded by Comm'. C'erni, continuing the subject item ;until Resolution Nei„ 6028 N.C.S. Subsection 10 has been revised. The motion was passed unani- mously by al.l- members present. Comm. Balshaw requested the entire area be considered at the same `time. 'Petaluma City Planning Commission Minutes June 6, 1972 WALTER.KIECKHEFER - REZONING SUNCO DEVELOPMENT CORPORATION REZONING Public hearing to allow an application filed by Walter Kieckhe,f'er to rezone a site from M-L (Limited Industrial) .District to C-C (Community Commercial) District .located in the area bounded by East Washing-ton Street, Weller Street, the Petaluma River, to include Baylis Street, A.P. #007-142-6, 9, 10, 11, 1.2,, and ,13. Mr. McGivern read the staff report and reviewed the histbry of the sub- ject rezoning. Chairman waters opened the public hearing. Mr. Pat Shannon appeared before the Commission stating no opposition to the proposed rezoning and further stated the development would be in the best interest of the City for better development ent of the downtown area. Public hearing to allow an application filed by Frank LaPointe to rezone a site from R-M-1,500 (Multi Family Residential) District to a P.U.D. (Planned Unit Development) District. Mr. McGivern gave an introduction and history of the subject re-zoning re- quest. Mr. Anderson read the staff report. Much discussion followed regarding the Environmental Design Plan designation -.4 -_ Petaluma City Planning Commission Minutes June 6 , 19 7'2 ZONING ORDINANCE #662 N.C.S. AMENDMENT limiting new residential development to a density of 6 units per acre. The Commission directed the staff to re- quest an opinion from the City Attor- ney on the Planned Unit Development Ordinance. Comm. Cerini requested utilization of any natural growth be preserved along the creek. The Commission requested the subject application be brought back upon com- pletion of all the requirements of a Planned Unit Development. Chairman Waters opened the public hearing. Mr. LaPointe, applicant, appeared before the Commission. He requested the rezoning only apply to the 149 units as established by Council policy on growth, and the re- mainder of the property be left in R -M- 1,500. (Multi Family) zone. If the subject request is tabled, then Mr. LaPointe stated he would need some time to make additional plans. The staff was directed to work with the applicant on compliance of the Planned Unit Development District requirements. The Commission continued the public hearing until the applicant: comes back with the required information under the Planned Unit Development Ordinance, and a memorandum of opin:'on from the City Attorney regarding thy: Planned Unit Development ordinance. Public hearing on proposed modification to the Zoning Ordinance to add Section 7 -401 (f`) - Motels and Hotels as a conditional use in the M -L (Limited Industrial) District.. Hood wanted an explanation of Cond-ition #6 with re- gards to "more vehicular traffic than normal." Chairman Waters opened the public. hearing. Mr. Pat Shannon appeared be- fore the Commis-sion. He stated the Chamber of Commerce has been working with Motel 6'fo over a year for the subject area® He. urged the Commission approve the con use of motels and hotels 'in the M-L (Limited Indus- trial) al) Districts ts, Chairman Waters closed the public hearing. After hearing all., the testimony and f . acts, a.motion was introduced by Comm. Popp, seconded by Comm. Balshaw, that Motels and Hotels be added as condi - tional.uses to the M-L, (Limited Indus- trial,) District. The motion was passed OF unanimously by all members present. The motion was passed unanimous'ly all members present. Public hearing to allow an application filed by Center Mobilehome Corporation to rezone a site from an M -L (Limited Industrial) bistrict, to an R -M -1,500 Mobilehome Park District located on the easterly side of U.S. 101 Freeway, south of Corona'Road and immediately adjacent to,the south of Petaluma Estates Moblehome Parka Comm. Daly brought before the Commis - sions attention Resolution No. 6028 N.C.S. adopted April 17, 1972, by the Council., Section No. 10 stating "'Except as to projects submitted and approved,_ he PY nin`g Commission shall not rezone or p- rezone any :land to any residential use unless the Council shall, by resolution, rescind this subsection." Comm. Daly reported the Council has not rescinded this subsection. Chairman Waters opened the public hearing. Mr. Peter Sardagna, Vice- President, Caster Mobilehomes Corporation appeared before the Commission. He stated the Corporat would not be ready to start construction of any new devel- opment units until the spring of 1973 with completion anticipated for August or September, 1973. Mr. Anderson read the staff report. Chairman Waters opened the public hearing. No public testimony was offered from the flour whereupon Chairman Waters closed the public hearing. A motion was introduced by Comm. Balshaw, seconded by Comm. Popp, approving the Use Permit application°, filed by V. L. Prevette allowing a lodging home for a maximum of 4 paying guests at 1212 James Way sub - ject to recommendations as listed in the staff report. The motion was passed unanimously by all members present. CHERRY HILL Mr. McGi Vern gave a brief resume of APARTMENTS the subj'ec't request and what trans - SITE DESIGN pired at the 'Site Design Review Committee Meeting. ; The applicants were not opposed to any of the cor.a tions of approval The entire pro- ject is being held up due to a require- ment for an additional access .road - to serve the subject development. A motion was introduced by Comm. Balshaw, seconded by Comm. Popp, to approve the Revisions of the --Site -8- Petalupa City Planning Qorfimis�s- June 6', 1972 Design Review,Committee with the con- ditions as contained in the staff's recommendations with the understanding that if the additional access road extended to the plan line "extension of Liberty Street" is not obtained, then the entire Site -De-sign approval be voided. The mot was pagsed unanimously by 'all memb*brs 'present. SONOMA COUNTY Mr. Anderson read the staff report REFERRAL to a Sonoma County Referral. An application was filed by Harold Gager and Terrance Jue for a variance to allow to build 3 two-bedroom single family dwellihqs at 802 Bodega Avenue. A motion was introduced by Comm. Cerini, seconded by Comm. Hood, dir- ecting the staff to forward a letter to the Sonoma County'oard of Zoning Adjustments requestin;q I d of the subject variance based on the fact the subject item is not in accordance with the Environmental Design Plan. The motion was passed unanimously by all members present. DIRECTOR'S Mk.,MdGivern presented a report and REPORTS pictures for all the use permit vio- lators on Lakeville Street as follows: Al Stack Wrecking Yard Bafta Hide Company C&W Wrecking Yard Beaverwood Shamrock Ready Mix Owners of the businesses have been informed of their violations. The Commission requested the staff to send registered letters to the use permit , Viol-dtors notifying them of their requirement to comply with the conditions of .approval of the use permit oar a public hearing will be held to revoke the subject use permit. -9- Petaluma City Planning Commission Minutes Jun6 6, 102 Mt., MdGivern reported on the lands- capinq and general appearance of'the Petaluma ,Estates Mobilehome Park as `re(4,uested by Comm. Balshaw. The staff determined the landscaping and general appearance was in compliance with the site design approval. Mr. Mc6ivern reported on Home Owner's Lumber Company compliance with their variance. The staff notified the owners regarding. lowering the stacks of lumber whereupon the owners have complied. Mr. McGivern submitted some proposed language for the policies of the Site Design Review Committee. The Commis - s ion ion deferred this matter for a study s0s COMMISSIONERS Comm. Hood requested an amendment to REPORTS the Planning Commission Rules and Regulations be placed on the next regular Planning Commission Meeting Agenda regarding the number of affirmative votes required in Section 507. The staff was requested to draf,". the , proposed, amendment for the Commis- sions. review. Comm..Balshaw brought before the Commissions attention the problems of PG&E-, Fire hydrants, etc. in the slidewalks. A moti;on was introduced by Comm. B.a- shaw, seconded by Comm. Daly to vide policy statement by the Pla.- Commission as follows: "It is the desire of the Planning Commis that all future con- struction within the City, have no obstructions or appurtenances other than traffic control de- vices placed within the usable limits of a pedestrian sidewalk or bicycle lane." 10 Petaluma City .
