APPROVAL OF MINUTES 7L Minutes ffr August 8, 1972 stand
approved as written.
CORRESPONDENCE: Chairman Waters read a letter from
Commissioner Cerini stating his resig-
nation from the Planning Commission.
Mr. Anderson read a County Referral
for a Use Permit for a Relay Radio
Station to be located atop the Sonoma
Mountain Ridge. The Staff Report indi-
cated no adverse affects.
Commissioner Popp made a motion to send
a letter to the Sonoma County Board of
Zoning Adjustment stating no objection
to the , application. Seconded by Comm.
Daly.

Mr. McGivern brought to the attention
of the Planning Commission a Site
Design Review for McDevitt Construction
Company which was approved over a year
ago. The project site is located at
the intersection of Frates and
Lakeville Highway. His recommendation
was to grant an extension of time of
one year to begin construction of the
project.
Comm. Balshaw made the motion that we
extend the Site Design Review for one
year. Seconded by Comm. Hood*.

Chairman Waters read a letter from
Victor Nagel a property owner next to
the Fairgrounds. Mr. McGivern said
a Public Hearing has been set for the
Mr. McGivern suggested .to'the applicants
that possibly a waiver could be granted
to the condition requiring the pad
elevation to be set at +l3° mean sea
level. However, in order to grant the
waiver a written signed' statement
would be necessary from the applicant
relieving the City from any and all
responsibility or liability due to flood
damage of the property in the event of
such an occurrence.
Mr. Bettie said the damage from such a
flood would be very in his view
because the building and warehouse
material to be stored are as such that

first, .meeting in October on this prop -
etty, and the surrounding area,. A
project schedule has been sent to the
City Manager showing a schedule of all
the special Planning studies and
assignments that should be done in the
fiscal year 1913. The City Council
no doubt will .set some priorities on
the Planning schedule.

Mr. McGive'rn..read excerpts from the

the conditions given by the City Engi-
neer and Planning Staff that should be
required by the Planning Commission
before approval be given.

M.r.'Gordan Bettie, representative for
SITE DESIGN
Mr. &`Mrs. Barta (Barta- Hide), said
REVIEW
Mr. Anderson had read all the conditions
pertinent to their project, and Mr. &
Mrs. Barta were in agreement with them.
However, the requirement to build the
structure at a 13.4 foot mean sea level
elevation would bring the new building
approximately 4 feet above the street
level. No other buildings in that area
are designed or constructed that way.
The previous structure approved for
Barta -Hide was 10.407 feet. He felt
there would be some real problems if
the .13.4 foot level had to be met.
Mr. McGivern suggested .to'the applicants
that possibly a waiver could be granted

Comm,. Ba'Ishaw reminded the Commission
of a previous Use'Permit approved for
a trailer storage yard down the street
from this property He was not given
the option of'signing a waiver 4 Mr.
McGivbrn stated his staf will investi-
gate whether a waiver would suffice. If
it would,Ye.will contact the people
responsible.for the trailer storage
area sand make them aware of it. He
further indicated that the City Attor-
ney,mustbe. consulted as to the legal
aspects of wa I i - vering the flood control
recommendation,.
Comm. Daly made a motion to approve
the Site " design Review with conditions.

USE PERMIT Commission with the recommendation from
the staff to grant approval with con-
.formity to several conditions. Chair-
man Waters opened the Public Hearing.
Mr: Gordon-Bettie - Barta-Hide stated
he fully understood what has been
recommended by the staff.
Mr. Warden, C & W Auto Wrecking, spoke
against the Use Permit since he had
previously - asked ,, to have his wrecking
yard expanded and down..
He also stated people in his ' could

smell the odor from the pre"sent'quarters
of. the Barta.-Hide Company.
Mr. Al Stack, Wrecking Yard owner in
the area against the Use Permit spoke
the.,same as Mr. 1 He stated that
if he is granted a permit to extend,
then he would want one too.
Mr.. McGiverh stated - if the .odor becomes
a nuisance in the new building
the Use Perm -it can be revoked.
Comm. Balshaw made the motion to approve

The Public Hearing was opened by Chair-
man waters.. Mr. Al: 'STack stated.,-he -has
from ,2.to 3 cars dropped at his place
of business a week and it takes 2 to 3
weeks to process the papers before he
can move the .cars, when the highway was
nut in,, they took the fence down and
it still. ha_sn't been put back.
Mr,. Stack complained that Mr. Masselli,
(Use iron & steel Dealer across the street)
has bought some property next to his
present business and has extended his
fence out thereby expanding his business..
At this Point, Mr. McGiver:n commented
that Mr. Massell could be:in violation
of his business license if'ths -was
donee
Mr. Stack stated that he would bring
in a hydraulic press if he could expand
his business'. Mr'e Don Confer, a property
owner, spoke in behalf of Mir Stack ..and
commended him for the work that has
been done to clean -up the and felt
he did need more space.

Comm;. Hood had a copy of the new zoning
ordinance. He said if this_ ordinance '.
becomes effective,, wreckifiq yard uses'
could be located only in a M -G District
with-'a Use Permit,, thereby making it
not possible to expand at his present
site since the zoning is M- (Light
Industrial)
Comm. Hood made a motion that we defer
action on this for a period of 90 days
from today, ,August., 15, 1972, to give
ample time to comply with the Use Re-
quirements. Seconded by Comm. Balshaw.
This will be reviewed during the second
regular meeting in November.

C & W AUTO WRECKING This'use Permit i_s also in violation.
U21 -55 The Planning Director gave a report on
the disposition of the Use Permit vio-
lations. They were outlined as follows:
Vehicles i'n Mr. Worden's ownership parked
outside of confines of Wrecking Yard;
wreckage material stacked above fence
line; boundary fence of yard in need of
repair and paint; general clean -up of
entire site needed very badly; finally
the necessity of providing landscaping
and an attractive frontage of the prop-
erty together with the need for customer
parking..
Mr. McG.vern also noted there were
violations in health standards on the
property now.
The Public Hearing was opened. Mr.
worden stated he could take care of
the cars across the street -, but as
far as going up higher with his fence
he didn't know. He would replace the
fence that is damaged.
Comm. Daly made a motion that we defer
action on this for a period of 90 days
from today, August 15, 1972 to give
ample time to comply to the Use Permit.
Seconded,by Comm. Balshaw. This will
be reviewed during the second regular
meeting in November.

B GEO. BARTA -HIDE CO. Mr. McG'ivern read.the,staff report
U31 -71 outlining the disposition of the
present Use 'Permit. He stated with
the advent of approving the new Use
Permit and Site Design Review of the
..propos-ed new Barta .Hide operation down
the street;; this development would
solve the. problems and violations
existing on the present site. All the
old structures: on the , present site will
be abated in the next 90 days. Upon
completion of th`e new building site the
entire operation will then be moved.
Public Hearing was opened,
Mrs. Barta asked what would happen if
they take the fence down - while they are
building and the cars from .0 & W
wreckers are "still piled against it?
Mr. McGi.vern said the other property
owner would have to rebuild the fence
on his side. Mr. Ba -rta said they will
have -the building built in 2 months and
the other structure torn down in 90
days.
Comm., Balshaw made a motion to continue
this action for six months at which
time we Will make a decision. This will
give the B °arta's 3-months to build and
00 days to tear the existing structure
down,. Seconded by Comm. Daly
